WHEkFAS, the City Planning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on December 9, 1985, at 1:30 p.m.,
notice o.f said public hearing having been duly given as reguired by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
p2rmit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and

evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the proposed use is properly one fo~ which a conditional use
permit is authori2.ed by Anaheim !9unicipal Code Section 18.44.050.130 to wit:
to permit a chucch in the CL (Commercial, Limited) 7.one with waiver of the

2. That the requested waiver is hereby granted on the basis thal- the
parking waiver will not cause an increase in tcaffic congestion in the
immediate vicinicy nor adversely affect any adjoining land uses because the
church use will pcimarily take place on Sundays; and that granting oF the
parking waiver under the conditions imposed, if any, will not be detrimental
to the peace, health, safety and general welfare of the citizens of the City
of Anaheim.

years, to terminate on December 9, 1987.

adeyuate to allow th~~ full development of the pzoposed use in a manner not
detrimental to the particula~ area nor to th~ peace, health, safety and
general we2fare of the Citizens of the City uf Anaheim.
G. That the granting of the Ccnditional U=e Permit under the
conditions ;mposed, if any, will not be detrimental to the peace, health,
saEety a:~d general welface oi the Citizens of the City of Anaheim.
i. That the trafEic generated by the proposed use will not impose an
undue burden upon tne str~ets and highway~ designed and impcoved to carcy the
traffic in the area.
8. That no one :ndicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the
subjecC petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planning
Cornissicn has revieked :he gropo~al to permit a church in the CL (Commercial,
Li!i~ted) Zune with waiver of minimum number of parking spaces on an
irregulacly-shaped parcel of land consisting of approximately 2.9 a~=es with a
frontage of approximately 1,080 feet on the souCh side of Orangethorpe Avenue,
located approximately 900 feet east of the centerline of Miller Str.eet, and
further described as 3452 and 3456 East Orangethorpe Avenue; and does hereby
approve the Negative Declaration upon finding thaG it has considered the
Negative Declaretion tcgether with any comments received during the public
review process and further finding on the basis of the initial study and any
comments received ttiat thece is no sLbstantial evidence that the project will
~arA a Ginnif;r~nr ~ff~ct ~n tnF envir~nment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commission does hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found co be a nece~sacy prerequisite
to the proposed use of the 3ubject property in order to preserve the safety
and genera2 welfare oY the Citizens of the City of Ar.aheim:
1. That p[ioc to issuance of a building permit, primary water main fees
shall be paid to the City of Anaheim, in an amount as deter~ined by
the Uffice of the Utilities Genecal Manage[.
2. That trash storage areas sha12 be provided and maintained in
accordance with appcuved plans on file with the Street Maintenance
and Sanitation Division.
3. Tnat due to the chan~e in use and/or occupancy of :he building, plans
shall be submitted to the Building Division showing compliance witt~
thc minimum standards of r.he City of Anaheim, including the Uniform
Building, Plumbing, Electrical, Mechanical and Fire Codes as adopted
by the City of Anaheim. The appropriate permiCS shall be obtained

4• That the proposal shall comply with all signing requirements of the
CL Zone, unless a variance allo•.~ing sign waivecs is approved by the
Planning Commission or City Council.
S• That the use of the premi~es for church servicec and acti•ritie~ shall
be limited to the following hours:
Dlednesday 7;OU p.m. - 9:30
Sunday 8:00 ~,m, P.m.
- 1:00 p.m.
5:00 p.m. - 9:00 p.m.
6• That subject propECty shall be d?veloped substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 and 2,
~• That prior to issuance of a building permit, or within a period of
one year from the date of this resolut:on, whichever occurs first,
Conditior, Nos. 1 and 3, above-mentioned, shall be complied with.
Extensions for furthec time to complete said conditions may he
9~anted in accordance with Section 18.p3.090 of the Ar,aheim Municipal
Code.
8• That prior to final building and zoning inspection=, Condition Nos. Z
and 6, above-mentioned, shall be comp:ied with.
9• That this permit shall t?C~IRJCE on Drcember 9, 1987,
BE IT FURTHEP, RESOiVED that the Anaheim City l~lanning Commission does
hNreby find and determine that adoption oE this Resolution is expressly
predicated upon applicant's compliance with ea~h and all of the conditions
nereinabove set forth, Should any such conditions, or. any part thereof, be
declared invalid or unenforceable by the final judoment of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
