RESOLUTION NO. PC36-10
A RESOLUTION OF THE ANAHE~M CIN PLANNING COMMISSIUN
AMENDING CERTAIN CONDITIONS OF APPROVAI OF
RESOLUTION N0. PC95-19 ADOPTED IfV CONNECTION WITH
CONDITIONAL USE PERMIT NO. 2992
WHEREAS, the subJe~t property is currenUy developed wfth a tree service contractor's yard
in the ML "Limited Industrial" zone on propeity located at 507 South Lemon Street (Leonard Chaidez Tree
Service).
WHEREAS, on March 28, 1988 the Planning Commission adopted Resolution No. PC88-85
approving, in part, Condftio~al Use Permft No. 2992 (to permit a contractor's storage yard with waNers of
minimum landscape setback and required screeni~g adjacent to a resident(al zone [waNer of req~ired
enclosuro of outdoor uses was denled]); and that no further action was taken by the City Councii;
WHEREAS, on February 22,1995) the Planning Commission adopted Resolution No. PC95-79
(approving revised plans and amending, in their entirery, all the condftions contained in Resolution No.
pCgB-85;; that no further action was taken by the City Council; and that said resolution contained the
following condftions of Gpproval which have not been fully complied with:
3. That the owner of subject property shail submit a letter requesting termination of Condltional
Use Pem'iit No.1367 (to establish an outdoor recreational vehicie storage area) to the Zoning
Division.
5. That at least one (1), minimum fifteen (15) gallon-sized, tree shail be planted for every twenty
(20) Ilnear feet of street frontago along Santa Ana Street and Lemon Street, wfth appropriate
irrigation facilfties being installed and maintained. The existing landscaping, if retalrsed, shall
be refurbished.
6. That clinging vines or iast-growing shrubbery shall be planted adjacent to the proposed
masonry block walis facing Lemon Street and Santa Ana Street in compliance with Code
SectiAn 18.04.060.040 to prevent graffiti opportunfties. Said plants shal! be maintained wfth
an automatic watering system.
8. That the subject properry shall be developed substantially in accordance with plans and
speciFlcations submitted to the Ciry of Anaheim by the petit(oner and which plans are on file
with th~ Plann~ng Department marked Revision No.1,;of Exhibit No.1, including construction
of a sbc (6) foot h~gh block wall alonc~ Lemon Street and Santa Ana Street.
11. That a solid gate shall be instal(ed in the driveway(s) along Lemon Street and Santa Ana
Stree:. Said gates shall remain open in the moming from 7 a.m. to 8 a.m. and in the
aftemoon from 4 p.m. to 5 p.m. and siiall be dosed between 8 a.m. to 4 p.m. A lwo-way
rad(o communfcation system shall be used for openi~~g gate between S a.m. and 4 p.m'.
WHEREAS, on Octobsr 30,1995 the Planning Commission set th(s matter for pu~lic hearing
to consider revoking or modHying Conditional Use Permit No• 2992 due to the condftianal use being
permft Noi 299r2 and which may be detrim ntal a the publ~icihealthtpeace,rsafetyforiaelfarai~or which
constftutes a publfc nuisance; and .

WHEREAS, L_a City Planning Commission did hold a pubfic hearing at the CNic Center in
the City of Anaheim on January 22, 1996~ at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the previsions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed amendment and to investigate and
make findings and recommendations in connection therewfth; and
WHEREAS, said Commis~ion, after due inspection, irnestigation and study made by ttself
and in fts behalf, and after due consideratlon of all evidence and reports offered at said hearing, does Hnd
and determine the following facts:
1. That staff had determined partial compliance as noted for certain condRions as foilows:
Condit(on No. 5: An irrigation system has been installed;
Conclition No. 8: A 6-foat high biock wall has been co~structed; and
Conaftion No. 9: Solid gates have been installed.
2. That no one indicated their presenca at said public hearing in opposition; and thai no
correspondence was receNed in opposition to the subJect petition.
CALIFOqNIA ENVIRONMENTAL QUALITY Af:T FINDIN : The Pianning Director or his authorized
representath~e has determ(ned that the proposed proJect falls wfthin the definftion of Categorical
Exemptions, Class 21, as deflned fn the State EIR Guideiines and is, therefore, categorically exempt ftom
the requirement to prepare an EIR.
NOW THEREFORE BE IT RESOLVED that the Planning Commission does hereby amend
Resolution Na. PC88-85, as amended by Resolution No. PC95-19 and adopted in connection with
Conditional Use Permft No. 2992, by adding the foilowing two conditions of approval:
