WHEItEAS, the Anaheim City Planning ~omnis:;ion did receive a verified
Petition for Conditional Use Peemit from ROBERT C. STOVALI, AND LOIS STOVALL,
1110 West Katella Rvenue, Anaheim, California 92805, owners, and JAMES
STOVALL, 1870 South Chris Lane, Anaheim, California 92805, agent fo[ certain
real proper.ty situated in the City of Ar.aheim, Ccunty of Orange, State of

WHEREAS, the City Planning Commission did hold a public hearing at
the Civic Center in the ~±ty of Anaheim on December 9, 1985, at 1:30 p.m.,
notice of said oublic hearing `:=~ing been duly given as required by 'law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 28.03,
to hear and consider evidence for and again~t said pcoposed conditional use
permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
~tudy made by itself and in its beha.Lf, and after due consideration of all
evidence and reports offered at said hearing, does find and determine the
following facts:
1. That the pcopesad use is pcoperly one for which a conditional use
oecmit is aul•harized by Anaheim Municipal Code Sertion 16.61.050.470 to wit:
to permit a limousine and bus rental service in cne i+i (Industrial, Li~ited)
zone.
2. That the proposad use will not adversely affect the adjozning
land ~ses and I:he gcowth and development of the area in which it is propa~ed
to be located.
3 That the size and shape of ~he site proposed for the use is ,
adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and ->:5
general welfare of the Citizens of the City of Anaheim. _

6. That no one indicated their presence at said public hearing in
opposition; and that no correspondence was received in opposition to the
subject petition.
ENVIRONMENTAL IhPACT FINDING: That the Planning Director or his
authorized representative has etermined that tf~e proposed project falls
within the definition of Categorical Exemptions, Class 3, as defined in the
State EIR Guidelines and is, therefore, categorically exempt from the
requirement to prepare an SIR.
NO~J, THEREFORE, BE IT RESOLVED that the Anaheim City Planning
Commissi.on does l~ereby gcant subject Petition for Cc~ditional Use Permit, upon
the following conditions which are hereby f.oun9 to be a necessary prerequisite
to the proposed use of the subject property in ocder to pce:serve the safety
and general welfare of the Citizens of the City of Anaheim:
7.. That trash storage areas shall be provided and maintained in
accordance with approved plans on file with the Street Maintenance
and Sanitation Division.
2. That the proposal shall comply with all signing requiremen~s of the
ML Zone, unless a variance allowing sign waivers is approved by the
Planning Commissi.on or City Council.
3. That no outdocr work on vehicles or vehicle parts or storage thereof
shall be permitted.
4. That pr.ior to the commencement of the activity authorized under this
refiolution, or prior to tt;e time that a building permit is issued, or
within a n~;,iod of ninetl (9U) days from the date of this resolution,
whichever occurs first, the owner(s} ~f subject property shall
execute and record a covenant in a form approved by the City
Attocney's Office wherein such owner(~) agree not to contest the
formation of any assessment district(sj which may hereafter be formed
pursuant to the provisions of Develop;nent Agreement No. 83-01 between
the City of Anaheim and Anaheim Sta~ium Associates, which district(s)
could i.^.cltlde such o;-;ncr'a propecty. c'aiiure to comply with this
condition within the specified tir,ie ~hall render tnis conditional use
per.mit null and void.
5. That. subject p~operty shal.l be developed substantially in accordance
with plans and ~peciEications on file with the City of Anaheim marked
EXhibit No. 1.
6. That Condition No. 4, above-mentioned, shall be completed ~aithin a
period of ninety (90) days from the date of this resolution.
7. That prior to final building and zoning inspections, Condition Nos. 1
and 5, above-mentioned, shall be complied with.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine that adoptior of this Resolution is expressly
predicaEed upon applicant's compliance with each and all of the conditions
hereinabove set foeth. Should any such conditions, or any part thereof, be
i3eclared invalid or unenforceable by the finsl judgment of any court of
t~ competent jurisd.iction, then this Resolution, and any approvals herein
