WHEREAS, the City Planninq Commission did hold a public hearing at
the Civic Center in the City of Anaheim on October 28, 1985 at 1:30 p.m.,
notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Ptunicipal Code. Chapter 18.03,
to hear and consider evi6ence for and against said proposed reclassification
and to investiyate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investiaation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the petitioner proposes reclassification of subject property
from RS-A-43,000 (b]HP) (Residential, AgriculLUra1 - Mobilehome Patk Overlay)
Zone tu the Rt9-1200 (Residential, Multiple-Family) Zone.
2. The Anaheim General Plan designates subject property for
commercial recreation and/or medium density residential land uses.
3. That the proposed reclassification of subject property is
necessary and/or desirable tor the ordecly and proper development of the
community.
4. That the proposed reclassification of subject property does
properly relate to the zones and their permitted uses locally established in
close proximity to subject property and to the zones and theic permitt=d uses
generally established throughout the community.
5. That the proposed reclassification of subject pr.operty requires
the dedication oE abutting streets in accordance with the Circulation Elemer.t
of the General Plan, due to the anticipated increase in traffic which wi.ll be
generated by the intensification of land use.
6. That no one indicaLeu their presence at said public hearing in
opposition; and that no correspondence was received in opposition to subject
petition.
tNVIkUNMk:N'1'AL lAIYACT FINDING: That the Anaheltn City Pldnning
Commission has reviewed the proposal to reclassify subject property from
RS-A-43,000 (MHP) (Residential, Agricultural - Mobilehome Park Overlay) to the
RM-1200 (Residential, Multiple-Family) or a less intense zone to construct a
204-unit 'affordable" apartment complex with waivers of minimum building site
area per dwelling unit, maximum structural height, minimum landscaped setback
and maximum fer,ce height on an irregularly-shaped parcel of land r.onsisti.ng of
approximately 5.9 acres located north and west of the northwest corner of
Orangewood Avenue and Flanchester Avenue, and fucther described as 8U1 East
Orar.gewood Avenue; and does hereby approve the Negative Declaration upon
finding that it has considered the Negative Declaration togethec with any
comments received during the public review process and further finding on the
basis of the initial study and any comments received that there is no
substantial evidence that the project will have a significant effect on the
environmenl-.

NOW, THEkEFORE, BE ZT RESOLVED that the Anaheim CiLy Plannir.g
Commission does hereby grant subject Petition for Reclassification and, by so
doing, that Title 18-ZOning of the Anaheim Municipal Code be amended to
exclude the above-described property from the RS-A-43,OOU(MHP) (Residential,
Agricultural - Mobilehome Park Overlay) Zone and to incorporate said described
property into the RM-1200 (Residential, Multiple-Family) Zone upon the
fol.lowing conditions which are hereby .Eound to be a necessary prerequisite to
the propos?d use of subject property in order to pceserve the safety and
general welfare of the Citizens of tne City of Anaheim:
1. That the owner of subject propecty shall irrevocably offer to
dedicate to the City oE Anaheim a strip of land 45 feet in width Llom
the centerline of the street along Manchester Avenue and 45 feet in
width from the centerline of thr street along Orangewood Avenue fc~
street widening purposes.
2. That the vehicular acces~ rights to Orangewood Avenue except at
approved access points, for the easterly 300 feet of subject property
shall be dedicated to the City of Anaheim.
3. That the owner of subject property shall submit a letter requesting
termination of Conditional use Permit No. 2259 to the Planning
Department.
4. That prior to the introduction uf an ordinance rezoning subject
property, Conditio^ Nos. 1. 2 and 3, above-mentioned, shall be
completed. The provisions or rights granted by this resolution shall
become null and void by acL-ion of. the Planning Commission unless said
conditions are complied with within one year from the date of this
resolution, or such further time as the Planning Commission may gcant.
BE IT FURTHER RESOLVED that the Anaheim City Planning C~mmission does
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid oc unenforceable by the final judgment of any couct of
competent jurisdiction, ther, this Resolution, and any approvals herezn
contained, shall be deemed null and void.
