A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING CERTAIN CONDITIOfVS OF APPROVAL OF
CONDITIONAL USE PERMIT NO. 3606
WHEREAS, on June 14, 1993 the Anahoim City Planning Comm(ssion approved Conditlonal
Use Permit Na. 3G06 undor Resolution No. PC93-70 pormlttinr~ tho on-premise sa(e and consumption of beer
and wine wi!hin a proposed restaurant in conJunctfon wlth an indoor swap meet facility on praporty located
north and east of the northeast corner of Corritos Avenue and Anaheitn Boulevard and fittrther ldentlfied 2.s

WFiEREAS, sald Resolutfon No. PC93-70 Includes the fallowing conditian oi approval:
"11. That this Conditionai Use Permft shall expire one year froRi the date of this
resolutlan, on Jun~ 14, 1994."
WHEREAS, the petitfoner has requested to amend or cielete ^~afd condition of approval
portaining to the time Iimfta[lon.
WHEFIEAB, the City Plannfng Commissl~n did I~ald a publl~ hearing at the Civic Canter in
the City of Anaheim on Mey 16, 1994, at 1:30 p.m„ notice of said public hearing having been duly given
as required by law and in accardance with the provl~lons of the Anahefm Municlpal Ca:d, Chapter 1a.03,
to hear and consider evidence far and ag~inst safd proposed amendment and to investigate and make
findings and recommendations in connection therewith; and
WHEREAS, said Commission, aftor due i~spection, investigation and study mado by itself
and in Its behalf, and after due consfderation of ~It evidenco And reports affered at said hearing, doos find
and determino the following facts:
1. That the one year time Iimitation was established to glvo the Ciry the opportunity to
deterrn(ne whether subj~ct use Is cnmpatible w(th surroundfng land uses but, since the use has not yet
cominenced, a tfmc~ extonsion will p;ovfde the onportunity as ortgfnally intendecl by the ~'I~nning
Commission,
2. That modificatfon uf the tirne Iimitation is necessary to pc~rmit reasonabte operetion ur,c~er
subject conditfonal use permft as granted.
3. That no one indicated their presenco ~t sa(d publfc hearing in opposit(on; and that .io
correspondence was recefvod in oppositfon to the subjoct petftlon.
ALIF RNIA ENVIRONM~NTAL OIIALiTY ACT FINDING: That the Anahaim City Plannfng
Commission has reviewed the proposal to amend Condition No. 11 of '~esolution No. PC93•70 portaining
to tho time limitation of a restaur~~~t with on-premiso sale ~nd consumption oE alcoholfc beverages ~n
conjunctfon w(th an Indour s~~ap mest facllity and daes hereby flnd that the NegatNe Declaration
previousiy approved fn connection with Conditfonal Use Permit No. 3606 Is adequate to serve as the
roquired environmental documentation in connection wfth this request upon finding that the declaratlon
reflocts the indopendent ;udgement nf the lead agency and that ft has consldered the Negative Declaration
together with any comments recefved durfng the public review process and further finding on the basis
of the fnftlal study and any comments recelved that there is no subst~ntfal ovidonce that the proJact will
have a signHicant effect on the environmont.
