WHEREAS, thA Gity of O.naheim ("City") fs an area oi nationel and Intornational int~rost as
a tourf~t and conventlon center and many mlllions o( dollars have beAn spent in the development of hotels,
motels, restHUrants and other sorvice-type businesses to accommodate the large number af tourists and
visftors r.omfng annually to thQ Ciry of Anahelm; and
WHEREAS, the visitor and convantion business pl~ys an important r~te In the proaperity and
-;ui~~~-~ ~+i the City of Anahofm ancl of its citizens; and
WHEHEAS, the City has for many years recognized the impact of the tourist r~nd convantion
husinetiR on the generFt! economy and has encouraged the orderly development of the area in And arouncl
r,e An3h~im Convent(on Center ar,d 171sneyland by impos(n~ strict zoning pro~eclures for developrnents In
the uroa and by deKignation of the aroa In the clase proximity oi and including tho Anahelm Conventiun
C~ter and Disnoyland as CommerciAl Recr~~Non in the General Plan of the City; and
WHEI~EAS, the City initiatecl Nlanning eilorts in 19A9 for the long-term devolopment strategy
and enhancament o( the erea known as the Anaheim Fiesart (form9rly roferred to as the Commercial
Recreatlon Area), fncluding adoption of revlslons to the C-R Zon(ng Ordinance and adoptlon of Deslpn
Guidellnes In 19~30; and
WHEREAS, the Anahefm Resait encompasses approxlmately 1,046 acres generally located
adjacent to and southwest of the Santa Ana Freuway (I•5). Thls eroa Is accesslblo (rom Harlsor 8oule~~rd,
Bali Road, Freodman Way, Katella Avenue, West Street, Amngewood Avenue, Hester Streat/Arsr~holm
Boulevard end Waliwt Street, as shown fn Attachment B to thls RosMutlan whlch (s Incorporated horein; and
WHEREAS, the City subsequently ~pproved The Dls+~eyland Resort Speciflc Plan (SP93-S)
for the comprehenslve developmont ancl revltatlzatlon of the existing Dleneyland and ad~acent propenl~s,
whtch addresses development of a new themA park, known es WE3TC0'f them~ park, addltlonal hotels anJ
entertalnment areas, new parking fac(litfes and a transportatlon systom, and tho Hotel Circle SpecNlc Plan
(SP93•1) which provldes for the developmont a( 700 additi~nel Iwtel rooms (269 exlsting) on a B.8-acro slte;

WHEREr4S, on August 29, 1934, the City Plannfnp Comm(saion re~ommendc~l that the City
Councfl adopt the Analieim Rasort Speclllc Plan which ostablishes a comprehensive ~nnd use plan And
provides for the developmsni of up to 15,906 additlonal hotol rooms, conventlon, retn{I and other vlsltor-
serving u9es as well as setting forth the in(ra:.tructure improvoments which w(il be needed to support Puture

WHEHEAS, the City has praparecl the Anahefm Reaort Nonconforming Signage Program,
a copy of which Is attached ao Attachment A to this RRSOlutlon and incorpor~ted heroin; and
INHEREAS, the CRy has caused to be prepared and has indopendently reviewed an
onvlroRmental impact report (EIR No. 313) (or General Plan Amandment No. 33~, the Aneheirn Resort
Specific F'lan No. 92-2, the Anahelm Resort Idontity Program, the Anahelm Resort Public Realm LAndscapo
Program, and the Anaheim Resort Nonconforming 5lgnage Progrem, in accordance wfth requirements of
the Celitornle F•nvfranmental Oualfty Act, Public Resourcea Cade Sectlon 21000,~i ~, 7he clraft of EIR No,
313 was mede available for a 45-day public review pe~lod endinq July 29, 1994, and the Final ElFt No. 313,

i, PUHPOSE
The Anahelm Resort Specific Pla~i, The Disneyland Resort Specific Plan and the Hotel Circle Specitic Plan
requfre all nonconforming sl{ ~is to be romoved, altered or replac~d so as tu cunform ta the requtrements
of the appllcable Spectfic Plan within a speclfied abatemont period. At that time, thb Property, Business
or Slfl~ Owner wiil be requirod to rernova tho nonconforming sign, and if thoy desiro, replaco it with new
signago in conformance rvfth applicable zoning codes and the Anaheim Resort Identlty Program (whicti
identffies the design for the Anaheim Resort freestanding monument slgn). Full costs Aasocieted therewith
will be borne by the Property, F3usiness or Sign Owner. This Nonconforming Signage Propram has been
developed to provide a financial incontive to encourafle Business, F'roperty and S(gn Owners wfthln tho
Anahefm Resort to replace legal nonconformfng freestandinc~ pole signs with conforming sfgnage at an
earlier noint then lhe required abat~rtient period, specifically wfthin a th;ee-year period following edoption
of the Resolution author~zing this program.
il. AUTHORITY
This program shall apply to legal nonconforming freestanding pole sfgns within the Anahelm Resort, a3
definod within the Anaheim Resort Specitic Plan No. 92-2, The Disnoyland Rosort Spocific Plan No. 92-1
and the Hotel C~rcle Spacific Plan No. 93-1.
III. DEFINITI~N:,
A. The "Business Owner" is that person(s) who is registored witt~ the City's Business Licenoo Division
undor the busfness entity and a~dress identified on the sign.
B. The "Property Ownor" fs that person(c) to whorn the property is assessed on the last equalized County
tax assessment rotl available at tho date the noticQ ~pruvided for in paragr~ph D-1 of Section V) Is
sent.
r. Tho "Sign Ownor" Is that person(s) or businoss entity who owns the sign as fdentftiod by the Bulidinfl
Divisian of the City of Anahefm Planning De{,artment s(gn permit records or tho rocords of the property
owner or occupant. 7he Sfgn Owner may be the same as or difterent from thE~ property owner or tho
business own~r.
V. PROVISIONS
A. Term ot Program - This program shall remain in eHect for a pori~xi of three years following City
~ouncil's adoption of the Resolution authoriiing this program.
B. Eligible Sfgns • This proyram applfes to all legal nr~nconforming troestanding pole 3igns in the Anah~im
Raso-t Idontffied es paR of the ~ity's inventory of er.isting signs. Under no circumstancos wlll any
illegally er~cted treestanding pole sfgn3 be eligible for this proflram.

D. Prucedur~s
1, Within sixty (60) days fo(lowing adoption of the I~esolution authoriziny this Program, nc~~r~srWm
be s~nt to elig(blo Property, Business and Sign Owners inform(ng them of this incentivo p y
and oncouragin~ their partlcipation. Tho notice will request Praperty, Busmess and Sign Owners
to indicate tFieir interest in participAting in tho program within s(xty (60) da~s of rocoipt of the
notice. As responses are roturned, the respondents will be placed on a chronological prlority Ilst
In the order recofved.
2. For th~e properties ~dentifiecl in C-1, the tollowing shall apply:
a. As funding permits, tlie City will meet '~vith the Property, Business anci/or Sign Owners to
determine the following:
~) The location of the replacement signage and de~i~n of the sign faco (the PrAperty,
Business and/or Slgn Owner wlll desi~n the siqn tace In accordance v~ith the requirerrients
for ti~e property as cet (orth in tha applicable Specffic Plan;
2) A prelfminary evaluatfon of repairs, ff any, that may be needed to the property re~ulting
from the remavai of the nonconforming pole signage; and,
3) The date and time for the removal and replacement of the nonc~nforming pale signaga.
b. Prlor to the ~ommQncement of any work an the property, the Property Owner, Business Owner
ard Sign Owner shall enter fnto an agreement with tho City of Anahelm, au[horizing the City
or its agonts to enter tho property and comptete the above-described work. Said agreemont
shail be subj9ct to the approval of the Cfty Manager or his/her designee.
c. Rernoval, replacoment and repafr work will be periormeci by a Iicensed contractor on contract
with the City. The City will pay directly to the contractor all involcos associtatod with the actual
removal and replacement oF said slgns and repa~rs, ff any, that mTy be neaded to the property
resulting from tho removal of the nonconforminy polo si~nnge.

3. For tliQ prr,pe;ties identified in C-2, as fund(ng parmits, the City will provide $5,000.00 towards the
actuai cost of removal And replacoment of the nonc~nformfng pole signage.
a. Pric~r to commencement of removal af the nonconforming pole sign, the Property, Businass
and/or Slgn Ownor shall meet with the Clty to dotermfne the lacatlon of the replacoment
signaye, obtain a sign permit and provide the City with the ost(mated cost prepare~l by the
City authorizod contraot~r of removing and replacing tiie nonaonforming pole sign with
conforming slgnac7e.
b. Following receipt of the estimate, the Property, Business and/or Sfgn Owner shall enter into
an agroernent with tho City of Anaheim wherein the City will reserve $5,000.00 for a perlod of
up to sixty (6U) days, unless otherwise extended by the City. The agraoment shall further
spdcify that the City shall pay dlrectly to the slgn contractor wfio completes tlie ectual removal
and/or replacoment wcrk, $5,000.00 foliowing suk~mittal tu the City of a receipt verifylnfl the
actual cost of removal and replacemont of the nonconforminc~ pola signage in accordance with
the sic~n permit and final City inspoction. In no case shall the City pay a sign contrector mor•e
than the actual cost of removal and replacement af the noncontorminy polo signage.

'fhe EIR No. 313 Rasponse to Comments document, dated August 19, 1994, Includes s~ document entitled,
"Short-Term R(ght-of-Way Requ(rernents (Over 10 Years to 2005) Areawido Impravements." This document
shows the anticipatod right-of-way (referred to as the "short-term right-of-viay" for the purposes of this
program) which will be requfred to im^!ement the Katolla Avenue Smartstreet Program, the Clty Critical
Inters~ction Program and the I-5 Freeway widening. The anticipated short•term rfghit-of-way in many case~
does not encompass the uitimate right-of-way as shown on tha City of Anaheim General Plan Clrculation
Element. In some instances thc~ ~hort-term ric~ht-oF-way will be very close to existfng buiid(ngs, primarlly
alon~ Katella Avenue, and will require the re(ocation of existinq signage. If authorized by the applicable
Speciiic Plan ~nd subJect to the approval oi the Pianning Director, in order to provide ~an incentive to
Property, Business and Sipn Owners affected by ihese short-term right•of-way (mprovements to raplace

signage roquirements for properties in the Anahe(m Re~ort adJacent to i-larbor F3oulovard between
Orangewooa Aven~e and i-5 and Katella Avonue betweon Walnut Street and I-5 as specified herein which
are ~ffected by these infrastructure improvoments (the Katella Avonue Smartstreat Program, the City Cri4lcai
Intors~ction Program and the I-5 Freeway widening) as follows:
A. Until such time as Katella Avenue fs widened to it's uitimate rl~ht-of-way or a property abutting Katella
Avenue recJevelops at tha new setback Iino (11 (eat from the ultlmate r(ght-of-way), freestanding
monument signs rnay have a zero•foot setback from thQ short-term right•of-way if the Property,
Busines~ and Si9n Owne: is a participant (n the Nonconforming Sic~nago Program.
If the short-term infrastru~turo improvements alonc~ Katella Avenue or Harbor Boulevard are such ttiat
the setback between the right•oi-way and tho uctual buflding setback Is not wide enough to
accommodate the rnfnimum Anaheim Resort ireestanding monument sign (mfn(mum length of 14 feAt,
4-inches) or required sotback (zero setback adjacent to the ultimate r(ght-of-way) and if the Proporty,
Buciness ancJ Siyn Owner is a participant in the PJonconiormfng ~ignago Program, thon the signage
desifln may be mod(fteci subject to the apnroval of thQ Planning Director In accordance with tho
