A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSZON GRANTING
AN E}:TENSION OF TIDIE FOR CONDITION N0. 12 OF PLANNING COMMISSION

WHEREAS, the petitioner submitted a ceguest for an extension of time
to complete Condition No. 12 of P'lanning Commission Resolution No. 84-203
pertaining to the rer_ordation of a covenant within 90 days, agreeing not to
contest the Eormation of any assessment districts which may be formed in the
future and w:~ich may inc.lude subject property; and
WHEItEAS, the petitioner indicates they are cur.rently in the process
of preparing the necessary documents and plan to cecord the covenant within
the next 90 cays; and
WHEREAS, the City Planni~g Commission did hold a public hearing at
the Civic Center in L•he City of Anaheim on November 25, 1985, at 1:30 p.m.,
notice of sai9 public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Fiunicipal Code, Ch•~pter 18.03,
to hear and considec evidence for and against said proposed to amend the
condition of ~3pproval of Conditional Use Permit Nc. 2623, and to investigate
and make findings and recommendations in connection rherewith; and
wHF.RFAS, said Commission, after due inc=ectior., investigation and
study rnade by itself and in its behalf, and after due consideration of all
evidence and [eports c~ffered at said hearing, DOES N~REBY FIND:
1. TY.at no one appeared at said public heacing in opposition; and
that no corr.espondence was rec?ived in opposition to the subject request.
2. That a maximum 90 day extension be granted for compliance with
Condition No. 1:: of Planning Cortur,ission Resolution No. 84-203.
EpIVIRONMENTAL IMPACT FINDING: That a Naqativa beclaratl0n was
previously appro~~ed on October 1, 1984, and no further action is necessary.
NOW, ThEREFU£.E, BE IT RESOLI~ED that the Anaheim City Planning
Commission does hereby grant a maximum 90-day extension of time, from the date
of this resolution, for compliance with Condition No. 12 of Planning
Commission :;esoiution No. PC84-203.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that ~doption of this Res~lution is expressly
predicated upon applicant's compliance with each and all of the condikions
heteinabove set £orth. Should any such conditions, or any pact thereof, be
declared invalid or unenforceable by the final judgment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be cleemed nu~l and void.
