A RESOLUTION OF TWE ANAHElM CITY PIANNING CQMMISSION
APPROVIN~ REVISED PLANS FOR ;
CONDITIONAL USE PERMIT N0. 3547 (READVERTISED)
WHEREAS, on Decembor 14, 1~J2 the Anaholm City Planning Commisslon approvod
Conditlonal lJse P~ •mlt No. 3547 permftting a 7a0 aquare foot storage room and fraezer unit aiditlon to ~
retall center on property located at the northoast corner of Sycamore Street and East Streot having
approximate frontages of 190 feet qn the oast aide oF East Street, 229 feet on the north side of Sycamore
Street end 229 feet on the south side of Glenwood Avenue, and further described as 5U0 - 530 Narth East
Street; and

WH~REAS, tha potitianer currently requests approval of revlsed plans to permit a 551 sq,ft. ,
expansion to the existing commerclal retail centor wfth weivers of minimum number of parking spaces and
maximum structural height within 150 feet af a single family rosfdentlal zone boundary; and
WHEREAS, the Qity Plannfng Commission did hold s public hoaring at tho Clvic Center in
the City nf Anaheim on Septernber ?.0, 1993, at 1:30 p.m., n~tice ot safd public hearing having been duly
given as requfred by law and in accordenco with the provislona of the Anahelm Munlcipal Code, Chapter
1a.03, to hear end ccnsider evidence fur arid against ~aid praposed revislons to plans and to investigate
and make findings and recommendatlons In connection therewith; and '!
WHEREAS, satd Commission, aker duo inspectiori, invostigation end etudy made by Itselt
and in its behali, and after due consfderatlon of all evidence and reports offered at sairJ hearing, does find
and determine the following facts:
1. Thet the petitioner requests revtew of revlsed p{ans to permit a 551 sy.ft. expansion to an

6. That strict applicatlon of the Zoning Code deprives the property ~f privileges enJoyed by
other propertles under identical zoning classiiication in the vicinity;
7. That the proposed use is properly one for which a conditlonal use permit is ~uthorizod by
the Zoning Code;
S. That the proposed expansion is for storage only and will not adversaly aHect tr~e adJoining
land uses an~! the gr~wth and develapment of the area;
9, That the size and shape of the sfte for the proposed use ~s edequate to allow the fuil
development pf the prapo3ed use in a manner not detrimental to the part~cular area nor to the peace,
f ~,.alth, safery, end general welfare;
10, That the traffic genera4ed by the proposed usa wlll not impose an unduv turden upon the
streets and highways designed and fmproved to carry the traffic in the area;
11, That the grantfng af the conditlonal use permit under the conditions imposad will not be
detrimental fn the peace, h9aith, safety and generai welfare of the cftizens of the Ciry of Anahsim; and
12, 7hat no one Indicated their presence at said {~ublic hearing in oppositlon; and that no
correspondence was received in opposftlon to tha subject petition.

Commisylon has revlewed the proposal to permft a 551 sq,ft. expansian to an exlsting commercial retail

approved '.~ connectlon with Cundltional Use Permit No. 35~17 is adoquate to sf,Ne ~s the requlrecl
environmantAl documentation In connection with this request upon finding that the d0claration reiiecta tho
indapendent Judgement ot the lead agency and that (t has considered lhe Negative Declaration 4ogether
with any comments received during the public review process and furthor finding on the basis of the initial
study and any comments recelved that there is no substantial evidence that ihe project wlll have a
significant eftect on the environment.
NOW, THEREFORE, B~ IT RESO4VED that thd Anahelm City Plenning Commission does
hereby approve the revised plana for Conditioral iJse P~rmft No. 3547 u~On the following condltions which
are hereby found to be a nocoasary prerequfsfte to the proposed use al the subJect properry in order to
preserve the safety and general waltare of the Citizena af the Ciry of Anehaim:
1. That subject property shall be developed substantiaily in aacordnnce wtth plans and speciffcatiuns
submltted to the City of Anaheim by the patitfoner and which plans are on file with the Plannin~
Gepartment marked Revialon Np. 2 oi Exhibft No. t end Revision No. t of Exhibit Nos, 2 and 3.
2. That prior ta ilnal buildfnp and zoning inspection3 or withfn a psrlod of one (1~ yeer from the d~te 4,'`~
of this resol~rtlon, whichever occurs tirst, Conditlon No. 1, above•mentlonod, shall be complled with. ~~

3. That approval of thls application constitutes epproval of the proposed request anly to the extent that
it complies wlth the Anahelm Municipal Zoning Code and any othorapplicabie City, State and Federal
reguletians. Approval does not Include aiiy action or iindings as ta complisnco or baproval of tho
