A RESOLUTION OF THE ANAHEIM CIT i' PLANNING COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 98-99-05 BE GRANTED, UNCONDITIONALLY
VUHEREAS, the Anaheim City Planninp Commissien did receive a verified petition fcr
Reclassification for real property situated in the City of Anaheim, County of Orange, State of California,
described as follows:
THE LAND REFERRED TO IN THIS REPORT IS SITUATED IN THE STATE OF
CAI_IFORNIA, COUNTY OF ORANGE, AND IS DESCRIBEO AS FOLLOWS:
LOT 43 OF TRACT NO. 8463, IN THE CITY OF ANAHEIM, COUNTY OF
ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A SUBDIVISION MAP
RECORDED IN BOOK 392, PAGES 28 THROUGH 31, INCLUSIVE, OF
MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF
SAID ORANGE COUNTY RECORDER.
WHEREAS, the City Planning Commission did ho~d a public hearing at the Civic Center in
the City of Anaheim on November 9, 1998, at 1:30 p.m., notice af said public hearing having been duly
given as requ(red by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, inves8gation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the petitioner proposes reclassification of subject property from the
RS-HS-10,000(SC) (Residential, Single-Family - Scenic Corridor Overlay) zone to the RS-A-43,000 (SC)
(Residential/Agricu~tural - Scenic Corridor Overlay) or a less intense zone.
2. That the Anaheim General Plan designates subject property for Open Space land uses.
3. That the proposed reclassification of subject property is necessary and/or desirable for
the orderly and proper development of the community.
4. That the proposed reclassification of subJect property does properly relate to the zones
and their permitted uses locally established in close proximity to subject property and to the zones and
their permitted uses generally established throughout the community.
5. That five (5) people indicated lheir presence at lh~ public hearing in opposition; and that
correspondence was rer,eived in opposition to subject petition.
CALIFORNIA ENVIRONMENTAL QUAUTY ACT FINOING: That the Anaheim City
Planning Commission has reviewed the proposal to reclassify subject property ~rom the
RS-HS-10,000(SC) (Residential, Single-Family - Scenic Corridor Overlay) zone to the RS-A-43,000 {SC)
(Residentiai/Agricuitural - Scenic Corridor Overlay), or a less (rtense zone, on a irregularly-shaped, 3.05-
acre property having frontage of 545 feet on the south side ofi Canyon Rim Road, a maximum depth of
295 feet, and being located 180 feet west of lhe centerline of Fairmont Boulevard (6900 East Canyon Rim
Road); and does hereby approve the Negative Declaration upon finding that the declaration reflects the
independent judgement of the lead agency and that it has considered the Negative Declaration togelher
with any comments recei•red during the public review process and further finding on tho basis of the initfal
study and any comments received that there (s no substantial evidence that the proJect will have a
significant effect on the environment.

NOW, 7HEREFORE, BE IT RESOLVED that the A~~aheim City Planning Commission
does hereby approve the subJect Petition for Reclassification, uncondiGonally, to authorize an amendment
to the Zoning Map of the Anaheim Municipal Code to exciude the above-described property from the RS-
HS-10,000(SC) (Residential, Single-Fami!y - Scenic Conidor Overlay) Zone and to incorporate sa(d
described property into the RS-A-43,000 (SC) (Residential/Agrlcultural - Scenic Corri~-:.: Overlay) Zone.
BE IT FURTHER RESOLVED, that this resolulion shall not consN•tute a rezoning of, cr a
commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of
the City Council which shail be a legislative act which may be approved or den(ed by the City Council a2
its sole discretion.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
November 9, 1998.
