WHEREAS, the r_itY planning Commission did }~old a public hearing at

accordance with the provisions uf the Anaheim 9qun cipal eCodeedC:~apter 18a03n
to hear and consider evidence f.or and agains~ said proposed reclassification
and to investigate and make finc9ings and rec~mmendations in connection
therewith; and
WHEREAS, said Commission, after due insY~ction, investigation and
study made by itself and in its behalf, and after due consideration of all
evidence and reports offered at ~aid hearing, does find and determine the
following facr.~;
1• That the petitioner propose~ reclassificrtion of subject
property from the RS-A- 43,000 {Kesidential, Agricultural) Zone to the RM-1200
(Residential, Multiple-Family) Zone.
Z• That the Anaheim General Plan desiy~.al:es subject property for
medium-density residcntial land uses.
3• Tliat the proposed ceclassitication oE su5ject property is
necessary and/or desirable for the ordecly and proper development of the
~o~~inity.

4. That the proposed reclassification of subject property does
properly relate to tne zones and ti:eir pern;itted uses locally established in
close proximity to subject property and to the zones and their permitted uses
generally established throughout the ccne~iunity.
5• That no one indicated their presence at said nub].ic hearing in
opposition; and that no correspondence was received in opposition to subject
petition.
ENVIRONFIENTAL IMPACT FTNDING: That the Anaheim City Planning
Commission has reviewed the prooosal to reclassiEy subject proFerty from the
xS-A-43,000 (Residential, Agricu.ltural) Zone to the P.M-1200 (Residential,
Multiple-Family) Zone to construct a 60-•unit affordable apartment complFx with
waiver of minimum building ,ite area per dwelling unit on a
rectangularly-shaped parce). of .land consisting of approximately 1.6 acres,
having a frontage of approximately 222 feet on the north side of Lincoln
Avenue, and further described as 3233 Y7est Lincoln Avenue ; and dues hereby
approve tha Negative Dec]aration upon findir,g that it has considered L•he
Negative Declaration together with any com;~ients received during the public
review pcocess and further finding on t;e basis of the inizial atudy and any
cumments receiced that there is no substantial evidence that the project will
have a signiFicant effect on the environment.
N~W, ThERu^FORE, BE IT RESGLVED that the Anaheim City Planning
Commission dues hereby grant subject Petition for Reclassification and, by so
doing, that Title 18-ZOning of the Anaheim Municipal Code be amended to
exclude the above-described property from ttie F.S-A-43,000 (Residential,
Agricultural) Zone and to incorporate said 2ascribed property into the RM-1200
(Residential, Multiple-Family) Zone upon the following conditions which are
hereby f.ound to be a necessary prerequisice to the proposed use of subject
property in order to preserve t:~e sa:ety and general welfzre of the Citizens
of the City of Anaheim:
1. That the owner(s) of subjecc propecty shall submit a letter
requesting termination of Variance No. 975 to t!ie Planning
Department.
z. That prior to the introduction of an ordinance rezoning subject
property, Condition No. 1, a6ove-mentioned, shall be completed. The
prcvisions or rights granted by this rAsolation shall become null
and void by action of the Planning Commia;sion unle~s said conditions
are complied with within one year from the dat~ of this :eeolutien,
or such further time as the Planning Commission may grant.
BE ZT PURTHER RESOLVED that the Anaheim City Planning Commission
does hereby find and determine that adoption of this Resolution is expressly
predicated upon applicant's compliance with each and all of the conditions
hereinabnve set forth. Should any such condition, or any part thereof, be
declzz::d invalid or unenforceable by the final judgment of any court of
competent jurisdictio*~, then this Resolution, and any approvals herein
contained, shall be deemed nu11 and void.
