A RESOLUTION OF T}IE ANAHETM CITY PLANNING COMMISSIGv
THAT PETITION FOR CONUITIONAL USE PERMIT N0. 2656 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified
Ietition for Conditional Use Permit fcom STEWART, GREEN ASSOCZATES, 2180 East
Lincoln Avenue, Anaheim, Caiifornia 92806, ATTN: KARL MEADER, owner of certain
ceal property situated in the City of Anaheim, County of Orange, State of
California, described as:
SEE ATTACBED "EXHIBIT A."
WHEREAS, the City Planning Commissi.or did hold a public hearing at
the Civic Center in the City of Anaheim on Pebruary 4, 1985, at 1:30 p.m.,
notice of said public hearing having been duly given as required by law and in
accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use
permit and to investigate and mal:e findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation and
study made by irself and in its behalf, and after due consideration of alI
evidence and ceports offered at said hearing, does find an~J determine the
followinq facts:
1. That the proposed use is properly one for which a condltional
use permit is autP,orized by Anaheim Municipal Code Section 18.44.050.010 to
wit: to permit on-sale beer and wine in a proposed restaurant with a waiver of
the £ollowin9:

2. That the requested waivee is hereby granted on the basis that the
parking variance will not cause an increase in traffic congestion in the
immediate vicin~ty nor advecsely affect any adjoining land uses; and that the
granting of the parking variance under the conditions imposed, if any, will not
be detrimental to the peace, health, safety or general welfare of the citizens of
the City af Anaheim.
3. That the proposed use is hereby granted on the basis that the
proposed re~taurant is smaller, requirin9 less parking, than a previously
approved restaurant and the conditiunal use permit for said la~ger restaurant
will be tarminated prioc to utilization of subject use permit.
4. That the proposed use will not adversely affect the adjoining land
uses and the growth and development of the area in which it is proposed to be
located.
5. That the size and shape of the site proposed for the use is
adequate to allow the full development of the proposed use in a manner not
detrimental t~ the particular area nor to the peace, health, safety and genecal
welfare of the Citizens of the City of Anaheim.

period of one year from the date of this resolution, whichever occurs
first, Condition No. 5, above-mentioned, shall be complied with.

in accordance with Section 18.03.090 of the Anaheim Municipal Code.
8. That prior to the commencement of the activity authorized under this
resolution, or final building and zoning inspections whichever occurs
first, Condition Nos. 1, 3 and 6, above-mentioned, shall be complied
with.
BE IT FUkTHER RESOLVED that the Anaheim City Planning Commission does
hereby find and determine tt~at adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabove set focth. Should any such conditions, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of competent
jurisdiction, then this Resolution, and any approvals herein contained, shall be
deemed null and void.
