A RESOLUTION OF THE ANAHEIM CI7Y PLANNING CUMMISSION
AMF.NUING CERTAIN CONDII'IONS OF APPROVAL OF RESQI_UTION NO. PC91-166
HDOPTED IN CUNNECTION WITH CONDITIONAL USE PERMIT NO. 3464
WHEREAS, on October21,1991 the Anaheim City Pianning Commission approved Condltfonal
Use Permit No. 3464 under Resolut(on No. PC91-16f permitting a church in An oxisting Industrlal building
with waivor of minfmum number of parking spaces on property located on the south side of La PaImA
Avenue approximately 3,560 feet east of the centerline of Lakovlow Avenue and further described as 5100
East l.a Palma Avonue, Suites 111 and /12, snd
WHEREAS, saic! Resolutlon No. PC91-1Gfi (ncludes the following condition of approva~:
"17. That this conditfonal uso parmit is granted for e period of three (3) years and shall
terminate on Qctober 2I, 19J4."
WHEREAS, the petitioner has requostc3d retroactive approval of a 3-year extension oF time to
retain a churcti in tho ML (SC) "Limited, Industrial - Scenic Curr(dor Overlay" Zone.
WHEREAS, th~ City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on DecembAr t?., 1994, at 1:30 p.m., notice oi sald public hearfng having bean duly
gfven as required t~y law and in accordance with thQ provisions oF the Anaheim Municipal Code, Chapter
18.03, to hear and consldor ovidence for ~nd against said proposed amendment ancl to Investigate and
make findings and recommendation3 (n connectlon therewith; and
WHEREAS, sald Commission, aker due fnsp9ation, fnvest(gation and study macle by itsolf
and In its behalf, end aFter due considerat(on ot all evidence and reports oHored at said hearing, does find
and determfne the foliowing (acts:
1. That subJact conditional use permit t~ being exercised In a manner not dotrimental to the
particular area and surrounding land uses, nor to tho public peace, health, safety and general wel(are;
2. That, in accordance wlth Zoninfl Code Section 18.61.050.614(b), churches are conditfonally
permittod in the Canyon Industrial Area tor a maxfmum d-arntion of 9 consecutive yoars from
commencement and
3. That no one indicated their presence at said public heariny in opposition; ~,nd that no
correspondonce was received in oppos(tion to the subject petition.
CAI.fFORNI~ ENVIRONM NT ~ALITY ACT FINDI~: That the Anaheim Cfty Planninq
Commission has reviewed the proposal and does horeby iind that tlie NogatNe Declaratioi previously
approved in connection with Conditfonal Use Pormit hu. 3464 is adequate to aerve as the requfred
environmental documentatlon tn connection with this request upon iinding tiiat tlie doclaration ro0ects the
indepondent judgemgnt of the lead agency and that ft has consider&d tha Negative Declaration together
wlth any commQnts rer,elved during the public review process and furthor finding on the basis oi the inltial
study and any comments received that thore is no substantial ev(dence that the pro~ect wfll have a
signKlcant effect on the Qnvironment.
NOW, THEREFORE, BE IT RESOLVED that tho Anahoim City Planning Commisslon does
heroby amend CondRion No. 17 of Raso~ution No. PC91-166 t~ read es toliows:
17. That this conditional use pormR is granted for a period of three (3) years and shall terminate
on October 21, 1997.
