A RESOLUTION OF THE CIiY OF ANAHEIM PLANNING COMMISSION
RECOMMENDING ADOPTION OF AMENDMENT NO. 1 TO
THE HOTEL CIRCLE SPECIFIC PLAN NO. 93-1
ZONING AND DEVELOPMENT STANOARDS
WHEREAS, on August 9, 1994, pursuant to the procedures set forth in Chapter 18.93 of
the Anahe+m Municipal Code, the City Council of th~ Ciry of Anaheim has adopted Ordinance t~os. 5443
and 5444 ~~~proving the Notel Circle Specific Plan No. 93-~ (Chapter 18.79 of the Anaheim Municipal
Code) (inciuc,ing "Zoning and Develupment Star.dards", a Design Plan and a F'ublic Facilities Plan and
associated conditions af approval) to provide for the development of three new hotels (700 rooms) and a
15,000 sq. ft. theme restaurant on a 6.8-acre area located north of Katetla Rlvenue between Clementino
Street and Maheim Boulevard; and that the Sp~cific Plan also encompasses two existing hotels (one with
130 rooms and ~ne which has been converted to a 139-room vacation owne~ship facility);
WHEREAS, pursuant to th~t procedurees set forth in Chapter 18.93 of the Anaheim Municipal
Code, Frank Elfend, authorized agent fo~ B.U. Patel, Tushar Patel, Ma~rur B. Patel, Kash Partnersh~p and
TSB Crystal Partnership (property owners), submitted a request to ame~~d the Hotel Circle Specific Plan
No. 93-1; and ,
WHEREAS, the requested amendment encompasses approximately 5.95 acres of the 6.8-acre
Specific Plan area and has frontages of approximataly 246 feet on the east side of Clementine Street, 576
feet on the west s(de of Zeyn Street, 100 fe~t on the east side of Zeyn Street, 100 feet on lhe west side of
Anaheim Boulevard and 254 feet on the north side of Katella Avenue, and is funher described as 1742
and 1754 S. Clementine Street; 1730, 1733, 1743 and 1755 S. Zeyn Street 1733 S. Maheim Boulevard;
and 201 W. Katella Avenue; and
WHEREAS, subject Amendment N~. 1 to The Hotel Circie Specific Plan No. 93-1 application
requests modificalions ta Zoning and Developmer~: S~nd~rd~ relating to wall signage, freestanding
monumant signage; theme signage, vacation ownership units and parking; modific3tions to Mitigation
Monitoring Program NQ. G079 to delete two mitigation measures ~elating to required installation of
rect~imed water iines (or landscape irrigation &~d an 8-foot high construction barciers adjacent to
construction areas; and modi~cation of Condition of Approval No. 7 of Ordinance No. 5443 to delete the
requirement for a sidewalk on both sides of Hotel Circle Driva, and as further described in the Staff Report
to the Planning Commission dated August 4, 1997; and
WHEREAS, the Anaheim City Planning Commission did hoid a public hearing at the Anoheim
Civic Cenler. Council Chamber, 200 South Anaheim Boulevard, ~n the Ciry of M~heim, on August 4,
1897, at 1:30 p.m., notice of said hearing having been duly given as required by law and in accordance
with the provisions of the Anaheim ~~unicipal Code, Chapter 18.03, ta hear and wnsider evidence for and
against said Amendment No. 1 and 2o investigTte and make findings and recommenda!ion in connection
therewith; and
WHEREA~, the Planning Comm~ssion does hereby find tfiat the previously-appr~ved Miti~ated
Negative Declaratian in connection with t~e Hotel Circle Specific Plsn No. 93-1 and Mitigation Monitoring
Program No. 0079, as modified (incorporating the measures set forth in the Modified Mitigation Monitoring
Program No. 0079 pertain(ng to construc!ion barriers to provide flexibility for shorter fences and alternative
fencing mate;ials when scund attenua!ion is r:flt at issue and to reiain the measure pertaining to reclaimed
water lines) serve as the required environmental documentation ior subject request ~pon a finding by the
Planning Commission that the declaration reflects the independent judgment of the lead agency and that
is has consi~ered the Mitigated Negative Declaration together with any comments received during the
~ublic revie~v process and further finding on the basis of the Initial Study and any comments received that
there is no substantial evidence that the project will have a signnicant effact on the environment; and

WHEREAS, after due consideration, inspection, investigation and study made by itself, and after
due consideration of information provided by the staff report, evidence and Project refinements received
during the public hearing process, the Planning Commission DOES HEREBY FIND:
1) 'i nat Approvai of the re~uested arnendments relating to (a) timiny for conversion of
existing hotel units to vacation ownership units from five to eight years following adoption of the Specific
Plan, (b) permitting hotel units and vacation ownership units ~n a permanent basis subject to the approval
of a Conditional Use Permit and (c) permitting subterranean parking are consistent with the goals and
p~licies of the Generai Ptan in that these standards are consistent ai}d compatible with the standards
appiied to surrounding propertie~ within the Anaheim Resort Area;
2) That Approval of a provision aliowing the cons~deratio~ of theme signage subject to the
approval of a Conditional Use Permit and, further, to clarify that this provision wo~ld r~ot increase the
number ~f changeable message siyns permitted along Katella Avenue; (only one changeable message
sign wouid be allowed consistent with current Code requirements whether it was included in the thame
sign or elsewhere);
3) That Denial of the requested amendments pertaining to (a) pPrmitting vacation ownership
units by right, (b) permitting theme signage by ~ight and (c) permitting an increase in wail and freestanding
monument signage are not consistent or compatible with the 5pecific Plan or standards applied to
surrounding prop~erties, nor would they resuit in a development of desirat~le character;
4) That the Specific Plan area has unique site characteristics which are enhanced by speciai
land use and development siandards;
5) That the Specific Plan, as recommended to be amended, with the amendments as
recommended by staff, will resuit in a development of desirable character which will be compatibie with
existing and proposed development in the surrounding Anaheim Resort area;
6) That the Specific Plan contributes to a balance of land use; and,
7) That the Specific P!an, with the amendments recommended by staff, respects
environmental and aestt~etic resources consistent with economic realities.
SE IT FURTHER RESOLVED, that pursuant to the above finding, the Planning Commission of the
City of Anaheim does hereby recommend that the City Council by ordinance, adopt Amendment No. 1
incorporating recommendations by staff to the Zoning and Development Standards which are hereby
found to be a necessary in order to preserve the safety and general welfare of the Citizens of the City of
Anaheim.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
August 4, 1997.
