ORDINANCE NO. 5970
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
CHAPTER 18.04 OF TITLE 18 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO THE ZONING
REGULATIONS TO BE APPLICABLE TO CERTAIN
PROPERTY UPON ANNEXATION TO THE CITY OF
ANAHEIM
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS AS
SECTION 1
That new Section 18.04.170 be, and the same is hereby, added to Chapter 18.04 of
Title 18 of the Anaheim Municipal Code, to read as follows:
"18.04.170 ZONING REGULATIONS APPLICABLE TO CERTAIN PROPERTY
FOLLOWING ANNEXATION TO THE CITY OF ANAHEIM.
Notwithstanding any provision of this Code to the contrary, those certain
properties located in the unincorporated territory of the County of Orange as of the date of
adoption of this section (which properties are more particularly described as Area 11 in Zoning
Reclassification No. 2005-00154 as set forth in City Council Resolution No. 2005-74) shall be
permitted to be developed, used, and maintained in accordance with all provisions of the zoning
regulations of the County of Orange which regulations were applicable to said property
immediately prior to completion of the proceedings for annexation of said property to the City of
Anaheim (the "County Regulations"). Said County Regulations are hereby adopted and deemed
incorporated herein by this reference solely for purposes of this section. Nothing in this section
shall prohibit the owner or occupant of any of the properties described in this section from
developing, using or maintaining such property in accordance with the zoning regulations of the
City of Anaheim otherwise applicable thereto following annexation of said property to the City
of Anaheim (the "City Regulations"). It shall be unlawful and a violation of this section for the
owner or occupant of any property which is described in this section to develop, use or maintain
said property in a manner which fails to comply with either the County Regulations or the City
Regulations."
SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares that should any section,
paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any
reason to be invalid, it is the intent of the Council that it would have passed all other portions of
this ordinance independent of the elimination herefrom of any such portion as may be declared
invalid.
SECTION 3. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of any other ordinance of this
City shall in any manner affect the prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty
or the penal provisions applicable to any violation thereof.
SECTION 4. PENALTY
Except as may otherwise be expressly provided by the Anaheim Municipal Code, any
person who violates any provision of this ordinance is guilty of a misdemeanor and shall, upon
conviction thereof, be punished in the manner provided in Section .1.01.370 of the Anaheim
Municipal Code.
THE FOREGOING ORDINANCE was introduced at a regular meeting of the City
Council of the City of Anaheim held on the 24th day of May , 2005, and thereafter
passed and adopted at a regular meeting of said City Council held on the 7th day of June
, 2005, by the following roll call vote:
