Resolution-PC 98-186RESOLUTION NO. PC98-186 A RESOLUTION OF THE ANAHEIM CITY PLANN(NG COMMISSION AMENDING RESOLUTION NO. PC86-31, AS AMENDED BY RESOLUTION NOS. PC86-63, PC86-118 AND PC87-168, AND ADOPTED IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 275Q WHEREAS, on January 20, 1986, the City Planning Commission adopted Resoh~tion No. PC86-31 to grant Conditional Use Permii No. 2750 and permit a 42-foot high, 183-unit matel with waivers of required site screening, maximum structural height, minimum structural setback and minimum landscaped setback on property located at 211 North Via Cortez; and that said resolution was subsequently amended in connection with Resolution Nos. PC66-63, PC86-118 and PC87-168 to amend the legal description, to approve revised plans and to amend the conditions of approval in their entirety; and WHEREAS, this property is developed with the Hanford Hotei in the CL(SC) (Commercial Limited - Scenic Corridor Overlay) Zone; and WHEREAS, the petitioner has requested that this use permit be amended to allow complimentary service of alcoholic beverages in meeting rooms at this motel; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on Nov~mber 23, 9998 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposal; and to investigate and make findings and recommendations in connection therewith. WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of al~ evidence and reports offered at said hea:~:ng, does find and determine the following facts: 1. That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.44.050.010 to ailow the complimentary service of alcoholic beverages in meeting rooms within an existing motel. 2. That the proposed use, as approved for two years, will not adversely affect the adjofning land uses and the growth and deveiopment of the area in which it is proposed to be located because the complimentary service of alcoholic beverages for on-premises consumption will be integrated with the services of the motel; and that alcoholic beverages will not be sold to the general public. 3. Thet because there will be no new construction and the proposed use will be a part of the existing operation, the size and shape of the site is adequate to allow full development of the proposal in a manner not detrimental to the particular area nor to tf~e peace, health, safety and general welfare of the citizens of Anaheim. 4. That no one indicated their presence at the public hearing in opposition to this proposal; and that no correspondence was received in opposition. CALIFOP,tv7*~ cNVIRONMENTAL QUALITY ACT FINDING That the Anaheim City Planning Commission has reviewed the proposal to allow the complimentary service of alcoholic beverages in meeting rooms within an existing hotel I~cated on an irregularly-shaped, 2.81-acre property having a frontage of 120 feet on the west side of Via Cortez, a maximum depth of 608 feet and being located 930 feet north of the centerline af Santa Ana Canyon Road, and fu~ther described as 201 North Via Cortez (Hanford Hotel); and does hereby approve the Negative Declaration upon finding that the declaration reflects the independentjudgement of the lead agency and that it has considered the Negative CR3486PK.DOC -1- PC98-186 Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Resolution No. PC86-31, as amended by Resoiution Nos. PC86-63, PC86-118 and PC87-168 and adopted in connection with Conditiona( Use Permit No. 2620, to permitthe compiimentary service of alcoholic beverages in meeting rooms within an existing motel underauthority of Anaheim Municipal Code Section 18.44.050.010 for a period of hvo (2) years, to expire November 23, 2000; and BE IT FURTHER RESULVED that ihe following new conditions are added thereto: 19. That the three (3) un-permitted omni-antennas and related accessory equipment shall be removed unless all Code required permits and approvals are granted to retain the same. 20. That if the outdoor patio adjacent to the meeting rooms is used as an area of service for, or consumption of, alcoholic beverages, the patio shall be modified to include perimeter fencing and any other improvements required by the Department of Alcoholic Beverage Control (ABC). 21. That the complimentar~ service of alcohol shall be limited to motel guests and participants of motel events. 22. That permanent bar facilities and sale~ to the genera! public shall not be permitted. 23. That there shall be no cover charge or admittance fee for the service of complimentary alcoholic beverages. 24. That the complimentary service of alcoholic beverages shall only be permitted in the meeting rooms located in Bui~dings B and C, the lobby, and the patio area of Buiiding B, as shown on approved Exhibit No. 6 of this Conditional Use Permit No. 2750. 25. That the complimentary service of alcoholic beverages in meeting rooms shall expire two (2) years from the date of this resolution, on November 23, 2000. 26. That the complimentary service of alcoholic beverages in meeting rooms shall be limited to that which was indicated by tfie petitioner and stipulated to in the Staff Report to the Planning Commission dated November 23, 1998, item No. 6, and in the letter oE operation attached to said staff report, all of which are on file with the Planning Department. 27. That within a period of one (1) month from the date of this resolution, Condition No. 19, above- mentioned, shail be completed. 28. That the proposed complimentary service of alcoholic beverages ~&i,~ll be conducted substantially fn accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Exhibit No. 6, and as conditioned herein. 29. That prior to commencement of lhe activity authorized by this resolu8on or within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 20 and 28, above mentioned, shall be complied with. Extensions for further tlme to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipai Code. 30. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim A4unfcipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. -2- PC98-186 BE IT FURTHER RESOWEQ that the Anaheim City PlannEng Commission does hereby find and determ!ne t~hat adoption of this Resolution is exRressly predicated upon appiicant's compliance with each and all of the conditions hereinabove set forth.
