PC98-53 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICA710N N0.97-98-09 BE GRANTED, UNCONDITIONALLY WHEREAS, the Anaheim City Planning Comm(ssion did receive a verified petition for Reciassification for real property situated in the City of Anaheim, County of Orange, State of California, described as follows: LOTS 3 AND 4 IN BLOCK A OF TRACT N0. 13, AS SHOWN ON A MAP RECORDED IN BOOK 9, PAGE 12 OF MIS~ELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNiA. EXCEPTING THEREFROM THE NORTIi 216.00 FEET OF THE WEST 404.62 FEET, SAID DISTANCE BEING MEASURED TO THE CENTER LINE OF THE STREETS ADJOINING ON THE NORTH AND ON THE WEST. ALSO EXCEPTING THEREFROM THE NORTH 66.00 FEET OF SAID LOT 3, AS DESCRIBED IN DEED TO THE STATE OF CALIFORNIA RECORDED FEBRUARY 4, 1958 IN BOOK 4185, PAGE 76 OF OFFICIAL RECORDS OF SAID ORANGE COUNTY. WHEREAS, the City Planning Commission did hold a public hearing at the Civic Csnter in the City of Anaheim on April 13, 1998 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and that the public hearing w2s continued from the meetings of February 18, March 2, March 16 and March 30, 1998; and WHEREAS, said Commission, after due inspection, investigation and stu~iy made by itself and in its behalf, and after due conside~ation of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes reclassification of subject property from the CL (C~mmercial, Limited) zone to the RM-3000 (Residential, Multiple-Family) zone. 2. That the Planning Commission has recommended approval of Anaheim General Plan Amendment No. 352 to City Council to amend the Land Use Element and redesignate this property Low- Medium Densiry Residential; and that the proposed RM-3000 zoning will implement said land use designation. 3. That the prcposed reclassification of subject property is necessary and/or desirable for the orderly and ~.~roper development of the community. 4. Tha~` the prop~sed reclassification of subject property does properly relate to the zones and their permitted i~ses locally established in close proximity to subject property and to the zones and thefr permitted use:, generally established throughout the community. 5. That one concerned person spoke at the public hearing; and thal no correspondence was received in opposition to subject petition. CR3249PL -1- PC91i-53 CALiFORPlIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposai to reclassify subject property from the CL (Commercial, Limited) Zone to the RM-3000 (Residential, Multiple-Famiiy) or a less intense zone on a 6.25-acre parcei, having frontage of 450 feet on the east side of Brookhurst Street wikh maximum deplh of 605 feet, and being located 216 feet south of the centerline of Lincoln Avenue (112-218 South Brookhurst Street); and does hereby approve the Negative Declaration upon finding that the declaration reflects "he independent judgement of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planring Commission does hereby approve the subject Peti!ion for Reclassification, unconditionaliy, to incorporate said described property into the RM-3000 (Residential, Multipie-Family) Zone. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council which shall be a legislative act which may be approved or denied by lhe City Council at its sole discretion.
