A RESOLUTION OF THE ANAHEIM CITY PIANNING COMMISSION
AMENDING CERTAIN CONDITIONS OF APPROVAL OF
RESOLUTION NO. PC95-158 ADOPTED IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 3807
WHEREAS, on November 27, 1995 ths Planning Commission approved, in part, Condftional
Use Permit No. 3807 pem'dtting an outdoor roller-hockey facilih/ includ(ng a 750 sq.ft. fteestanding fceeway
oriented s(gn, a 1,800 sq.ft. accessory building for uses including a snack stancl, ptayer locker and meeting
rooms. restrooms, merchandise repair shop and an office with wafver of freestanding freeway o~lented ~igns
(and denying waiver of r~ermitted encroa~hments into required yard areas);
WHEREAS, Resolu[fon No. PC95-158, adopted (n connection wfth Conditfonal Use Permit No.
3807, contains the following stipulations and conditions which the applicant requests be amended:
~ip~lation No. 4. That the proposed freeway-oriented freestanding sfgn will be redesigned and
resubmitted to the Planning Ccmmission for review and approval, wftti the redesign tncluding the
following components: location at th~ north edge of the 30-foot landscaped setback near the oenter
of the property; single-faced; heigM not exceeding 12 teet or the heigM of the chainl(nk fence
enclostng the roller rink area (estimated to bp 10 to 12-feet), whichever is le^~s; and design in
compliance wfth Section 18.110.080.140 "Freestanding Freeway Orierrted Signs.
~ondRion No. 4. That a Mal sign plan shall be submitted to the Zoning Division for review and
approval by the Planning Comr+mission as a'Reports and Recommendations' ftem. Such flnai sign
plans shall:
(a) Incorporate the design characteristics spec~ied in paragraph 23d of the November 27,1995
Staff ReFort to the Planning Commission regarding subJect Condftional Use Permft No. 3807;
(b) Consist o~ a single-faced sign facing either east or south and visible to westbound traffic on
the Riverside/SR 91 Freeway;
(cj Locate tha sign at the north edge oi the 30-foot ~ride Iandscaped s9tback near the center of
the property;
(d) Show that the'?(gn does not exceed twelve (12) feet in helght oe the hefght of t~:e chalolink
fence enciosin~,j the roller ~ink area (estimated to be ten [10] to tweive [12] feat high),
whichevsr is,!v3s; and
(e) Shov: that the sign is in compUance with Snction 18.110.080.140 "Freestand(ng Freeway
Uriented Signs.
Condftiora No. 6. That a uniformed security guard shall be present from 6:00 p.m. uMll c!asing.
Condition No. 9. That access into Fry's Electronics Qocated on adJacent properry to the east) shall
be gated and said gates shall be ctosed w~thin one (1) hour of Fry's dos(ng time.

WHEREAS, Gary Elder, representing Plewport Federal, has submitted a letter,
dated January 29, 1996, proposing amendment to the conditions of approval pertaining to a freestanding
freeway oriented sign and securiry guard requiremerrts and proposfng that the follawing condition replace
Condition Nos. 6 and J:
"That ff there is no access to Fry's, a security guard will not be necessary before ten (10) p.m. If there
is access into Fry's, the access shall be gated and the gates will be dosed withtn or.e (1) hour of Fry's
closing, and a security guard shall be provided from six (6) p.m.'
WHEREAS, the Ciry Planning Commission did hold a public hearing at the Civic Center in
the Ciry of Anaheim on February 5, 1996, at 1:3d p.m., notice of said public hearing havfng been duly
gNen as required by law and in accordance wfti~ the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed amendment a~d ta investigate and
make findings and recommendations in conrectlon therewfth; and
WHEREAS, sa(d Commission, after due inspection, fnvestigation and study made by itself
and in its behalf, and after due consideration of all evfdence and reports offered at said hearing, does flnd
and determine the foilowing facts:
1. That the following chart compares the applicanYs request wRh the above-menttoned

~AUFORNIA ENVIRONMENTAL 4UALITY AGT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal and does hereby find that the Negative Declaration praviously
approvod in connection with Condkional Use Permft No. 3807 Ps adoquate to serve as the required
environmental documentation in connection with this request upon finding that the declaration reflects the
independent Judgemeni of the lead agency ai~d that it has cunst~ered the S,reviously appruved Negative
Declaration together with any comments received during the public review process and further flnding on
the basis of the initial study and any comments received that there is no substantial evidence that the
project will have a sign~cant effect on the environment.

NOW THEREFORE BE IT RESOLVED that the Mahefm Planning Commfssion does hereby amend
Resolution No. PC95-158, adopted in connection with Condftionai Use Permft No. 3807, as follows:
(1) That Condition No. 4 be amended to read:
'That a flnal sign plan shail be submitted to the Zon(ng DNision for review and approval. Such flnal
sign pian shall:
(a) Consist of a double-faced f~eestanding sfgn, located perpendfcular and visible to the westboun~
and eastbound traffic on the Riverside/SR 91 Freeway;
(b) Locate the sign at the center of the 30-foot wide Iandscaped setback area adjacer~t to the south
propercy Iine;
(c) Show that the sign does n~t exceed twenty'five (25) feet in height as measured from the finished
grade of the freeway; and
(d) 8how that the sign is in compliance wfth Section 18.110.080.140 (Freestanding Freeway Oriented
Signs).'
(2) That Condition No. 6 be amended to read:
"That the owner of the roller-hockey faclliry shall be required to provide a security guard~ at the
discretion of the Anaheim Police Department, to discoun,ge loftering and vandalism on the subject

(3) That Condition No. 9 be deleted in its entirery.
