PC97-97 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMiSSION THAT PETITION FOR CONDITIONAL USE PERMlT NO. 3951 BE GRANTED WHEREAS, ths Anaheim City Planning Commission did receive a verified Petition for Condftio~lal Use PermR for certain real property situated in the C!ry of Anaheim, Counry of Orang2, State of Califomia, described as: LOT 36, EUCALYP'fUS FOREST TRACT, AS SHOWN ON A MAP RECORDED IN BOOK 5, PAGES 29 Ai~iL' 3cl MISCELLANEUUS RECORDS OF ORANGE COUNTY. WHEAEAS, the City Planning Commission uw hold a public hea~ing at the C(vic Center in the City of Anaheim on July 21, 1997 at 1:30 p.m., notice of said pubiic hea;?n~ having been duly given as required by law and in accordance with the provisions of the Rnaheim Municipal Code, Chapi~i S°.~3, to hear and consider ev(dence for and against safd proposed condftfonal use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by ftself and in Rs behalf, and aft~r :.°ua consideration of all evidence and reports offered at said hearing, does find and determine the fdlowing facts: 1. That the proposed use ts properiy one for which a conditional use permR is authorized by An~he(m ~.lunicipal Code Sectlon 18.110.050.0515 to permR an 1,800 sq. ft. office buildfng in conjunction w~th a 34,665 sq, ft. contrac:tors storage yard; 2. That the proposed use is properly one for which a condiiional use permit is authorized by the Zon(ng Code in Development Area 1(Industrial Area) of Specfflc Plan No. 94-1 (Northeast Area Specific Plan); 3. That the proposed use will not adversely aifect the adJoining land uses and the growth and development of the area in which ft is proposed to be located because ft is compatible with the suROUnding industrial neighborhood; 4. That the size and shape of the sfte for the proposed use is adequate to allow the full development of the pioposed use In a manner not detrimsntal to the particular area nor to the peace, health, safety and genera! w~lfare; 5. Thai the traffic generated by the proposed office use will n~t impose an undue burden upon the streets and h(ghways des(gned and improved to carry the traffic in the arsa because sa(d use wfll be relocating to this properry from a nearby site only one biock away; 6. That the granting of the conditional u~e permft, under the ccmdftions imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the Ciry of Anahefm; 7. That no one indicated their presence at the public hearing fn opposit{oss; and that no correspondence was received in opposftion to the subject petftion. CR2982PLWP -1- PC97-97 ~ ~ ~AUFORNIA ENVIRONMENTAL QUALITY ACT FINDIivi :: That the Anaheim Ciry Planning Commission has reviewed the proposal to permft an 1,800 sq. ft. affice building in conjunction with a 34,665 sq, ft. contractor's storage yard on a 0.76 acre, rectangularly-shapec! parcel of land wfth a frontage of 132 feet on the north side of la Cresta Avenue, a maximum depth of 310 feet, and being located 398 feet east of the cerrte~tine of Blue Gum Street (2831 East La Cresta Avenusj; and does hereby approve tha NegatNe Declaration upon flnding that the declaration reflects the independent judgement of the lead agency and that it has considered the Negathre Der,laration together wfth any comments receNed during the public review process and iurther flnding on the basi~ of the inftiai study and any comments receNed that there is no substantial evfdence that the project will have a sign~icant effect on the environment. NOW, THEREFORE, BE IT RESOLV~:D that the Anaheim Ciry Planning Commission does hereby ~rant subject Petition for Condftional Use Permit, upon the following conditions v~hich are hereby ~ found t~ be a necessary prerequisfte to tha proposed use of the subject properry in order to preserve the safery and general welfare of the Citizens of the Cfry of Anaheim: ~ 1. That the proposed chainlink gate shall remafn unlocked and open during business hours to provide vehicular ac~d pedestrian access to required on-sfte parking. 2. That the PVC slats interwoven into the chafnlink fencing, as proposed, shall be maintained in good condftian at all times. 3: That the two (2) parkinfl spaces on efthor side of the proposed driveway adjacent to the south properry line shalt be removed and that saki area be comptetely landscaped. Said informatfon shali be shown on the plans submitted for buliding permfts. 4. That all outdoor storage aroas shall be paved to a minimum depth of three (3) inches, except that gravel may be placed around the perimeter where materials are stored. Sald storage areas s~s.all be permanently maintained. 5. Thai ail roof-rriounted eyuipment shall be completely screened trom view of any public r(ghts-of-way in conformance wfth Code Section 18.110.050.030.03d9. Sald information shall be shown on the plans submitted for building parmfts. 8~ ~; ;~ _ 6. That trash storage areas shail be provided and maintained in a location accepiable to tl7e Publi~ 1 ti~~ Wo-ks Department, Streets and Sanitation Division, and in accordance wfth approved plans on file viith said Department. Said information shall be specffically shuwn on the plans submitted for build(ng - permfts. 7. That plans for a maximum three (3) foot high monument sign on a solid base shall be submi!ted to the Zoning Division for review and approval by the Planning Commission as a"Reports and Rec~rnmendations' item. 8. That signage for subJect faciliry shall be I(m~ted to the wall sign shown on approved exhibits and the monument sign ident~ted in Condition No. 7, above. Any addftional signs shall ~ie subject to review and approval by the Planning Commisuton as a'Reports anJ Recommendatiuns' item. 9. That the buliding roof shall be painted wfth three (3) foot high reflectMe address numbers in a contrastin~ cdor to the rooiing material. Said address numbers shall not be vis(ble from ground level. 10. That a plan sheet for soiid waste storage and cdlection, arxi a plan for recyciing shall be submitted to the Public Works Department, Strests nnd Sanitation Divisien, for review and approval. -2- PC97-97 ~ ~ 11. That an on-site trash truck tum-around area shall be provided and maintained to tt~a satisfaction of the Public Works DepaKment, Streets and Santtation Division. Said turn-around area shall be spec~ically shown on the plans submitted for building pennfts. 12. That gates shall not be installed across any drfveway fn a manner which may adversely affect vehicular trafflc in the adjacerrt pubUc street. That plans shall be submitted to the Ciry Traffic and Transporcation Manager for review and approval sho~ving conformance with the latest revisions of Engineering Standard Pian Nos. 436 and 602 pertaining to parking standards and ci~tveway locations. Subject property shall thereupon be developed and maintained in conformance with said pians. 14. That no required parking area siiall be fenced or otherwise enclosed for outdoor storage uses. 15.
