RESOLUTION NO. PC97-165
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
APPROVING AN EXTENSION OF TIME FOR
CONDITIONAL USE PERMIT NO. 3301
WHEREAS, on August 21, 1990, the City Council adopted Resolution No. 90R-330 to
approve Condifiona". Use °ermit No. 3301 and permit from two to six dwelling units in the Flood Plain Zone
Overlay with waivers of required lot frontage and minimum distance between oil drilling sites and dwelling
units; and
WHEREAS, Resolution Plo. 90R-330 includes Condition No. 30 which requires that certain
conditions of approval (Nos. 1, 2, 4, 5, 7, 11, 13, 95 through 20, 23 and 28) be ccmplied with within a period
of one yea~ f~:om the date of Council's adopting said resolution; ihat two of those condiiions (Nos. 18 and
19) ha~.~21".'e.•~ :%~tis`ed; and that four pre~ious time extensions have been granted, the lasi one having
exFi~ed ~~n Au~iist':1, 1996; and
;!!H~REAS, the property owner, Blash Momeny, has requested a retroactive extension of
time for Con~Sitio7ai Use Permit No. 3301 to comply with the conditions of approval.
WHEREA5, the City Planning Commission did hold a meeting at the Civic Center in the Cify
of Anaheim on November 24, 1997, at 1:30 p.m., to investigate and make findings and recommendations in
connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by itself
and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the following facts:
1. That the project approved in connection with subject conditional use permit remains
consistent with the General Plan and the zone dislrict designation in which the properly is located;
2. That no Code amendments have occurred that would cause the approval to be inconsistent
with the Zoning Code; and
3. That no additional information nor changed circumstances exist to contradict 1he facts
necessary to support one or more of 1he required findings for approval of the project.
CALIFORNIA ENVIRON~~ENTAI_ QUALITY ACT FINDING: The Anaheim City Planning
Commission has reviewed the proposai and does hereby find that 1he Negative Declaration previously
approved in connection with Conditionai Use Permit No. 3301 is adequate to serve as the required
environmental documentation in connect.ion with this request.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby approve an extension of time, retraactive to August 21, 1996, for Conditional Use Permit No. 3301,
to expire on August 21, 1998.
THE FOREGOING RESOLUTIAN was adopted at the Planning Commission meeting of
November 24, 1997.
