WHEREAS, pursuant to Section 65865 of the Statute, the Ciy heretofore anacted Resduc~°n
No. 82R-565 (hereina.'?er 'Procedures Resol~Kion') establishing proceciures and requlremencs for the
considerxtion of developme~:x agreements upon receipt af an applir.dtion; and

WHEREAS, on August 1y, 1396 the Planning Comrt~ission dki hold a publ~ hearing upon
The Developme~at Agreement, notice of which hearing was given In a manner requlred by law; ar:~1
WHEREAS, the PlanNng Commission has dotermined, by its Aesdut(on No. PC96-79 ftnding
and rocommending that ihe Clty Councp determine that pursuant to the provislons of the Ca~ifomia
Ernironmental ~uality Act ('CEAA'}; that the Addendum ('Addendum'~ to Flnal ErnlronmeMal Impad
Report No. 311 for The Disneyland Resort Project (the 'Final EIR~ and Modifled MftlgaUon Monftoring
Program No. 0067 were prepared in compliance with the requirr,m~~:r, ~ CEQA and the State and City of
Anaheim CE~A Guidolines; that as demonstrated by the analyst5 aidude.. In the Flnal E~R and Addendum
for all ernironmeMal tssues, the propASed project a~tions, induding Development Agreemerrt 96-0 ~, will not
resutt in rsew signffi: aM Impacts or substantial ic~creases in the severity of signfficant impacts and no
supplemental o+' subsequent ernironmental review is required; and that the Flnal EIR along vvith the
Addendum and FAod~ied AAftfgatlon Monfto~ing Program No. 0067 are adequate to serve as the requlred
ernironmenta! documentat(on for this request; snti
WNEREAS, the applicant has demonstrated that ft meets the eligibpfty requirements of
Section 1.3 of the Procedures Resolution to enter into the DevelopmeM AgreemoM by showing the fdlowing:
That the proJect occupies at least fffty acres. The property owned or corrtrdled by the
appllcaM encompasses approximately 450 acres;
That, upon completlon, the proJect will result in the construct(on of at least 250,000 square
feet of commercial/aHlce space. The proJect will ~esult in the construction of a total of
5,225,000 new square feet of theme park. RetaU Entertainment Center, and ad~ninistrative
cffico spaco and 4,600 new hot~t rooms; arid,
That the proJect will be consiructed in phases over an antlcipated period of ~ot ~ess tt~-~
5 years. The Disneyland Resort praJect will be implemented in three phases cver a 15-yoar
perio~. The flrst phase has been completed. Phase U wpl be completed in 2001 and Phase
Ill is proJectecf to be completed by 2010.
NOW, THEREFORE, the Planning C~mmtssion of the City o( Anahelm hereby resoNes that
after due'.nspectlon, irnesttgation and study m9de by ftseM and in tts t~ehalf, and atter due consideratlon of
and ' tse3 upon al{ evidence and ~eports offered at said hearing, doos flnd upon review of the larxl use
aspects af the Development Agreement that:
1, The Development Agreement is within the scope ut the Flnal EIR anci the Addendum, end
was co~emplated therein as pa-t of The Dfsnoy~and Resort ProJect.
2. The Development Agreement is consistent whh the Genera! Plan of the City of Anaheim and
The Disneyland Resort SpecHic Plan No. 92-1.
3. Tha Deve~opment Agreement Is compatible with the uses atdho~izod In and the regulations
prescrlbed for The Disneyland Resort Spectfic Plan No. 92-1.
4. Th9 Development Agrt~ement is compatible wfth the orderly development of properry in the
Disneyland Resort area surrounding The Disney~and Resurt SpecNlc Plan Mo. 92-1.
5 The Deve~npment Agrec3ment ts not otherwise detrimental to tha health, safety ar-d general
welfare ot the cftiz~+ns of Anaheim.
g. The Deve~opment Agreement wql have an overall poskive eHect on the health, satery arx!
welfare of the residents of and visftors to the Ciry.

7. The Development Agreement constft!ites a lawful, present exerci ~e of the City's pollce
power anc! authoriry under the Statute, the Enabling Ordinance and the Procedures
Resolutton.
8. The Development Agreement is entered into pursuarrt to and in complianca w~th its charter
pewers and the requirements of Section 65867 of the Statute, tha Enabling Ordinancn and
the Procedures Resotutlon.
Based upon the foregoing flnd(ngs anc! determ?nations, the Planning Commfssion recommends ta the Ciry
Council the approval of Development Agreement No. 96-01, subJect to the following changes:

requirements of Specffic Plan 92-t or the Applicabie Rules.' has been added to tfie text at the
bottom of the page.

now show any illustration of the Cerritos Avenue alignment d~e to cropping.
. Exhibi~ L, Impact Fees - The list of mitigation measures is under review and subJect to change prior
to the Ciry Council consideration.
. Section 3.1.6 - Add language to this section to state that the funds will be used in the immedlate
proximity to the Anaheim Resort area.
