Resolution-PC 97-180~ ~ RESOLUTION NO. PC97-180 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 3991 BE GRANTED WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described on Attachment "A". WHEREAS, the City Planning Commission did hold a pubiic hearing at the Civic Center in the City of Anaheim on December 22, 1997 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in cannection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and repo~ts offered at said hearing, does find and determine the following facts: 1. Tha4 the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.61.050.230 to construct a women's rehabililation center in conjunction with the existing Salvation Army men's rehabilitation center and woric therapy unit, and with the following waiver: Sections 18.06.050.0269 - Minimum number of parkinq soaces. 18.06.050.031 (575 required; 130 proposed and recommended by the 18.06.080 City Traffic and Transportaiion Manager) and 18.61.066.050 2. That subject property is developed with the Salvation Army men's rehabilitation center and work therapy unit, which was established under Conditional Use Permit No 2533 (approved by the City Council in 1985 and permiUing an aduit rehabi!itati~r~ center, including a 150-bed men's residence and treatment center, and a work therapy unit with waiver of minimum number of parking spaces); 3. The petitioner has submitted a parking demand study, dated October 29, 1997 to substantiate the requested waiver; and that the Ci1y Traffic and Transporlation Manager has reviewed the submitted plans and parking study and finds the proposed parking sufficient to serve the proposed uses of the property; 4. That the parking waiver, under the conditions imposed, will not cause fewer off-street parking spaces to be provided for such use than the number of such spaces necessary to accommodate all vehicles attributable to such use under the normal and reasonably foreseeable conditions of operation of such use; 5. That the waiver, under the conditions imposed, will not increase the demand and competition for parking spaces upon the public streets in the immediate vicinity of the proposed use because more than an adequate number of spaces will be provided on-site and parking is not permitted on Lewis Street adjacent to the Center; _~ _ PG97-180 CR3139PL.DOC ~ ~ 6. That the waiver, under the conditions imposed, will not increase the demand and competition for parking spaces upon adjacent private prope~ty in the immediate vicinity of the proposed use ( which properiy is not expressly provided as parking for such use under an agreement in compliance with Section 18.06.010.020 of this Code) because more than adequate parking will be provided on-site and all the adjacent private property is either owned by the Salvation Army and/or is vacant Iand; 7. That the waiver, under the conditions imposed, will not increase traffic conyestion within the off-street parking areas or lots provided for such use because the women's residence improvements include improving the existing driveway and providing a new access for the proposed parking area adjacent to the women's residence; 8. That the waiver, under the conditions imposed, will not impede vehicular ingress to or egress from adjacent properties upon the public streets in the immediate vicinity of the proposed use because the proposed women's residence parking area access will be connected to the existing private street which provides access for lhe adjacent property (existing men's residence) to Lewis Street; 9. That the proposed use is properly one for which a conditional use permit is authorized by the Zoning Code; 10. That the proposed use will not adversely affect the adjoining land uses a~d the growlh and development of the area in which it is proposad to be located; 11. That the size and shape of the site for the proposed use is adequate to allow the full development of the proposed use in a manner not delrimental to the pa~licular area nor to the peace, health, safety and general welfare because the proposal is an expansion of a use that has been in existence at this site for a substantial time period without having a detrimental impact on the surcounding land uses nor on the growth and development of the area, nor to the peace, health, safety or general welfare of the Citizens of Anaheim; 12. That the traffic generated by the proposed use wiil not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; 13. That the granting of the conditional use permit, under the conditions imposed, will not be detrimental to ihe peace, health, safety and general welfare of the citizens of the City of Anaheim; and 14. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition. CALIFORNIA ENVIRONfNENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to construct a women's rehabilitation center in conjur~`tion with the existing Salvation Army men's rehabilitation center and work therapy unit, with the waiver of minimum number of parking spaces on a 14.51-acre parcel having a frontage of 1130 f°et on the east side of Lewis Street, a maximum depth of 435 feet and is located 820rovetthe~Ne~alive centerline of Cerritos Avenue (1300 South Lewis Street); and does hereby app 9 Declaration upon finding that the declaration reflects the independent judgement of the lead agency and that it has considered ihe Negative Declaration together with any comments received during the public is n~o s b t nUal evidence thatthe p oject willlhave aes gnifi atnteffect on the enveonmert ~ved that there _2_ PC97-180 ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use a'r the subject property in orcJer to preserve the safety and general welfare of the Citizens of the City of Anaheim: 1. That trash storage area(s) shall be provided and maintained in location(s; acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved plans on file with said Department. Such information shall be specifically shown on plans submitted for building permits. 2. That a plan sheet for solid waste storage and coliection and a plan for recycling shall be submitted to the Public Works Department, Streets and Sanitation Division, for review and approval. 3. That plans shall be submitted to the Gity Traffic and Transportation Manager for review ano approval showing conformance with the most current versions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and driveway location. 4. That an on-site trash truck turn-around area shall be provided in compliance with Engineering Standard Detail No. 610 and maintained to the satisfaction of the Public Works Department, Streets and Sanitation Division. Said turn-around shall be specifically shown on plans submitted for building permits. 5. That vehicles shail not be permitte~i for the residents of the women's rehabilitation center. 6. That the proposed women's residence is approved soleiy in conjunction with the existing rehabilitation center. The proposed use of ttie property shall be limited to that stated in the leher of operation (dated August 27, 1997 and attached to the Staff Report to the Planning Commission dated December 22, 1997). If the existing rehabiiitation center should cease operation, the buildings on this properly shall not be used for any other residential uses. 7. The maximum number of residents for the women's facility shall be twenty six (26). 8. That subject property shall be devetoped substantially in confarmance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on fle with the Planning Department marke~ Exhibits No. 1 through 5, and as conditioned herein. 9. That prior to issuance of a building permit or within a period of one (1) ye ~:; m the date of lhis resolution, whichever occurs first, Condition Nos. 1, 2, 3 and 4, above me ;i~oned, shall be complied with. Extensions for fu~lher time to complete said conditions may be granted in accordance with Section 18.03.090 of tFie Anaheim Municipal Code. 10. That prior to final building and zoning inspections, Condition No. 8, above-mentioned, shall be compiied with. 11. That approval of this application constitutes approval of the proposed req~est only to the extent that it compiies with the Anaheim Municipal Code and any other applicable City, State, and Federal regulations. Approval does not inciude any action or findings as to compliance or approvai of the request regarding any other appiicable ordinance, regulation or requirement. _3_ PC97-1 SO ~ ~ BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set fo~th. Should any such condition, or any part thereof, be oeclared invalid or unenforceable by the final judgment of any cour! of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed nutl and void.
