WHEREAS, tha City Plannin~ Gummission did hold a public hoaring at the C(vic Conter in
the City of Anaheim on Ma,y 16, 1994 at 1:30 p.m., notice of safd public hearing having been duly gfven as
requfred by law and in accordance wfth the provisions of the Anaheim Munlcipal Code, Chapter 18.03, to
hear and consider ovidence for and against said proposed reclassification and to Invostfgate and make
ffndings and recommendations in con~~ection therewith; and
WHEREAS, said Commission, after dua inspactfon, investigation and study made by itseif
and in its bohalf, and after due cor•~ideration af all evidenc9 and reports offered at sa(d hearing, doos find
and determine 4he foliowing facts:
1. That the petitionor prc;,:~ses reclassitication of ;ubject property from !he ML (Limited,
Industrial) Zone to the RM-1200 (Resfdoritial, Multfple•Famil~) or a lass intense zono to retaln an existin~l
duplex.
2. That the Anahefm Generai Pian designates suhject properiy for ~Nedlum Density Residential
land uses.
3. That tho proposed reclassiiication of subJect property (s necessary and/or desirabl~ for the
orderly and proper development uf the community.
4. That the proposed reclassificat(on of subJect pro~erty does properly ralato to tho zones and
thair permitted uses locally establishod in close prox(mity~ t~ subJect property and ta the zonos ~nd their
permitted uses generally established throughout the community.

Commission has reviowed the proposal to reclassHy subJect proporty from tho ML (Umited, Industrial) tur.a
to the RM-1200 (Residentia!, Multiple-Fam~ly) or a less intense zone to retain an exist(ng duplex on a
rectangularlysh~ped parcel of land consisting of approximately 0.'11 acre, having a frontage of
approximately 85 feet on the north side af Clm Street, h~vfng a maximum depth of approximatoly 59 feet,
being locatod approximately 120 feet east of the centerl(ne of Lomon Streot and further d~scribed as 131-135
West Elrr~ 5treet; and does horeby approve the Negative Daclaration upon finding that the dec,aration
reflects the independent Judgement of tl~~, load agancy and that It has considered the Negative Qeclaration
together with any cornments recoived during the public reviow prooess and iurther findin~ on the basis of
tho initial study and any comments received that there is no substantial evidenco that the project will hAVe
a significant effoot on tho onvfronment.
NOW, THEREFORE, BE IT RESOLVED that the Anaholm City Pianning Commission does
hereby approve the subject Petition for Reclassificatian to ~uthorize an amendment to the Zaning Map of
tho Anahelm Municipal Code to exclude the above-described property from the ML (Limited, Industrial; Zona
and to incorporate sald describecl property Into the RM-1200 (Resident(al, Multiple-Family) Zorie,
unconditlonally.
BE IT FURTHER RESOWED, that approval of thfs application constitutes approval of the
proposed request anly t~ tho extent that it cumplies with tho Anahelm Municipal Zoning Codo and any other
appllcable City, State and Federal regulatlons. Approval does not Include any actlon or findings as to
complfance or approval of the request regarding any other applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED, that this resolutian shall not constitute a rozoning of, ar a
commitment by the Ci4y to rezono, the subject property; any such rezaning sha11 requlre an ordinance of
the City Council whfch shalt be a legislative act which may be approvod or denled by the Cfty Councll at
fts sole discretion.
