A RESdLUTiON OF THE ANAHEIM CITY PLANNIhG COMMISSION
ANENDING RESOLUTION NO. Pq3-132 ADOPTED IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 3648
WHERE4S, on December 1, 1993, the Planning Commisslon adopted Resdution N~. PC93-132 in
connectlon with Corxlftional Use Pertnii No. 3648 to pe-'mft an automoYrve tire sales and installation faciliry
wRh waNer of minimum number of parking spaces at 909 North Anaheim Boulevard; and that satd
Resolution No. PC93-132 included the fdlowing condkion:
11. That subject busfness shall be Iimfted to the sale and Installation of tires and ~ims purchased
oniy on the subJect property.
WHEFEAS, this properry is developed wfth a 5,800 sq.ft. commercfal building (n the CG
(Commercial, General) xone.
WHEREAS, the petftioner has submitted a request to amend Condft~on No. 11 to permR an
automotive stereo Instailatlon facGity undEr the authority of Code Section 18.03.092.060; and that said
proposal was ~~ccrrectlY advertised as an automotive stereo and aiarm installatfon facilky.
WHEREAS, the Ctry Planning Commission did hdd a public hearing at the Civic Center in the
Ciry of Anaheim on July 21, 1997, at 1:30 p.m., notice of said public hearing having been duly given as
required by law and fn accordance wfth the provision~ of the Anahoim Municipal Code, Chapter 18.03, to
hear and conslder evtdence for and against said pro~sosed amendment and to investlgate and make
f(ndings and recommendations in connection therewfth; and
WHEHEAS, sakl Commtsalon, after due Inspeccion, irnestlgatlon and study made by itself and
in fts behalf, and aiter due consideration ef all evY~ence and reports offered at said hea~tng, does flnd and
determfne the fdlowing facts:
1. That ttie proposed rttodiflcation, induding the imposftfon of addftional condftions, is
r~~~ay ~~ry to protact the public peace, health, safety and general welfare, and necessary to
permft reasonable operation under the conditional use permft as origlnally granted;
2. That the proposed stereo sales and installation facUity is a Iisted condftionally-permitted use
!n the CL (Commercial, LlmRed) Zone and, as condltioned herein, will be compatible wfth the existing
commercial and automotNe repair businesses in the surrounding neightorhood~
3. That there are no apprecfable dffferences between the previousiy-approved automotNe t(re
sales arxi installatio~ faciliry and the proposed stereo sales arxl installation faciliry in terms of the floav p~an
arrangement and op~ratlonai characteristics;
4. That two peoP~e spoke in opposition to the proposal at the public hearing; and that n~
correspondence was receNed in opposftbn to the subJect petftion.

rAUFORNIA ENVIRONMEt~TAL ~UAUT`f PCT FlNDING: That the Anaheim Cfry Planning
Commfssion has revlewed the proPosal a~d does hereby flnd that the Negative Dedaration previously
approved tn connectbn with GondRional Use Permit No. 3648 ts adequate to serve as the required
srnironmenta~ documentation in connectlon with this request upon flndfng that the dedaratlon reflects the
irxlependeM Judgement of the lead agency and that ft has considered the previously approved NegatNe
Dedaration together with any comments receNed durin~ the public review process and further findfng on
the basis of the initial study and anY commems r9ceNed that there is no substantial evidence that the
project wi~l have a signfflcant effect on the ernironmeM.
NOW THEREFORE E IT RESOLVED that the Anaheim City Pianning Commissfon does hereby
amend Resoiutbn No. PC93-132, adopted in connaction wich Condftional Use Permft No. 3648, as foltows:
(~ That the uge shall consist of an automotNe stereo installation facility; and that th~ ,:siver of minimum
~umber of parking spaces shall remafn the same ag P~eviously-approved;
(~n That Condhion Nos. 1 and t 7 are amended to read:
1. That all business actNitles st~all be conducted whd~Y ~~side the building.
11. That subJect business shall be ~imfted to the sales and lAStallation of stereo and atarm equlpment,
purchased only on the subject property.
(iil) That the fdlowing now condfttons are added:
15. That there shall be ra test~n9 d stereo a a~8~ e~luipment that is audible outside the building.
16. That this candftional use Permft shall expire one (1) year ftom the date of this resdullon, on July
21, 1996.
17. That the on-slte Iandscapfng and Irrigatlon system shall be refurbished and mainta(ned fn
compliar~ with Ciry standards•
18. 7hat the hou~s d operatlon shall be Iimited :0 9 a.m. to 8 p.m., Mondays through Frkiays, and
10 a.m. to 5 p.m., Saturdays and Surxlays, wttl~ four (4) empioyees, as stated by the petitioner.
19. That withln a pertod of thirty (30) days from the date of this resoiutlon, ~lans for a comprehensfve
sign program sheil be submitted to the Zoning Divlsion for review and approval by the Planning
Commisskm as a'Reports and Recommendatlons' agenda ftem. No signs other than those
speci~cally approved by the Planning Commission shal~ be permitted.
20. That no avemfght storage of vehides shall be permitted~ as stipulated to by the petitioner.

foot rdi-up door facing the ailey to the west shall be dosed and insulated; end that a new twelve

dosed at the end of the th~r'ry (30) day Perbd untN the door on the souch side d the property
is completely installed and the door to west dosed and insulated.
