RESOLUTION NO. PC96-43
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING CERTAIN CONrITIONS OF APPROVAL OF
RESOLUTION N0. PC90-88 P:~OPTED IN CONNE(.'TION W]TH
CONDITIONAL iJSE PERMIT N0. 3265
WHEREAS, on April 9, 1990 the ~'lanning Commission approved Conditio~u Use Permft No. 3265
to permit a church in an existing industral building with waiver of minEmum number rn` parking spaces (246
required, 81 existing) for a period of t~~ree years until April 9, 1993; and that no further ac:lon was taken by
the Gity Council;
WHEREAS , Resolution No. PC93-68, adopted in conjunction with suoject use pem~it conta~ns the
fdlowing condftion:
•~p. That subJect church facility shall be limited to three (3) year's duration; and, fu~ther, that
such church use (other than church office staff use} shall not be perr~itted on ~t{~-nday
thr4ugh Friday prior to 6:00 p.m., as specif(ed by Section 18.61.050.614 (churches in the
Canyon Industrial Area) of the Anaheim Municipal Code. Two (2) time e~densions (up to
three (3) years each) may be permitted subject to the approvai of the Planning Commission
or Ciry Council at a noticed public hearing."
WHEREAS, on J~ne 14, 1993 the Planning Commission adopt2d Resolution No. PC93-68
approving a time extension to expire on April 9, 1996; and
WHEREAS, on September 12, 1995 the City Councii adopted Spec~ic Plan No. 94-1 'Northeast
Area Speciflc Plan" (SP 94-1) for the Canyon Industrial Area inciuding subject property which is located in
peveiopment Area 1(Industrial Area); and that SP 94-1 contains the following provisions in Subsection
18.110.050.050.0511 pertaining to churches in Development Area 1:
'{b) Churches whlch occupy less that three (3) acres or are not the exclusive use of the proper.ry
(regardless of acreage), are Iimited to a maximum initial three (3) years duration with extensions which
shall not exceed nine (9) consecutive years from the ~ri~ir,a! a~Nroval.
(c) Churches established pursuant to subparagraph (b) shall, with the exception of natlonal
hol(days, Umit activities tc church office staff, prior to 6:00 o'clock on Monday through Friday.
(d) Churches may inc~ude educational facilities as an accessory use, provided such facilitles are
appmved in the conditional use permit °
WHEREAS, the Ciry Planr~ing Commiss:on did hold a publlc hearing at the Civic Center in the
City of Anaheim on April 29, 1996, at 1:30 R.m., notice of said public hearing having been duly given as
required by law and in accorcfance with the provisions of the Anaheim Munfcipal Code, Ghapter 18.03, to
hear and consider ev(dence tor and agafnst said proposed amendment and to investigate and make
flndings snd recommendations in connection therewi:h; and
JJHEREAS, said Commission, after d~e inspection, investigation and study made by itself and
in its behalf, and after duQ consideratfon o( all evidence and reports offered at said hearing, does flnd and
determfne the foliowing facts:

1. That subject u~ ermft is being exercised in a manner not detrimental to the particular area
arxl surrounding land uses, nor to the public peace, health, safery and generai welfare because the church
use has demonstrated compatibility with 4he surrounding area and land uses in that there have been no
reported Code violations or compiaints associated with its operation.
2. That one previous three year extension of time has been granted and, if 3pproved, subJect
request will complete the consecutive nine years trom the original approval date (Ap~il 9, 1990) permiried
by Code.
3. That no one indicated their presence at safd public hearing in apposftlon; and that no
coRespondAnce was received In opposition to th2 s~bject petitfon.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim Ctty Planning
Commission has reviewed the proposal and does hereby find that the ~legative Declaration previously
approved in connection with Conditionai Use Permit No. 3265 is adF,quate to serve as the required
ernironmental documentation in connection with this request upon finding that the declaration reflects the
independent Judgement of the lead agency and that it has considerad the previously apprrned Neeative
Dddaration toyether with any comments received during the publ!c review process and further finding on
the basis of the initial study and any comments received that there Is no substantial evidence that the
project will have a significant effect oii the environment.
NOV1P THEREFORE BE IT RESOLVED that the Anaheim City Planning Commission does hereby
amend Cnnditlon Vo. 10 oi Resolution No. PC90-88, adopted in connection wfth CondR~onal Usc+ Permft
No. 3265, to read as follows:
'10. That subJect church facility sfiall expire on Aprii 9, 1999; and, further, that such church ~se
(other than church oHice staff use) shall not be permitted on Monday through Friday prior
to 6:00 p.m., as specitied by Subsection 18.t10.050.050.0511 of the Maheim Municipal
Code (pertaining to churcl~es in tlis Northeast Area Specffic Plan).'
THE FOREGOING RESOLUTION was adopted at tlie Planning Commission meettng of
April29, iS96. -
