A RESOLUTION OF THE ANAHEIM C17Y PLANN{NG COMMISSION
AMENDING CEFiTAlN CONDITIONS OF APPROVAL OF
RESOLUTION NO. PC97-26 ADOPTED IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 3726
WHEREAS, on December 3, 1990, the Planning Commfssion granted Conditional Use Permft
No. 3363 permitting a church faciliry with waivers of minimum number of parkfng spa.ces and permitted
hours of operation for three years (Vineyard Church at 5300-5340 East La Palma Avenue); thaY on June 17,
1g91, Commission amended said condftional use pem'iit to expand the existing church v~ith waiver of
minimum number of parking spaces; and that on May 18, 1992, the Planning Commissfon granted

WHEREAS, ~n October 31,1 ~, the Planning Commission adopted Resolution No. PC94-147
granting subject Conditfonal Use Permit No. 3726 to permit expansion of the previousty-approved prNate
educational institution (Fairmont School at 5310 East La Palma Avenue) and that said approvai included the
following conditions:
"5. That subject property shall be developed substantially In gccordance with plans and
specifications submitted to the City of Anaheim by the petftioner and which plans are on file
with the Planning Department marked Exhibft Nos. 1 through 3.
g, That enrollment of subject school shall not exceed four hundred f'~ty (450) students.'

WIiEREAS, the Ciry !'lanning Commission did hold a public hear(ng at the CNic Center in
the City of Anaheim on March 17, 1997, at 1:30 p•m•~ not(ce of said public hear(ng having been duly gNen
as required by law and in accordanc~ wfth the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed amendmenY and to investigate and mako
findings and recommendat(ons in connection therewith; and
\NHEREAS, safd Commission, after due inspection, irnestigation and study made by ftself
and in its behaif, an~ after due conslderation of all evidence and reports offered at said hearing, does find
and determine the following facts:
t. That subject property is located in the Project Alpha Northeast Redevelopment Area, and
Community Development Departmer.t staff has revlewed this proposal and determined ft to be in
substantial conformance with the Redevelopment Plan.
2. That no one indicated their presence at said public hearing in opposftion; ar~d that no
correspondence was receNed in opposftion to the subject petftion.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposal and does hereby flnd ihat the Negative Declaration previously
approved in connection with Conditional Use Permit No. 3726 is adequate to serve as the seyuired
environmental documentation in connectlon with this request upon finding that the declaration reflects the
independent judgement of the lead agency and that it has considered the previously approved NegatNe
Declaration together with any comments received during the public revtew process and further finding on
the basis of the initial study and any comments received that there is no substantial evidence thai the
project will have a signfficant effect on the environment.
NOW THEREFORE BE IT RE80WE0 that the Planning Cfty Commission does hereby amend
Resolution No. PC94-147, adopted in connection with Condftional Use Permit No. 3726, to increase the
maximum enrollment to 650 students by converting 5,715 sq.ft. of ch~~'ch audftorium space to classroom
use and comaerting an existing parkin~ araa into a 9,550 sq.ft. turf covered children's play area fior use by
Fairmont School at 5310 East La Paima Avenue; and
BE IT FURTHCR RESOWED that the conditions of approval contained in Resolution No. PC94-147
are hereby amended as foilows:
(i) Amend Condit(on Nos. 5 and 6 to read:
"5.
That subject property shall be developed substantially in accordance with plans and
specificatlons submitted to the Ciry oi Anaheim by the petitioner and which plans are on file
with the Planning Department marked Revision No. 1 uf Exhibit No. 1 and Exhibft Nos. 2
and 3'
That the schoof enrollment shall not exceed six hundred fffty (650) students at 5310 East La
Paima Avenue."
(ii) Add the follow;ng conditions:
°~p. That prior to comm2ncement of use of the proposad playground, a fence enclosure of the
playg~ound shall be constructed of wrought iron ~vherever the 4ence is visible from La Paima
Avenue; and that the remafndfrr of the fence may be constructed of chain Iink.
>>, That within a period of sixty (60) days from the date of this resolution, the proposed parking
spaces along Cambridge Circle (a private street) shall be striped to match Revision No. 1
to Exhibit No. 1.
~ 2, That within a period of sixty (60) days from the date of this resolution, a plan sheet for solid
waste storage and collection and a plan for recyding shall be submitted to the Public Works
Department, Streets and Sanitation Division, for review and approval.
~3, That tho applicant shall submft a signed statement, approved by the Ciry Attomey's Office,
acknowic-dging that industrial uses are permiited, and ~-aY be located immedtately adjacent
to subject use. The statement shall indicaEa the perrnitted Primary uses and condftionally
permitted uses specHied by SFe~iHc Plan Mo. 94-~ for Development Area 2, and shall
