A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING CERTAIN CONDITIONS OF APPROVAL OF
RESOLUTION NO. PC93-88 AnOPTED IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 3616
WHEREAS, on July 26, 1993 the Planning Commiss(on adopted Rasolution N~. PC93-88 ~n
connoction wfth Conc~itfonal Use Permit No. 3616 to permft ths retail sales of -r-arine v~hicles, trailers, parts
and accessories (n conjunction wfth a marine product manufacturing facility at 1130 North Kraemer
Boulevard; and that no further action was taken by the City Councii;
WHEREAS, Specfflc Plan No. 94-1, the'Northeast Area Spec~ic Plan; was adopted on September
12,1995 by the Ciy Coun~il reclassifying the Canyon Industriai Area and thereby supersedin9 the existin9
ML'Limiteci InrlusMai" and ML(SC) "Limfted Industriat-Scenic Corridor Overlay' zoning; and that subJect
property is ~ocated in Development Area 3"La Palma Core" of said spec~ic plan;

WHEiiEAS, the petitioner rea,uests amendment of Conditional Use Permft No. 3616, in connection
wRh a public hearing, under authority of Code Section 18.110.080.050.0531 to retatn the accessory servlce
and outdoor display of marine vehicles ~nd to modify an existing 6,265-square foot meuanEne in conjurction
with the previously approveci marine vehicle manufacturing and retail sales facil'ity, and with waiver of the
foilowing:

WHEREAS, the petitioner also requests approval of revised plans to (i) retain a 1,500 sq.ft. service
area for the repair of marine vehicles (as shown on Revision No.1 of Exhibit No. 1) because the southwest
portion of the building has been converted from manufacturing to service department use, (ii) convert
approximately 2,100 sq.ft. of the existing 6,265 sq.ft. mezzanine area to addftional office use (as shawn on
Revislon No.1 of Exhibft No. 3), and (ifi) retain an outdoor drop-off area for marine vehicles (to be serviced)
in the parking area adjacent to Kraemer Boulevard;
WHEREAS, the Ciry Planning Commission did hold a public hearing at the Civic Certer In the City
~f Anaheim on April 1, 1996, at 1:30 p.m., notice of said pubiic hearing having been duly given as required
by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and
consider evidence for and against said proposed amendment and to investigate and make flndings and
recommenrlations in connection therewith; and
WHERE/zS; said Commission, aftes due inspection, imestigation and study made by ftself and ~n
its behalf, and afcer due consideration of all evklence and reports offered at said hearing, does find and
determine the fdlowing facts:

~, That the proposed use, as amended, is propedy one for whtch a condRionai use permit Is
authorized by the Zoning Code:
2. That the proposed use, as amended, will not adversely affect the adjoining land uses and the
growth and development of tha area in which it is propased to be because said use will ba accessory to
the primary manufacturing use of the subject properry; that the retail sales activities will be incidental to the
manuFactu~ing of marine vehicle accessories and the saie of marine vehides will be Umited to 'Jet ski' type
vehicles only and will n~t tnclude boats; and that there will be no outdoor display of marine vehides and f or
accessories at any time unless the Zoning Code is specffically amendec to permk such outdoor dtsplay;
3. That the size and shape of the sfte for ihe proposed use, as amended, Is adequate 4o a!low
the full development of the saki use in a manner not deMmentai to the particular area nor to the peace,
heaith, safery, and general weifare;
4. That the traffic generated by the use, as amended, will not Impose an undue burden upui ~ the
streets and hiyhways designed and Improve~J to carry the traffiG in the area because only Iimfted floor areas
are being mod~ied and the specialized nature of the marine products which will be serviced; and that the
combined existing and proposed accessory uses (office, retai~m~ Ni~ ~ use ~Se only 32% of the total
floo~ area with the remaining 6896 being manufacturing (a pe P~ rY )~
5. That amending the conditional use permit, under the condftions imposed, will not be
detrimental to the peace, health, safety and generai welfare of the citize~s of the City of Anaheim.
g, That there is a speciai circumstances applicable to the property, consisting of its shape, whioh
does not apply to other identically zonod p~operties in tha vfc(nity; and that using the four parking spaces
for drop-off of marine vehicles to be service~i :s temporary because the petitioner is seeking a new facility
for the service department and related uses;`
7. That strict application of the Zoning Code deprNes the property of privileges enjoyed by other
properties under identical zoning class~ication in the viciniry;
g. That the existing parking (127 spaces) exceeds the required parlcing (100 spaces) for the
proposed combinatlcn of uses:

~`AUFORNIA ENVIRONMcNTAL QUALITY ACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposa~ and does hereby flnd that the NegatNe Dedaration previously
i' approved in connection with Condftional Use Permit No. 3616 Is adeauate to serve as the required
ernironmental documentaUon in connectfon whh this request upon Nnding that the declaration reflects the
independent judgement of the lead agency and that it has considered the previously approved NegatNe
~ Declaration together with any comments received during the public review process and further firxJing on
the basis of the inftial study and any comments received that there is no substantial evidence that the project
will have a stgniflcant effect on the ernironment.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plann(ng Commissfon doas
hereby amend Resolution No. PC93-88 to permit the accessory service of ma~ine vehides, an outdoor
senrice drop-off area for marine vehides !n the par{cing area adjacent to Kraemer Boulevard, modfficailon
of the exfsting 6,265 sq.ft. mezzanine, and waivQr of the fdlc~wing in conjunctfon with the prevtously

BE IT FURTHER RESOLVED, that the conditlons of approval oF Resolution No. PC93-88 be
amended in their er~irery to read as follows:
1. That the owner of subject property shall submit a letter requesting termination of Condftional Use
PeRnit No. 186 (to estabiish a planned unit shopping center arxl restaurarrt wfth cocktail lounge) to
the Zoning Divisfon.
2. ThaY the subject request for servicing marine vehicles and using four (4) existing parking spaces for
'temporary service drop-ofP shalt be permitted for a period of two (2) years to expire on April 1,1998.
3. (a) That the four (4) service drop-off spaces shatl be so-labeled on plans submitted to the Zoning
Division;
(b) That the four (4) service drop-off spaces shall be striped to identify the use of the spaces for
serv(ce drop-off and `temporary hold';
(c) 7hat use of the four (4) service drop-off spaces shali be i(mited to the hours of operation of
the service department; 9 a.m. to 6 p.m., Monday through Saturday; and
(d) That no canopy or overhead covering of any kind shall be permitted to cover the four (4)
service dro~roff spaces.
4. That the existing landscape hedge separating Kraemer Baulevard and the service drop-off spaces shall
be mafntained at a hetght which screens the viow of the marine vehicles parked in said spaces ftom
Kraemer Boulevard.
5. That the existing landscap~ planter adJacent to the service drop-off spaces adjacer~t to the north side
of the driveway entrance from Kraemer Bculevard shall be plaMed with a tree, shrubs and
ground~over in conformance wfth 18.04.060 "Landscaping RequiremeMs - General.'
6. That subject property shafl be developed substantially in accordance with plans and specffications
submitted to ths City of Maheim by the petitioner and which plans are on file wRh the Planning
Department marked Revision No. i of Exhibft Nos.1, 2 and 3, fndudfng the requirements of Condftton
Nos. 3 an d 5, herein.
7. That prior to commencement of the actlviry authorized by thfs resolutfon, or prior to issuance of a
building permit, or within a period of one (1j year from the date of this resolutfon, whichever occurs
flrst, Corxiftion Nos. 1 and 3, above-mentioned, shall be complied with. Extensfons for further tima
to compiete sakJ conditfons may be c~ranted in accordance with Section 18.03.090 of the Maheim
Municipal Code. ~ ~
8. That p~lor to ftnal building and zoning inspectfons, Condftion Nos. 4, 5 and 6, above-mentionecl, shall
be complied with.
