A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR VARIANCE NO. 4350 BE DENIED
WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for
Va;iance for certain reai property situated in the City of Anaheim, County of Orange, State of Califomia
described as:
THE EAST 190 FEET OF THE WEST 450 FEET OF THE SOUTH 310 FEET
(MEASURED ALONG THE SOUTHERLY AND WESTERLY LINES
PERSPECTIVELY) OF THE SOUTHEAST QUARTER OF SECTION 22,
TOWNSHIP 4 SOUTH, RANGE 10 WEST, S.B.E.M., IN THE CITY OF
ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA.
THE ABOVE DESCRIBED PROPERTY IS ALSO INCLUDED WITHIN THE
AREA SHOWN ON A MAP FILED IN BOOK 36, PF~GE 38 OF RECORD OF
SURVEYS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID
COUNTY.
WHEREAS, the City Planning Commission did hold a publ(c hearing at the Civic Center in
the City of Anaheim on November 9, 1998, at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed variance and to investigate and make
findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the petitioner proposes waiver of the following to permit two hotal identification wall
signs to be located on adjacent building walis (including one existing wall sign on the south side of the
building and one proposed wall sign on the west side of the building):
Sections 18.48.130.060.0601(dl - Permitted wali sians.
and 18.48.130.060.0604 (Maximum 2 hotel identification wall signs permitted on
non-adjacent building elevations in the Anaheim Resort;
two signs on ad acen building elevations proposed)
2. That the requested waiver is hereby denied on the basis that there are no speclal
circumstances or hardships appficable to the property, including size, shape, topography, location or
surroundings, which do not apply to other fdent(cally-zoned properties in the vicinity; and that the granting
of the requested variance would be granting a special privilege to the property not shared by other similar
properties.
3. That the requested variance is not necessary for the preservation and enJoyment of a
substantial property right possessed by other property in the same vicinity and zone, and denied to this
property.
4. ?hat approval of the requested variance will be materially detrimental to the publfc welfare
or i~jurious to the property or improvements in the vicinity and zone in which lhe property is located.
5. That no one indicated their presence at the public hearing fn opposition; and that no
correspondence was received in opposition to thfs petition.

CALIFORNIA ENVIRONMENTAL ~UALITY ACT FINDING: The Pianning Directoror his
authorized representative has determmed that the proposed project falls within the definition of
Categoricai Exempfions, Class-i1, as defined in the State EIR Guideiines and is, therefore, categorically
exempt from the requirement to prepare an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby deny subject Petition for Variance on the basis of thb aforementioned findings.
THE FOREGOING RESOLUTION was adopted at the pianning Commisslon meeting of
November 9, 1998.
