PC98-171 A RFSOLU i iUN OF THE ANAHE!M CITY PLANNING COMMISSION REINSTATING At77 APPROVING CONDITIONAL USE P~RMIT NO. 3602, AND AMENDING CEFrN.~N CONDITIONS OF APPROVAL OF RESOLUTION N0. 95-'l43, ADOPTED THEREWITH WHEREAS, on October 30, 1995, Resolution No. 95-143 was adopted by the Anaheim City Planning Commission to approve Conditional Use Permit No. 3802 and permit a pawnshop in an existing commercial shopping center for a period of three years; and that said resoiution includes the following conditions of approval: That the ho~rs of operation shall be limited to 9:00 a.m. to 7:00 p.m., Wlonday through Saturday. That subject use permit shall terminate three (3) years from the date of this resolution, on October 30, 1998. WHEREAS, lhis property is developed with pawr. shop in a 2-unit, 10,020 sq.ft. commercial shopping center in the CL (Commercial, Limited) zone (Eastside Jewplry and Loan at 1500 East Lincoln Avenue); and that the Anaheim General Plan Lav~d Use Element designation is General Commercial; and WHEREAS, the petitioner has requested reinstatement of this use permit, which expired on October 30, 1998, to retain the pawn shop fn the shopping center and to amend or delete Condition No. 1 which limits the hours of operation, under authority of Code Sections 18.03.093, 18.03.091 and 18.03.092 of the Anaheim Municipal Code; and WHEREAS, lhe City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 26, 1998, at 1:30 p.m., notfce of said pubiic hearing having been duly given as required by law and in accordance will~ lhe pruvisions of the Anaheim A4unicipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to fnvestigate and make findings and recommendations in conneclion therewith; and WHEREAS, said Commission, after due inspection, invest(gation and study made by itselF and in its behaif, and after due consideration oF all ~vidence and reports offered at said hearing, does find and determine the following facts: 1. That the use (s properly one for which a conditional use permit is authorized by the Zoning Code. 2. That the proposal, as amended, will not adversely affect the adjoining land uses and the growth and development of the area in which it is located. 3. That the sizp and shape of the site for the proposal, as amended, is adequate to afiow the full development of the use in a manner not detr(mental to the particular area nor to the peace, health, safety and general welfare. 4. That the traffic generated by the proposal, as amended, will not (mpose an undue burden upon the streets and highways designed and improved to ca~ry the traffic in the area. 5. That granting this reinstatement, under the conditfons imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 6. That this use permit is being exercised substantially in the same manner and in conformance with all conditions and slipulations originally approved by the approval body. CR3466PK.DOC .1_ oraa_~~~ 7. That this use permit is beiny exercised in a manner not detrimental to lhe particular area and surrounding land uses, nor to the public peace, fieaith, safety and general welfare. 8. That no one indicated their presence at tho public hea~ing in opposition; and that no correspondence was received in opposition to the subject petition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FiNDING: That the Anaheim City Planning Commission has reviewed the proposal and does hereby find that the Negative Declaration previously approved in connection with Conditional Use Permit No. 3802 is adequate to serve as the reGuired environmental documentation in connection with the request upon findli;g that the declaration reflects the independent Judgment of the lead agency and that it has considered tt;e Negative Declaration together with any comments received during the public review pracess and further finding on the basis of the initiai study and any comments received that there is no substantial evidence inat thc~ project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planr;ing Commission does hereby amend Resolution No. PC95-143, adopted in connection with Conditionai Use Permit No. 3802, to reinstate the pawnshop at in the existing commerciel shopping center, and _ AND BE IT FURTHER RE80LVED that the Planning Commission does hereby amend C~~ ~dition Nos. 1 and 7 to read: That the hours of operation shall be limited tu 9:00 a.m. to 9:00 p.m., seven days per week. That subject use permit shall terrninate on October 30, 2001. AND BE IT FURTHER RESOLVED that the Planning Commission does hereby add the following new condition of approval: 10.
