A RESOLUTION OF THE ANAHEIM CIN PLA,NNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMI7 NO. 4036 BE GRANTED, IN PART
WHEREAS, ihe Anaheim City Planning Commission did receive a verified Petition for
Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State
of California, desaribed in Attachment "A":
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
tfie City of Anaheim on June 22, 1998, at 1:30 p.m., notice of said public hearing having bean duly given
as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendafiuns in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by itself
and in its behaif, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the following facts: _
1. That the proposed use is properly one for which a conditional use permit is authorized by
Anahsim Municipal Code Sections 18.05.046.020 and 18.61.050.050 to permit an automotive sales lot
and parking lot with accessory service/repair facilities and two 10-foot high, 150 sq. ft. monument signs
with waivers of the following:
(a) Sections 18.04.060.050 - Reauired aarkinp lot landscaoina,
18.06.030 (Minimum 48 sa. ft. Iandscaped break required separating
and 18.61.066 sets of 10 parking spaces in a row; 25 sa. ft. landscaped breaks
proposed separating sets of more than 10 spaces in a row)

2. That this pr~posal concerns an auto dealership (CarMax) on an overall 19.4-acre site, of
which 6.7 acres are in the City of Anaheim and 12.7 acres are in the City of Orange; and that all the
structures, including a 65,970 sq. ft. sales and service building, a 5,072 sq. ft. presentation area and a
2,808 sq. ft. wash/detail building are located in lhe City of Orar.ge (under City of Orange Conditional Use
Permit No. 2199-98} and the employee/ customer parking and auto inventory staging/storage area are
located primarily in the City of Anaheim.
3. That waiver (a), required parking iot landscaping, is hereby approved, in part, waiving only
the location of required lan~scaping but not the total combined squ;~re footage required or the minimum
number of trees; and that the volume of landscaping in the parking lot wil~ be equal to, or greater than,
required by Code.

4. That waiver (b), permitked location of freestanding signs, is hereby approved in part,
waiving the setback requirement only to the extent that may be necessary to allow a"directional " sign on
the east side of the drive~vay; and that there are special circumstances applicable to the property
consisting of its shape, location and surroundings, which do not apply to other identically zoned properties
in the vicinity, because the frontage on Orangewood Avenue is only 50 feet wide and includes a service
driveway to the proposed business.
5. That waiver (c), maximum sign widih, is hereby denied because revised plans were
submitted after public notification ~howing compliance with Code standards for freestanding signs
advertising retail businesses having regional significance.
6. That waiver (d), mfnimum sight distance requirements, is hereby denied on the basis that
lhe petitioner indicated at the public hearing that the sign location on Orangewood would comply with this
Code standard.
7. That the two monument signs originally proposed (10 feet high with 150 sq. ft. display
areas) are not approved; but instead, as agreed to by the petitioner, neither monument signs will exceed
eight feet in height, and the sign on State College Boulevard will not •exceed 65 sq. ft. in display area and
the sign on Orangewood Avenue will not exceed 25 sq. ft. in d(splay area. _
S. That the proposed use, as approved and as shown on the submitted exhibits and
described in the letter of operation, will not adversely affect the adjo(ning land uses and the growth and
development of the area in which it is proposed to be located.
9. That the size and shape of the site for the proposed use is adequate to allow the full
development of the proposal in a manner not detrimental to the particular area nor to lhe peace, health,
safety and general welfare because this 6.7-acre site in the City of Anaheim is large enough to support the
parking lot necessary far the aufo dealership and its accessory uses located in the City of Orange.
10. That the traffic generated by the proposed use will not impose an undue burden upon the
streets and highways designed and improved to carry the traffic in the area.
11. That granting of this conditional use permit, under the conditions imposed, will not be
detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim.
12. That one person spoke at the public hearing regarding concerns about the proposal; and
that no one spoke in opposition and no correspondence was received in opposition to this petition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to permit an automotive sales lot and parking lot with
2ccessory service/repair facilities and two 10-foot high, 150 sq. ft. monument signs, and with waivers of
required parking lot landscaping, permitted location of freestanding signs, maximum sign width and
minimum sight distance requirements on a 6.7-acre parcel located southeast of the southeast corner of
Orangewood Avenue and State College Boulevard, having frontages of 50 feet on the south side of
Orangewooti Avenue and 347 feet on the east side of State College Boulevarcl, and being located 570 feet
south of the centerline of Orangewood Avenue (2150-2170 South State College Boulevard, formerly a
portion of the Orange Drive-In Theater); and does heieby approve the Negative Declaration upon finding
that the declaration reflects the independent Judgment of the lead agency and that it has considered the
Negative Declaration together with any comments received during the public review process and furlher
finding on the basis of the initfal study and any comments received that there is no substantial evidence
that the project will have a significant effect on the environment.

NOW, THEREFORE, BE IT RESOLVeD that the Ar~aheim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, in part, upon the foliowing conditions which
are hereby found to be a necessary prerequisite to the proposed use oF the subject property in order to
preserve the safety and generai welfare of the Citizens of the City of Anaheim:
1. That trash storage area(s) shall be provided and maintained in Iocation(s) acceptable to the Public
Works Department, Streets and Sanitation Division, and in accordance with approved plans on file
with said Department. Said storage areas shall be designed, located and screened so as not to be
readily identifiable to adj~cent streets or highways. The walls of the storage areas shall be
protected from graffiti opportunities by the use of plant materials such as clinging vines or tali
shrubbery. Said information shall be specificaily shown on the plans submitted for Streets and
Sanitation Division approval.
If, however, the above requirement is provided entirely on the portion of this dealership located in
the City of Orange and plans are submitted to and approved by the City of Orange, a copy of those
approved plans shall be submitted to the Zoning Division, Anaheim Planning Department and
placed in this conditional use permit file. Said approved plans will satisfy this condition.
That a plan sheet for solid waste storage and collection and a plan for recyciing shall be submitted
to the Public Works Department, Streets and Sanitation Division, for review and approval.
If, however, the above requirement is provided entireiy on the portion of this dealership Iocated in
the City of Orange and plans are submitted to and approved by the City of Orange, a copy of those
approved plans shall be submitted to th~: Zoning Division, Anaheim Pl2nning Department and
placed in this conditional use permit file. Said approved plans will satisfy this condition.
That an on-site trash truck turn-around area shall be provided in accordance with Engineering
Standard Detail No. 610 and maintained to the satisfaction of tihe Public Works Department, Streets
and Sanitation Division. Said turn-around area shall be specifically shown on plans submitted ror
building permits.
If, however, the above requirement is provided entirely on lhe portion of this dealership located in
the City of Orange and plans are submitted to and approved by the City of Orange, a copy of those
approved plans shall be submitted to the Zoning Division, Anaheim Planning Department and
placed in this conditional use permit file. Sa(d approved plans will satisfy this condition.
4. Tt~at plans shall be submitted to the City Tra~c and Transportation Manager for review and
approval showing conformance with the most current versions of Engineering Standard Plan Nos.
436 and 602 pertaining to p2rking standards and driveway locations. Subject property shall
thereupon be developed and maintained in conformance with said plans.
5. That plans shall be submitted to the City Traffic and Transportation Manager for review and
approval and showing conformance with the Engineering Standard No. 137 pertaining to sight
distance visibility for the sign locations.
6. That no truck parking, staging or vehicle delivery shall be permitted on Orangewood Avenue or
State College Boulevard.
7. That no loading/unloading of vehicles shall be permitted on Orangewood Avenue or State College
Boulevard.
8. That prior tcr commencement of the activity herein approved (including but not limited to grading,
landscaping and/or paving the parking lot in the City of Anaheim) or prior to issuance of a certificate
of occupancy by the City of Orange for the portion of this proJect located fn the City of Orange,
whichever occurs first, a cooperation agreement by and between the City of Anaheim and fhe
Orange Redevelopment Agency covering items relating to this project shall be duly executed.

9. That the existin,; fifteen (15) foot high metal fence on the subject properry shall be removed and
replaced with ~ decorative eight (8) foot high block wall to screen the site from adjoining industrial
properties. Said wall shall match the proposed eight (8) foot high block wall enclosing the auto
staging/str,rage area at the eastem portion of th~~ property.
10. That thE final landscaping and irrigation plan(s) for subject property shall be submitted to the Zoning
Divisio~~ for review and approval. The pians shall include additional plant material consistent with
the ant ~ipated Stadium Area Master Land Use Pian, such as Lemon Scented Gum, Sugar Gum,
Spotted Gum, Red Ironbark, Cajeput Tree and Canary Island Pine.
(a) The plan(s) shall show clinging vines planted on maximum three (3) foot centers adjacent to
the eight (8) fout high block walls enclosing the auto staging/storage area and screening the
adjoining industrial properties to the north to prevent gra~ti opportunilies.
(b) A minimum of seventeen (17), twenty four (24) inch box, trees shall be planted in the
landscaped planter aiong and immediately adjacent to State College Boulevard.
(cj Except as specifically permitted by approval of waiver (a) (which allows minimum twenty
five (25) sq. ft. landscaped planters separating sets of parking spaces exceeding ten (10)
spaces), the total square footage of landscaping in the parkinc; area, excluding required
landscaping adjacent to State College Boulevard, shall not be less than would be required if
forty eight (48) sq. ft. pfanters were provided, as required by Code Section 18.04.060.050,
to separate every set of 10 parking spaces in a row. Additiona~ly, the number of trees in the
parking area shail not be less than the total number required if one (1) tree were planted in
each forty eic~ht (4a) sq, ft, planter otherwise required by Code Section 18.04.060.050 to
separate every set of 10 parking spaces in a row. Any decision made by the Zoning
Division regarding said plan(s) may bo appealed to the Planning Commission and/or City
Council.
11. That the developer shall be responsible for compliance and any direct costs associated with the
Mitigation Measures established by the City of Orange, as required by Section 21081.6 of the Public
Resources Code, to ensure implementation of those mitigation measures identified in the
Recommended Conditions of Approval (Nos. 15 through 41) approved ir conjunction wiih
Conditional Use Permit No. 2199-98 for Mitigated Negative Deciaration No. 154z-y8, as adopted by
the City of Orange. A certified copy of said compliance with those mitigation measures shall be
submitted to the Zoning Div(sion, Anaheim Planning Department, to ensure implementation.
12. That the two (2) proposed freestanding signs on subjact property shall be monument type not
exceeding eight (8) feet in height as measured from the grade of the closest public sidewalk and
shall be subject to review and approval by the Cily Traffic and Transportation Manager to verify
adequate lines of sight. The dispiay area of the monument sign near the driveway on State College
Boulevard shall not exceed sixty five (65) sq. ft. The monument sign on Orangewood Avenue shall
be located on the east side of the driveway, as close as possible to the driveway, and the display
area shall not exceed twenty five (25) sq. ft.
13. That plans for a comprehensive sign program, including detailed plans for the freestanding
monument signs for Slate College Boulevard and Orangewood Avenue, shall be submitted to the
Zoning Division for review and approval by the Plannfng Commission as a"Report3 and
Recommendations" agenda item.
14. That the storage or overnight parking of vehicles, vehicle parts, or business-related materials and a!I
work on vehicles (including the washing of vehicies) shall be confined entirely to tre interior of the
service building or within the enclosed auto staging/storage area. Absolutely no vehicular body
work, painting or other business-related activitfes, or storage of veh(cles, vehicle p2rts or materials
shall be allowed outside the service buildings or the auto staging/r;torage areas.

15. That customer parking spaces shall be striped and clearly marked for "customer parking only," and
ai no time shall customer vehicles be stacked, double parked, or left standing in tandem in front of,
or adjacent to, the buildings.
16. That the main access driveway from Staie College Boulevard shall be constructed according to
CalTrans approved plans. If the subject auto deaiership is compieted before the CalTrans
improvements are installed, the petitioner may be required to construct planned improvements or to
prepare an interirn design and construct altemate improvements for ~ccess to the site from State
Coilege Boulevard.
17. That this Conditional Use Permit No. 4036 shail operate in connection with City of Orange
Conditional Use Permit No. 2199-98, and any changes, revisions, modifications, etc. to said
Conditional Use Permit No. 2199-98 may necessitate additional action by the Anaheim Planning
Commission or City Council, as determined by the Anaheim Planning Department.
18. That the portion of this dealership located in the City of Anaheim shall not be developed as a
separate or independent automobile deaiership; and that the parking lot and auto staging/storage
areas shall be developed in conformance with approved exhibits on file with the City of Aqaheim
(Conditional Use Permit No. 4036) and with the City of Orange (Conditional Use Permit No. 2199-
98). Furthermore, this Conditional Use Permit No. 4036, and ali uses and activities permitted
herein, is expressly conditioned upon City of Orange Conditional Use Permit No. 2199-98 remaining
in fuil forcP and effect; and, if the portion of this dealership located in the City of Orange ceases to
exist or Conditional Use Permit No. 2199-gg expires or is terminated by the City of Orange, it shall
constitute sufficient c~rounds for termination of this Conditional Use Permit No.4036.
19. That subject property shall be deveioped substantially in accordance with pians and specifications
submitted to the Ciry of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1 through 10; as conditioned herein and including lhat the total
combinec! s~~uare footage of landscaping required and distributed throughout the parking area, and
the total number of trees in the parking area, shall not be less than is required by Code Section
18.04.060.05C "Parking Lot Landscaping" and as specified in Condition No. 10, above.
20. That the owner of subject property shall submit a letter requesting termination Conditional Use
Permit No. 3842 (to permit swap meet operations on lhe City of Anaheim portion of the Orange
Drive-In Theater, including an accessory outdoor roller hockey facility in the parking tot), Conditional
Use Permit No. 3106 (to permit and govern construction of one 18-story commercial office building
and a parking structure in Anaheim and two 10-story and two 18-story commercial o~ce buildings in
the City of Orange portion of lhe site), Conditional Use Permit No. 1144 (to establish a drive-in
theater with periodical use as a swap meet facility with waivers) and Variance No. 4158 (waiver of
required lot frontage to establish a 2-lot commerciai/o~ce subdivisic,n) to the Zoning Division.
21. That outdoor lighting for this facility shall be designed and positioned in a manner so as not to
unreasonably illuminate or cause glare onto adjacent or nearby streets, freeways and/or properties.
22. That there shall be no display vehicles for sale or lease permitted (n the landscaped setback ~~eas.
23. That prior to commencement of ihe activity autti~rized by this resolution or within a period of one (1)
year from the date of this resolution, whichevar occurs first, Condition Nos. 1, 2, 3, 4, 5, 8, 10, 12,
13, 16 and 20, above-mentioned, shail be complied with. Extensions for further time to compiete
said conditions may be granted in accordance with Section 18.03.090 of lhe Anaheim Municipal
Code.

25. That prior to comrciencement of the business operation herein approved or prior t~ final building and
zoning inspections, whichever occurs first, Condition Nos. 9, 15 and 19, above-mentioned, shall be
complied with.
26. That approval of this application constitutes approvai of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, reg~lation or requirement.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolution is expressly predicated upon applicanYs compliance
with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof,
be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this
Resolution, and any approvals he~ein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
June 22, 1998.
