THAT PETITION FOR CONDITIONAL USE PERMIT N0. 2746 B^c GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Petition for Conditional Use Permit frorti SOUTHERN PACIFIC COMMUNICATIONS
COMPANY, C/0 GTE SPRINT COMt4UNICATION CORPORATION, P. 0. aox 974, Burlingame,
California 94010, ATTN: JACK DAVIDSON, owner, and JORDAN ARCHZTECTS, INC.,
18218 McDUrmott, #D, Irv.ine, California 92714, agent for certain real property
situated in the City of Anaheim, County of Orange, State of California,
described as:

WHEREAS, the City Ylanning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on December 9, 1985, at 1:30 p.m.,
notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and make findirgs a~d recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in ics behalf, and after due consideration of ali
evidence and reports otfered at said hearing, does find and determine the
following facts:
1. That the proposed use is properly or.e for which a conditional use
permit is authorized by Anaheim Municipal Code Section 18.61.050.433 to wit:
to pernit a public self storage facility and cn-sire manager's residen~e with
waiver of the foliowing:

2. That the requested waiver is hereby qranted thak the parking
waiver will not cause an increase in trafEic cong=stion in the immediate
vicinity nor adversely affect any adjoining land uses and granting of the
parking waiver under the cond?tions imposed, if any, will not be detrimental
to the peace, t:ealth, safety and general welfare of the citizens of the City
of Anaheim.
3, Tbat the prcposed use will not adversely affect the adjoining
land uses and the gror+th and development of the area in which it is proposed
to be located.
i 4. That the size and shape of the site proposed for the use is
`; adequate to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health, safety and

5. That the granting of the Conditional Use Permit undec the
co[~ditions imposed, if any, will not te detrimental to the peace, health,
safezy and general welface of the Citizens of the City of Anaheim.
6. ThaL- the traffic generated by the proposad use will not impose an
undue burden upon the streets and highways designed and improved to ca-ry the
traffic in the area.
7. That no one indicated their presence at said public hearing in
opposition; and that no correspondence was r.eceived in opposition to the
subject petikion.
ENVZRONMENTP.L IMPACT E~iNDING: That the Anaheim City Planning
Commission as reviewe t e proposa to permit a public self stocage facility
and on-site manager's residence with waiver of minimum number of parking
spaces on a rectangularly-shaped parcel of land consisting of approximately
1.52 acrea, having a frontage of approximately 240 feet on the south side of
Penhall Way, located appr~ximately 425 feet east of the centerline of Crescent
Way; and fucther described as 1776 Penhall Way; and does hereby approve the
Ne9a~ive Ueclaration uoon finding that it has considered the Negative
Declaration together with any comments received during the public review
process and iurther finding on the basis of the initial study and any comments
received that there is no substantial evidence that the project will have a
significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City P]anning
Commission dues hereby grant subject Petition for Conditional Use Permit, upon
the following conditions which are hereby found to be a necessary prerequisite
to the proposed use of the subject property .in order to preserve the safety
and general welfare of the Citizens of the City of Anaheim:
1. That prior to issuance of a building permit, the appropriate traffic
signal assessme~~c Eee shall be paid to the City of Anaheim in an
amount as deternined by the City Council for new commercial buildings.
2. That sidewalks shall be installed along Penhall Way as required by
the City Engineer and in accordance witii standard plans and
specifications on file in the Office of the City Engineer.
3. That all drireways shall be constructed to accommodate ten (10) foot
radius curb returns as required by the City Traffic Engineer.
4. That drainage of subject property shall be disposed of in a manner
satisfactor}• to the City Engineer.
5. That in the event subject propecty is to be divided for the purpose
of sale, lease, oc financing, a parcel map to record the approved
division of subject property shall be submitted to and approved by
the City oE Anaheim and then be recorded in the Office of the Orange
County Recorder.
6. That l•he owner of subject propecty shall pay to the City of Anaheim a
fee for street li9hting along Penhall Way in an amount as determined
' by the City Council,

7. That prior to commencement of structural framing, fire hydrants shall
be installed and chara~d ns zequired and determined to be necessary
by the Chief of the Fire Department.
8. That fire sprinkler.s shall b? ;nstalled as required by the City F~re
Marshall.
9. That trash storage areas sha].1 be provided and maintained in
accordance with appcove6 plans on file with the Street Maintanance
and Sanitation Divinion.
10. That all lockable vehicular access gates shall be equipped with a
'knox box° device to the satisfaction of the City Fire ntarshall.
11. That gates shall not be installed across aqy driveway in a manner
which may adversely affecr vehicular traffic in the adjacent public
street. Installation of ar,y gates within a distance of forty (40)
feet from said public street right-of-way shall be subject to the
review and approval of the City Traffic Engineer.
12. That the proposal shall comply with all signing requizements of the
ML Zone, unle~s a variance allowing sign waivers is approved by the
Planniny Commission or City Council.
13. That subject property shall be developed substantially in accordance
with plans and specification: on file with thP Ci.ty of Anaheim marked
Bxhibie Nos. 1 through 4.
14. That prior to issuance of a building permit, or within a period of
one year from the date of this resolution, whichever occucs first,
Condition Nos. 1 and 6, above-mentioned, sFall be complied with.
Extensions foc further time to complete said conditions may be
granted in accordance with Section 18.03.090 of the Anaheim Municipal
Code.
15. That prior to final building and zoning ins~ections, Condition Nos,

HE IT FURTHF.R RESOLVED that th~ Anaheim City Planning Commission does
hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgm?nt of any court of
competent jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void.
THE FUREGOING RESOLUTION is aigned and approved by me this 9th day of
