A RESA~ENDING CE.RTAAN CGNIDITIONS OF APPROVHL OF SION
RESOLUTION NO. PC88-34 ADOPTED IN CONNECTION WITH
VARIANCE NO. 3863
WHEREAS, on ~ecember 5, 1988, the Planning Commission adopted Resolufion No.
PC88-334 to approve Variance No. 3863, in part, and waive permitted shopping center identification and
permitted wall signs to construct a 75 sq. ft. freestanding sign and 3 wall signs; and thaY Condition No. 6
of said resolution specifies:
"That subject property shall be developed substantially in accordance with plans and

be permitted subject to approval of the City Traffic Engineer, instead of ihe proposed
pole sign:'
WHEREAS, subject properly is developed with a commercial center at 5640 East La
Palma P.venue; that the properly is Iocated in Development Area S(Commercial Area) of Specific Plan
No. 94-1 (the Northeast Area Specifi, Pian); and that the Anaheim Gene:ai Plan land use designation is
General Commercial.
WHEREAS, the petitioner requests amendment of Condition No. 6, to relocate an
existing shopping center monument identification sign to subject property from 5646 East La Palma
Avenue, I~cated 130 feet to the west; that the relocated sign will be placed o~tside the ultimate right-of-
way along La Palma Avenue; that the submitted plan (Revision No. 1 of Exhibit No. 3) shows that the
existing sign is 42 sq. ft. with a maximum height of 6 feet and maximum width of 13 feet, 2 inches; and
th2t pian also indicates that one existing tree would be removed to accommodate the sign location;
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the Ciiy of Anaheim on November 24, 1937, at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Muni:ipal Code, Cha~ter
18.03, to hear and consider evidence for and against said Qroposed amendment and to investigate and
make findings and recommendations in connection ±herewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by itself
and in its behalf, and after due consideration of all evidence and reports off~red at said hearing, does
find and determine the foll~wing facts:
1. That the proposed modircation to permit the proposed sign, including impositien of
additional conditions, is reasonably necessary to protect the public peace, health, safety or general
welfare, and necessary to permit reasonable oQeration under the variance as originally approved;
2. That the 42 sq. ft. sign which will be relocated 1o subject property is the same size as
originally planned and approved in connection with this variance; and
3. That no one indicated their presence at said public hearing in opposition; and that no
co~respondence was received in cpposition to the subject petition.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal and does hereby find that the Negative Deciaration
previously approved in connection with `Jarance No. 3863 is adequate ~o serve as the required
environmentai documentation in connection with this request upon finding that the declaration reflects
the independent judgment of the lead agency and that it has considered the previously approved
Negative Declaration together with any comments received during tna public review process and furiher
fi~iding on the basis of the initial study and any comments received that there is no substantial evidence
that the project will have a significant effect on the environment.
NOW THEREFORE BE IT RESOLVED that the Anaheim City Planning Commission
does hereby amend Resolution No. PC88-334, adopted in connection with Variance No. 3863, as foilows:
~i) That Condition No. 6 be amended to read:
g, That subject propertl~ shall be developed substantially in accordance with plans and
specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2, and
Revision No. 1 of Exhibit "::,. 3, and as conditioned hereir..
(ii) That the followmg new conditions are added:
10. That any specimen tree removal shall be subject to the tree preservation regulations in
Chapter 1a.84 of the Anaheim Municipal Code pe~taining to the "SC" Scenic Corridor
Uverlay Zone.
? 1. That prior to final buiiding and zoning inspections for suaject sign, each existing tree to
be removed shall be replaced with two (2), minimum twenty four (24) inch box sized,
trees of the same spscies, to be planted, irrigated and maintained in the front setback
area.
12. That the Iocation of the proposed sign shall be subject to the review and appraval of the
City Traffic and Tra~isportation Manager for line• of-sight considerations.
13. That any tree planted on-site shall be replaced in a timely manner in the event that it is
rer:~ved, damaged, diseased and/or dead.
14. That prior to issuance of a permit for the sign relacation, the ownee of subject prope~ty
shall s~~bmit a letter requesting termination Uf Conditional Use Permit No. 1722 (to
permit sales rf beer and wine far on-premises consumption in a proposed restaurant)
and Conditional Use Permit No. 3234 (to permit sales of aicoholic beveragAs for on-
premises consumption with waiver of minimum number of parking spaces) to the Zoning
Division.
THE FUREGOING RESOLUTION was adopted at fhe PlannEng Commission meeting of
