WHEREAS, the City Plznning Commission did hold a public hearing at
the Civic Center in the City of Anaheim on February 4, 1985 at 1:30 p.m.,
notice of said public hearing having been duly given as required liy law and in
accocdance with the provisions of the Anaheim Municipal Code. Chapter 18.03,
to hear and consider evidence for and against said proposed reclassification
and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and ceports offered at said hearing, does find and determine the
following tacts:
1. That the petitioner proposes reclassification of subject
property from the RS-A-43,OU0 (Resideeti.al/Agricultural)ZOne to the RM-1200
(Residential, Multiple-Family) Zone.
Z. That the Anaheim General Plan designates subject property for
medium density residential land uses.
3. That t~e proposed reclassification of subject property is
necessary and/or desi~aule fo~ the ordecly and proper development of the
community.

4. That the proposed reclassification of subject pcoperty does
pcoperly relate to the 2ones and their permitted uses locally establist,ed in
close pcoximity to subject property and to the zones and their permitted uaes
generallY established throughout the comnunity.
5. That the pcoposed reclassification of subject property requires
the improvement of abutting streets in accordance with the Circulation Element
of the General Plan, due to the anticipated increase in tra£fic which will be
generated by the intensification of land use.
6. That t_wo interested persons indicated their presence at said
public hearing; and that no correspondence was received in oprosi:ion to
subject petition.
ENVIRONMENTAL IMPACT FINDING: That the Anaheim City Planninq
Commission has reviewed the proposal to recl~ssify subject p:operty from the
RS-A-43,000 (Residential/Agricultural) Zone to the FM-1200 (Residential,
Multiple-Family Zone to constr~:ct a 24-unit apactment complex with waivers of
maximum structural height and requirpd block wall on a rectangularly-~haped
parcel of land consisting of approximately 0.83 acre, having a frontage of
approximately 148 feet on the west side of Dale Avenue, and being located
approximately 300 feet south of the centerline of Lincoln Aver.ue; and does
hereby apProve the Uegative Declacation upon finding that it has considered
the t7egative Decl~ration tegether with any comments received during the public
review proce^:~ ~nd Eurther findin9 on the basis of thc initial study and any
comments recaived that there is no substantial evidence that the project will
have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plar.ning
Commission does hereby yrant subject Petition for Reclassification and, by so
doingr that Tit1e 18-2oning of the Anaheirn Municipal Code be amended to
exclude the above-desccibed property from the RS-A-43,000
(Residential/Agricultural) Zone and to incorporate said described pcoperty
into the RM-1200 (Residential, Multiple-Family Zone upon the following
con~i.tions which are hereby foand to he a nececsary nr~rAm~isito ro ~.~A
proposed use of subject property in order to preserve the safety and gereral
welfare of the Citizens of the City of Anaheim:
1, That stceet lightiny facilities along Dale Avenue shall be installed
as required by the Utilities General Manager in accordance with
specifications on file i~ the office of Utilities General Manager,
and that security in the form of a bond, certificate of deposit,
letter of credit, or cash, in an amount and form satisfactory to the
City of Anaheim, shall be posted with the City to guarantee the
satisfactory completion of the above-mentioned improvements. Said
security shall be posted with the City of Anaheim priur to
introduction of an ordinance rezoning subject property. The
a6ove-required improvements shall be installed priar to occupancy.

Thac pcior to the introduction of an ordinance rezoning subject
property, Condition No. 1, above-mentioned, shall be completed. The
provisionc or rights granted by this resolution shall become null
and void by action of the Planning Commission unless said conditions
are complied with within one year from the date of this cesolution,
oc such further time as ths Planning Commission may grant.

BE IT FURTHE~ RES~LVED that the Anaheim City Plannin9 Commission
does hereby find and determine that adoption of this Resolution is expre3siy
predicated upon applicant's compliance with each and all of the conditions
hereinabove set forth. Should any such condition, or any part thereof, be
declared invali? or unenforceable by the final judgment of any ~ourt of
competent jurisdiction, then th;s Resolution, and any appcovals herein
contained, shall be deemed null and void.
