RESOLUTION NO. PC97-132
A RESOLUTION OF THE ANAHEIM CITY PLF+NNING COMMISSiON
AMENDING CERTAIN CONDITIONS OF APPROVAL OF
RESOLUTION NO. PC95-25 ADOPTED IM CONNECTION WITH
CONDITIONAL USE PERMIT NO. 2703
WHEREAS, on Ju~y 22, 1985 , the Planning Commission adopted Resolution No. PC85-176 to
approve Conditional Use Permit No. 2703 and peRnit a public mini-storage facility and on-site caretaker's
residence with waivers of minimum number of parking spaces, maximum building height, and minimum
structural setback adjacent to a residential zone at 1441 Noith Baxter Street; and that on March 6, 1995,
Commission adopted Resolution No. PC95-25 to add ce~tain conditions to said Resoiution No. PC85-176,
including permitting moving truck rental for a period of rinro years until March 6, 1997 (Condition No. 24).
WhlEREAS, subject property is developed with a self-storage and truck rental facility (Stor-A-Lot)
in the ML (Limited Industrial) Zone; and that the Anaheim General Plan Land Use Element designates
this property for General industrial land uses.
WHEREAS, petitioner requests amendment or deletion of Condikion No. 24 peRaining to a time
limitation to retain the existing truck rental operation in conjunction with the self-storage facility.
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the
Ciry of Anaheim on September 15, 1997, at 1:30 p.m., notice uf said public hearing having been duly
given as reguired by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed amendment and to invsstigate and
make findings and recommendations in cennection therewith; and
WHEREAS, said Ccmmission, after due inspection, investigation and study made by itself and
in its behalf, and after due cc nsideration of all evidence and reports offered at said hearing, does find
and determine tha following facts:
1. That subject conditional use permit is being sxercised in a mann~r not detrimental to the
particular area and surrounding land uses, nor to the public peace, heaith, safety and general welfare;
2. That there are no outstanding violations peRaining to this property, and that an extension
of time wiil not be detrimental to the surrounding neighbofiood; and
3. That no one indicated their presence at said pubiic hearing in opposition; and that no
correspondence was received in opposition to the subject petition.

Commission has reviewed the proposal and does hereby find that the Negative Deciaration previously
approved in connection with this conditional use permit is adequate to serve as the required
environmental documentation in connection with this request upan finding that the declaration refl~ec~ts~
tlie independent judgement of the lead agency and that it has considered the previously app
Negative Deciaration together with any comrcients received durin~ the public review process and further
finding on the basis of the initiai st~~dy and any comments received that there is no substantial evidence
that the project will have a significant effect on the environment.

NOW THEREFORE BE IT RESOLVED that the Ananeim Giry Pianning Commission does
hereby amend Conclition No. 24 of Resolution No. PC95-25, w'hich amended Resoluticn No. PC85-176
adopted in cor+nection with Conditional Use Permit No. 2703, t~~ read as follows:
24. That !he moving truck rental operations, in conjunction with the self-storage facility, is hereby
approved for a period of five (5) years to expire on Marr,h 6, 2002.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
September 15, 1997.
