THAT PETITION FOR VARIANCE N0. 3505 BE GRANTED
WHEREAS, the Anaheirt~ City Planning Commission did receive a verified
Petition for Variance from SETCO, IHC., P.O, Box 3730, Culver City, California
90331, ATTtJ: WILLIAFI L. BRANUT, owner, and ARCHITECTS ORANGE, 144 N. Orange,
Street, Orange, CA 92666, ATiN: DARREL HEDENSTREIT, aoent foc certain real
property situated in the City of Anaheim, c:ounty of Orange, State of
California described as:

OF $AID COUNTY.
WHEREAS, the City Planning Commission did hold a putlic hearing at
the Civic Center in the City of Anaheim on Sepkember 16, 1985, at 1;30 p,m,,
notice of said public hearing having been duly given as requiced by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed variance and to
invesl-iqate and make firdings and recommendations in connection therewith; and
WHEkEAS, said Commission, after due inspection, investigation and
study made by itseJ.f and iz its bchal£, and aftec due consideration of all
evidence ar,d reports of'fered at said hearing, does find znd determine the
followin9 facts:
i• That the p,~titioner proposes waivers of the following to
construct an industrial bu.ilding:
SECTIONS 18.OG.050.0212 - Minimum number of oarkinu spaces.
18.06.050.031 (654 spaces required; 285 saaces proposed)
18.06.080 AND
18.61.066.p50
Z~ That the above-r~ientioned waiver is heceby granted on the basis
that the parking waiver will not ca~se an increase in traffic congestion in
the immediate vicinity nor adversely affect any adjoining land uses and
9ranting of the parking waiver under the conditions imposed, if any, will not
be detrimental to the peace, health, safety and general welfare of the
~itizens of the City of Anaheim; and furthPr on the basis that if it is found
that additional parking is needed, tt,ere is adequate on-site space available
in landscaped areas (not including the c=quired landscaped setbacks) which can
be converted to parking spaces a, required by Code.
3. That there are exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended use of the
property that do not apply yenerally to the pcoperty or elass oE use in the
same vicinity and zone.
4. That the requested variance is necessary for the preservation and
enjoyment of a substantial property right possessed by other propert,y in the
same vicinity and zone, and denied to the property in question.

5. That the requested variance will not be materially detrimental to
the public welfare or injurious to L•he property or improvements in such
vicinity and zone in which the proper.ty is located.
6. That one person indicated their pcesence at said public heating
in opposition; and that no correspondence w~s received in opposition to
subject petition.
ENVIROIaMENiAL IhIPACT FINDIPiG: That the Anaheim City Planning
Commission has reviewed the proposal to construct an induslrial building with
waiver of rninimurn number of parkiny spaces on a rectangularly-shaped parcel of
land consisting of approximately 12.4 acres, having a frontage of
approximately 972 feet on the north side o£ Huntec Avenue, having a maaimum
depth of approximately 565 feet and being located north of the northerly
tecminu:~ of Manassero Stceet and further described as 4875 East Hunter Avenue;
and does hereby approve the Negative Declaration upon finding that it has
con~idered the Negative Declaration together with any comments received during
the public review p~ocess and further finding on the basis of the initial
study and any comments received that there is no substantial evidence that the
peoject will have a significant effect on the environment.
p70W, TFIEFEFORE, BE Ii RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Variance, upon the following
conditions which are hereby found to be a necessary prerequisite to the
pcoposed use of the subject prope~ty in order to preserve the safety and
general welfare of the Citizens of the City of Anaheim:
1. That prior to issuance of a building permit, the appropriate traffic
signal assessment fee shall be paid to the Ciky of Anaheim in an
amount as determined by the CiCy Counci.l for new industrial buildings.
2, Tnat prior to issuance 3 building permit, the owner of subject
property shall pay the appropciate ~rainage assessment fees to the
City of Anaheim in an amount as determined by the City Engineer.
3. That drainage of subject property shall be .~isposed of in a manner
satisfactory to the City Engineer.
4. That all deiveways shall be constructed to accommo~ate ten (10) foot
radius r_urb returns as required by the City Traffic Engineer.
5. Thal- prior to commencement of strnetural framing, fire hydrants shall
be installed a~~d charged as required and determined to be necessary
by the Chief of the Fire Department.
6. That trash storage areas shall be provided and maintained in
accordance with approved plans on file with the Street Maintenance
and Sartitation Division.
7. `i'h,~t in the event subject propert,y is to be divided Eor the purpose
ef ~ale, lease, or financiny, a parcel map to record the approved
division oE subject property shall be submitted to and approved by
the City of Anaheim and then be recorded in the Office of the Orange
County Recorder.

8. That the proposal Uk::,ll comply with a.il signing requirements of the
h1L(SC) Zone, unless a variance allowiny sign waivers is approved by
the Planning Commission or City Council.
9. That subject property shall be developed substantially in accordance
with plans and specifications on f.ile with the City of Anaheim marked
Exhibit Nos. 1 through 6.
10. That in the event a parking deficiency occurs Eollowing occupancy of
the su~ject property (said deficiency having been demonstrated in a
parking demand study to be funded by the property owner at the
request of the City Traffic Engineer and to be reviewed and approved
by the City Traffic Engineer), additional on-site parking ~hal] be
provided in a manner and number approved by the City Traffic
Engineer; and r_hat a covenant shall be recorded in a form approved by
the City Attorney's Uffice obligating the petitioner and any future
assignees to provide such parking if a deficiency is Found to exist.
11. That prioc to the cortimencement of the activity authorized under this
resolution, Condition Nos. 7 and 10, above-mentioned, shall be
complied with. Extensions for further time to complete said
conditions may be granted in accordance with Section 16.03.090 of the
Anaheim Municipal Code.
12. That prior to final building and zoning inspections, Condition Nos.
3, 4, 5, 6, 8 and 9, abovc-mentioned, shall be complied with.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission ~9oes
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all oF the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid or unenforceable by the final judgment oE any court of
competent jurisdiction, then this Resolution, and any app~ovals herein
contained, shall be deemed null and void.
