A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 3999 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for
Cc~ditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State
of California, described as:

1'~`: ~: REAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of ~naheim r.•n February 2, 1998 at 1:30 p.m., notice of said public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use permit and to investiyate and
make findings and rscommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by itself
and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the following facts:
1. That the proposed use is properly one for which a conditionai use permit is
authorized by Anaheim Municipal Code Section 18.61.050.433 to construct a 161,800 sq. ft., one- and
two-story, self-storage facility, including an existing 50,000 sq. ft. warehouse building and rvaiver of the
foilowing:

2. That the parking waiver, under the conditions imposed, will not cause fewer off-
street parking spaces to be provided for such use than the number of such spaces necessary to
accommodate all vehicies attributable to such use under the normal and reasonably foreseeable
conditions of operation of such use because the petitioner submitted a parking letter indicating that the
typical parking demand for off-street parking on the existing site is never more than the number of spaces
{43) available on the site; and that the parking letter indicates there is ample parking and a surplus of
spaces will always be provided even during peak hours since customer visits primarily involve a brief
amount of time loading and unloading only;
3. That the waiver, under the conditions imposed, will not increase the demand and
competition for parking spaces upon the pubiic streets in the immediate vicinity of the proposed use
because more than adequate on-site parking is available to accommodate the projecYs peak parking
demands:
4. That ti~e waiver, under the conditions imposed, wiq not increase the demand and
competition for parking spaces upon adjecent private property in the immediate vicinity of the proposed
use (which property is not expressly provided as parking for such use under an agreement in compliance
with Section 18.06.010.020 of this Code);
5. That the waiver, under the conditions imposed, will not increase tra~c congestion
within the off-street parking areas or lots provided for such use because the supply of on-site parking is
greater than the anticipated peak demand;
6. That the waiver, under the conditions imposed, will not impede vehicular ingrESS to
or egress from adjacent properties upon the public streets in the immediate vicinity of the proposed use
because existing lines-of-sight and turning area(s) for the project driv~way on Lincoln Avenue are
unaffected by this proposal;
7. That the proposed use is properly ane for which a conditional use permit is
authorized by the Zoning Code;
8. That the proposed use will not adversely affect the adjoining larid uses and the
growth and development of the area in which it is proposed to be located;
9. That the size and shape of the site for the proposed use is adequ2te to allow the full
development of the proposal in a manner not detrimental to the particular area nor to the peace, health,
safety and general welfare;
10. That the traffic generated by the proposed use will not impose an undue burden
upon the streets and highways designed and improved to carry the traffic in the area;
11. That granting of this conditional use permit, under the conditions imposed, wi~l i~ot
be detrimental to the peace, health, safety and general welfare of the ~itizens of the City of Anaheim; and
12. That no one indicated their presence at said public hearing in opposition; and that no
correspondence was received in opposition to the subject petition.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDiNG: That the Anaheim City
Planning Commission has reviewed the proposai to constn~ct a 161,800 sq. ft., one- and two-story, self-
storage faciliry, including an existing 50,000 sq. ft. warehouse building and waiver of minimum number of
parking spaces on a 3.7-acre rectangulariy-shaped properiy having frontage of 345 feet on the north side
of La Palma Avenue, a maximum depth of 450 feet, and being located 980 feet west of the centerline of
Gilbert Street (2475 West La Paima Avenue) and does hereby approve the Negative Declaration upon
finding that the declaration reflects the independent judgment of the lead agency and that it has
considered the Negative Declaration together with any comments received during the public review
process and further finding on the basis of the initial study and any comments received that there is no
substantial evidence that the project will have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are
hereby found to be a necessary prerequisite to the proposed use of the subject property in order to
preserve the safety and general vrelfare of the Citizens of the City of Anaheim:
That all storage activities shall be confined wholly inside the buildings. At no time shall outdoor
storage of material or vehicles, including boats, trailers or recreational type vehicles, be permitted,
except for the loading and unloading of materials.
2. (a) That the mature Eucalyptus, Sycamore, Palm and Pine trees in the planters adjacent to
La Palma Avenue and at the south end of the existing warehouse building shall be
retained;
(c) That six (6) additional broad-headed trees and a minimum three (3) foot high hedge with
iandscaping to screen the above-ground backflow device shall be installed in the required
setback area adjacent to La Palma Avenue; and
(c) That said landscaping shall be specified on the plans submitted for building permits.
3. That all existing chain link fencing in the front setback shall be removed.
4. That minimum one (1) gallon sized vines on maximum three (3) foot centers shall be planted,
irrigated and maintained adjacent to the trash enclosure walls. These landscaping specifications
shall be shown on plans submitted for building permits.
5. (a) That the existing freestanding sign shall be removed;
b) That all proposed signs for this facility shall be limited to that which is shown on the
exhibits submitted by the petitioner and approved by the Planning Commission, and as
conditioned herein, including that any proposed signs shall be subject to the review and
approval of the City Tra~c and Transportation Manager to determine adequate lines-of-
sight;
c) 'fhat signs shall comply with Code requirements in effect at the time of application for sign
permits unless a variance is approved by the Planning Commission or City Council; and
d) That any additional signs shall be subject to the review and approval of the Planning
Commission as a Reports and RecommendaYions item.
6. (Proposed Condition No. 6 was deleted at the Plann/ng Commission public hearing.)
That the owner of subject property shall be responsible for the removal of any on-site graffiti withfn
twenty four (24) hours af its application.

8. That any ra~f-mounted equ~pment shall be subject to Anaheim Municipal Code Section
18.61.030.100 (pertaining to roof-mounted mechanical/utility equiFment). Such information shall
be specificaliy shown on the plans submitted for building permits.
9. That a valid business li,sr,se shall be obtained from the C(ty Business License Division of the
Finance Department.
10. That, as stipulated to by the petitioner, the hours of operation shall be limited to 7 a.m. to 7 p.m.
daily; and that the maximum number of employees shall be eight (8), including 2 managers.
11. That the entry gate and/or any fencing proposed in the front setback shall be wrought iron or a
comparable material. Said information shall be specifically shown on pians submitted for building
permits.
12. That no required parking area shall be fenced or otherwise enclosed for storage or other outdoor
uses.
13. That the sewer capacity mitigation fee for the Anaheim Plaza Area shall be paid to the City of
Anaheim Public Works Department. The current fee is three hundred thi; ty six dollars and twenty
eight cents ($336.28) per one thousand (1,000) sq. ft. of building area.
14. That trash st~rage area(s) shall be provided and maintained in location(s) acceptable to the Public
Works Department, Streets and Sanitation Division, and in accordance with approved plans on file
with said Department. Such information shali be specifically shown on tha plans submitted for
building permits.
15. That a plan sheet for solid waste storage and collection and a plan for recycling shall be submitted
to the Public Works Department, Streets and Sanitation Division, for review and approval.
16. That an on-site trash truck turn-around area shall be provided in accordance with Engineering
Standard Detail No. 610 and maintained to the satisfaction of the Public Works Department,
Streets and Sanitation Division. Said iurn-around area shall be specifically shown on plans
submitted for building permits.
17. l:hat gates shall not be installed across any driveway or street in a manner which may adversely
affect vehicular traffic in the adjacent public street. Installation of any gates shall conform to
Engineering Standard Plan No. 609 and shall be subject to the review and approva; of khe City
Traffic and Transportation Manager.
18. That plans shall be submitted to the City Traffic and Transportation Manager for review and
approv:il showi~g conformance with the most current versions of Engineering Standard Plan Nos.
436 and 602 pertaining to park(ng standards and driveway locations. Subject property shall
thereupon be deveioped and maintained in conformance with said plans.
19. That all driveways shall be constructed with ten (10) foot radius curb returns as required by the
City Engineer and in conformance with Engineering Standard No. 137.
20. That lighting fixtures shall be down-lighted (n such a manner that these fixtures illuminate only the
subject site. This information shall be specifically shown on plans submitted for building permits.
21. That subject property shall be developed substantialiy in accordance with pians and specificatlons
submitted to tlie City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1, 2, 3 and 4, and as conditioned herein.

22. That prior to he issuance of a building permit or within a period of one (1) year from the date of
this resolution, whichever occurs first, Condition Nos. 2, 4, 8, 11, 13, 14, 15, 16, 18, 20 and 27,
herein-mentioned, shall be complied with. Extensions for further time to complete said conditions
may be granted in accordance with Section 18.03.090 of the Anaheim Niunicipal Code.
23. That prior to the commencement of lhis business activity, Condition No. 9, above-mentioned, shall
be complied with.
24. That prior to final building and zoning inspections, Condition Nos. 3, 19 and 21, above-mentioned,
shall be complied with.
25. That approval of this application constitutes approval of the proposed request only ta the exfent
that it complies witl~ the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or
approval of the request regarding any other applicable ordinance, regulation or requirement.
26. That prior to construction of any signs, fina! sign plans shall be submitted te the Zoning Division of
the Planning Department for review and approval by the Planning Commission as a"Reports and
Recommendations" item.
27. That the owner of the subject property ~hall submit a letter requesting termination of
Administrative Adjustment No. 30 (waiver of minimum number of parking spaces to construct an
industrial building) to the Zoning Division.
BE iT FURTHER RESOLVED that the Anaheim City Rlanning Commission does hereby
find and determine that adoption of this Resolution is expressiy predicated upon applicanY;, compliance
with each ~nd all of the conditions hereinabove set forth. Should any such condition, or any part thereof,
be deciared invalid or wienforceable by the final judgment of any court of competent jurisdiction, then this
Resolution, and any approvals herein contained, shali be de2med null and void.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
February 2, 1998.
