A RESOLUTION OF THE ANAHEIM CITY PlANNIPJG COMMiSSION
THAT PETITION FOR RECLASSIFIGATION NO. 97-98-14 BE GRANTED
WHEREAS, the Anaheim City Planning Commission did receive a verified petition foi
Reclassification for +eal property situated in the City of Anaheim, County of Orange, State of California,
described in "Attachment A," a location map showing said property and the two portions thereof; and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on March 30, 1998 at 1:30 p.m., notic<: of said public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed reclassification and to investigate and make
findings and recommendations in connection therewith; and that said hearing was continued from the
meetings of March 2 and March 16, 1998; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does
find and determine the following facts:
1. That this is a City-initiated proposal to rezone two parceis, one of which (Portion A) is located in the
County of Orange and the other (Portion B) is located in the City of Anaheim, and that reciassification is
proposed to take place in two phases, as follows:
(a) Portion A(County of Orange M1 {FP-2) "Light ivlanufacturing - Flood Plain Overlay" Zone)
shall be reclassified, unconditionally, to the City of Anaheim RS-A-43,000(FP)
"Residential/Agricultural - Flaodpfain Overlay" Zone; and
(b) Portions A and B{County of Orange M1 (FP-2) "Light Manufacturing - Flood Plain Overiay"
Zane and City of Anaheim ML(FP) "Limited Industrial - Floodplain Overlay" Zone) shall both
be reclassified to the City of Anaheim PR(FP) "Public Recreation - Floodplain Overlay" Zone
following annexation of Parcel A to the City of Anaheim.
2. That the reason for reclassi(ying subject property in two phases is that Portion A will be pre-zoned to
the RS-A-43,000(FP) Zone prior to annexation of the underlying property to the City of Anaheim, and that
following annexation both Portions A and 6 will be recla~sified to the PR(FP) Zone.
3. That the Anaheim General Plan designates subject property for business office/service/industrial
land uses.
4. That the proposed reclassification of subject property is necessary and/or desirable for the orderly
and proper development of the community.
5. That the proposed reclassification of subject prope~ty does properly relate to the zones and their
permitted uses locally established in close proximity to subject property and ta the zones and their
permitted uses generally established throuyhout the community.
6. That no one indicated their presence at said public hearing in opposition; and thet no
correspondence was received in opposition to subject petition.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed tiia proposal to reclassl(y subject property in two ph2ses, as follows:
prior 4o annezation, Portion A(County of Orange M1 (FP-2) "Light Manufacturing - Flood Plain Overlay"
Zone) to the City of Anahc;m RS-A-43,000(FP) "Residential/Agricultural - Fioodplain Overlay" Zone; and
foilowing annexatien, both Portions A and B(County of Orange M1 (FP-2) "Light Manufacturing - Flood
Plain Overlay" Zone and City of Anaheim ML(FP} "Limited Industrial - Floodplain Overlay" Zone) to the
PR(FP) "Public Recreation - Floodplain Overlay" Zone; that the property consists of two irregularly-
shaped parceis totaling approximately 16.6 acres located on the south side of Kalella Avenue between
Douglass Road and the Santa Ana River, having approximate frontages of 385 feet on the south side of
Katella Avenue and 755 feet on the east side of 6ouglass Road, and further described as 2630 through
2650 East Katella Avenue (County of Orange Katella Yard); and does hereby approve the Negative
Declaration upon finding thal the declaration reflects the independent judgement of the lead agency and
that it has considered the Negative Declaration together with any comments received during the public
review process and further finding on the basis of the initiai study and any comments received that there is
no substantiai evidencP that the project wili have a sig~ iificant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby approve the first phase of subject petition for recla~sification (Reclassification No. 97-98-
14(1)) to authorize an amendment to the Zoning Map of the Aneheim Municipal Code to exclude the
above-described Portion A from the County of Orange M1 (FP-2) "Light M~nufacturing - Flood Plain
Overlay" Zone and to incorporate said described Portion A, unconditionally, into the City of Anaheim RS-
A-43,000(FP) "Residential/Agricultural - Floodplain Overlay" Zone; and
BE fT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
approve the second phas~ of subject petition for reclassification (Reclassification No. 97-98-14(2}) to
authorize an amendment to tha Zoning Map of the Anaheim Municip2l Code to exclude the
above-~escribed Portions A and B from the County of Orange M1 (FP-2) "Light P,Aanufacturing - Flood
Plain Overlay" Zone and the City of Anaheim ML(FP) "Limited Industrial - Flaodplain Overlay" Zone, and to
incorporate said described properties into the Cit;/ of Anaheim PR(FP) "Public Recreation - Floodplain
dverlay" Zone upon the following conditions which are hereby found to be a necessary prerequisite to the
proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the
City of Anaheim:
'fhat prior to introduction of an ordinance rezoning both Portion A and Portion B of subject
property to the PR(FP) "Public Recreation - Floodplain Overlay" Zone under Reclassification No.
97-98(2), a copy of the certificate of completion finalizing the annexation of Portion A to the City of
Anaheim shall be submitted to the Planning Department.
That approval of this reclassification constitutes approvai of the propoaed request only ta •the
extend that it complies with the Anaheim Municipal Zoning Code and any ~lher applicabie City,
State Federal regulations. Approval does not include any action or findings as the compliance or
approval of the request regarding an other applicable ordinance, regulation, or requirements.
BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a
commitment by the Ciry to rezone, the subJect property; any such rezoning shall require an ordinance af
the City Council which shall be a legislative act which may be approved or denied by the City Council at its
soie discretion.
