WHEREAS, pursuant to the au~hority set forth in Califurn3a Government
Code Section b5~l64, City of Anatieim Ordina:zce No. ~1377 and Resolution No.
a212-565 (ProcFClures Fesnlu~ion), ~hQ City has raceived an application £rom the
developer requesting adoption of an amended and restated Devaloprnent Agreement
No. 88-03 in connection with The Summit oi Anaheim Hil1s Specific Plan Noe
88-2 developmen: area encompassing aiaproximately 591 acres g~nerally lcc~ted
southeasterly oi th.e southeriy terminus of Weir Canyon Road and Santa Ana
Canyon hoad; and
WHEREAS, on J'une 21, 1.988, the Ci~y Council adopted Or.dixiance No. 4935
autharizing the execution of bevelopment Acaree-ne:at No. 88-03; and
4IHERLAS, the ?lanning Department deemed it app:opriate, pursuant to tha
pro~~isions of the Califurnia Environmental Quality act, to prepare a
supplement to EnvironmeiiL-al Impact Repurt No. 287. (~IR No. 2Ei1 was previously
certified by the City Council on June ~0, 19ff7, in connection with the Oak
Hills Ranch Genoral P].an Amendment No. 223 axid Planned Community Zone
Roclassification No. U6-87-19) in cnnnr~ction wi#:h ~eneral '1an Amendment No.
24~1 anfl Specific F~lan No. 88-i for the proposed de~velopmont of the property
=~oferred to as The Summit of Anaheim Hills; and
WH~.REAS, the City Plr~nning Commission did hold a public hearing at 1:he
Civic Center in the City of Anaheim on 5ep4:ember 26, 1988, at 1:30 p.m.,
n~tice of said public hearinq havirig been duly givQn as required by law and in
accordar.ce with the provisions of the Anahoim Municipal Code, l:hapi:or ':8.03,
to hear and consi.der evi.dence .for anc~ against said proposod SpeciEic P3.an
including xoniizg ancl dc~vo'lopment standards and a~uhlic faciliti.es plan,
General Plan Amendment No. 24~1, a Fiscal Impact Analysis, and amended and
rQStated Devalo~ment AgreemQnt plo. 80-03, and to investigate and make fi.ndings
and rec~mmendations in connection l:~erewii:2i; and sazd petitior~ having
continued tu the meetinq of October 10, 1988, and
WHEREAS, throuc~h the arnendod and resr_ated D~v~lopmerit Agreement, the
developer is seeking assu:ance that tha City will pormxt developmen.t of tho
nroject in accordance with the tarms and con~itions seC fort2i in the propose~l
AgreemQnt and in the development approval; and
