III. DEFINITI~N:, A. The "Business Owner" is that person(s) who is registored witt~ the City's Business Licenoo Division undor the busfness entity and a~dress identified on the sign. B. The "Property Ownor" fs that person(c) to whorn the property is assessed on the last equalized County tax assessment rotl available at tho date the noticQ ~pruvided for in paragr~ph D-1 of Section V) Is sent. r. Tho notice will request Praperty, Busmess and Sign Owners to indicate tFieir interest in participAting in tho program within s(xty (60) da~s of rocoipt of the notice. As responses are roturned, the respondents will be placed on a chronological prlority Ilst In the order recofved. 2. For th~e properties ~dentifiecl in C-1, the tollowing shall apply: a. As funding permits, tlie City will meet '~vith the Property, Business anci/or Sign Owners to determine the following: ~) The location of the replacement signage and de~i~n of the sign faco (the PrAperty, Business and/or Slgn Owner wlll desi~n the siqn tace In accordance v~ith the requirerrients for ti~e property as cet (orth in tha applicable Specffic Plan; 2) A prelfminary evaluatfon of repairs, ff any, that may be needed to the property re~ulting from the remavai of the nonconforming pole signage; and, 3) The date and time for the removal and replacement of the nonc~nforming pale signaga. b. Prlor to the ~ommQncement of any work an the property, the Property Owner, Business Owner ard Sign Owner shall enter fnto an agreement with tho City of Anahelm, au[horizing the City or its agonts to enter tho property and comptete the above-described work. Said agreemont shail be subj9ct to the approval of the Cfty Manager or his/her designee. c. Rernoval, replacoment and repafr work will be periormeci by a Iicensed contractor on contract with the City. Pric~r to commencement of removal af the nonconforming pole sign, the Property, Businass and/or Slgn Ownor shall meet with the Clty to dotermfne the lacatlon of the replacoment signaye, obtain a sign permit and provide the City with the ost(mated cost prepare~l by the City authorizod contraot~r of removing and replacing tiie nonaonforming pole sign with conforming slgnac7e. b. Following receipt of the estimate, the Property, Business and/or Sfgn Owner shall enter into an agroernent with tho City of Anaheim wherein the City will reserve $5,000.00 for a perlod of up to sixty (6U) days, unless otherwise extended by the City. The agraoment shall further spdcify that the City shall pay dlrectly to the slgn contractor wfio completes tlie ectual removal and/or replacoment wcrk, $5,000.00 foliowing suk~mittal tu the City of a receipt verifylnfl the actual cost of removal and replacemont of the nonconforminc~ pola signage in accordance with the sic~n permit and final City inspoction. In no case shall the City pay a sign contrector mor•e than the actual cost of removal and replacement af the noncontorminy polo signage. VI.
