W[iEREAS, the Anaheim City Planning Cemmission did receive a verified
petition for Reclassification from CORNELIUS W. DERUYTER AND MARY ALICE
DERUYTER, 530 North Colgate Street, Anaheim, California 928Q1 and HACIENDA
UNITED CORPORATION, 946 Everett Street, #1, Lus Angeles, Califo[nia 90026, and
HUGO A. VAZQOEZ, 619 South Live oak Drive, Anaheim, California 92805, agent
for certain real property situated in the City of Anaheim, County of Orange,
State of Califocnia, described as follotvs:

WHFREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on October 14, 1985 at 1:30 p.m.,
notice of said public hearing havino been duly given as required by Zaw and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 1R.03,
to hear and consider e idence fnr and against said proposed reclassification
and to investigate _., maka findings and recommendations in connection
there~aith; sai~ pubiic hearing having been continued to the Planning
Commission meeting of November 25, 1985; and
WHEREAS, said Commissior„ after due inspection, investigation and
study made by itself and in its beha.lf., and after due consider.ation of all
evidence and reports offered at said hearing, does find an~ determin~ the
following facts:
1. That the petitioner proposes reclassificat-ion of the northerly
178 feet of subject property from the CL (Commercial, Limited) Zone to the
RM-1200 (Residential, Multiple-Family) zone.
2. That the Anaheim General Plan designates subject property for
general commercial and/or medium density residential land uses.
3. That the proposed reclassification of subject property is
necessary ar.d/or desirable for the orderly and proper development of the
community.
+. That the proposed reclassification of subject property does
properly relat•e to the zones and their permitted uses locaZly established in
close proximity to subject pzoperty and to the zones and their permitted uses
generally established thzoughout the community.

5. That no one indicated their presence at said public hearing in
opposition; and that no ~orrespondence was received in opposition to subject
petition.
ENVIRUNI9ENTAL IMPACT FIND7~;~: That the Anaheim City F~lanning
Commission has ceviewed the pronosal to reclassify the northerly 178 feet of
subject property from the CL (COmmercial, Limited) Zone to the RM-1200
(Residential~ piultiple-Family) Zone to construct a 2-story 46-unit
'affordable" apartment complex under authority of State Government Code
Section No. 65915 with waiver of minimum building site area per dwelling unit
on a rectangularly-shaped parcel of land consisting of approximately 1.05
acres and having a frontage of approximately 164 feet on the south side of
Lincoln Auenue, rnd further described as 2230 West Lincoln Avenue; and does
hereby approve the Nega~ive Declzration upon finding that it has considered
the Negative Declaration togethec with any comments received during the public
review process and further finding on the basis of the initial study and any
comments received that there is no substantial evidence that the project will
have a significant ef:ect on the environment.
t~OW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
; Commission does heceby grant subject Petition for Reclassification and, by so
doing, thal- Title i9-ZOning of the Anaheim Munici?al Code be amended to
exclude the above-describea pr.operty frcn the CL (CCm^c:cizl, Li.mited) Zone
and incorporate said described pronerty into the RM-1200 (Residential,
tdultiple-Family) Zone.
