PC98-69 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION DENYING GENERAL PLAN AMENDMENT NO. 354 PERTAINING TO THE LAND US~ ELEMENT WHEREAS, the City Council of the City of Anaheim did adopt the Anaheim General Plan by Resolution No. 69R-644, showing the gereral description ard extent of possible future development within the City; and WHEREAS, the Anaheim City Planning Commission did receive a request for amendment io the General Plan and directed staff to initiate said amendment to the Land Use Element of the General Plan to redesignate the subject property from the current Hillside Low-Medium Density Residential land use desi~nation to the Hillside Medium Density Residential land use designation; and WHEREAS, the Analieim City Planning Commission did hold a public hearing at the Anaheim Civic Center, Council Chamber, 200 South Anaheim Boulevard, on April 27, 1998, at 1:30 p.m., notice of said public hearing having been duly given as requi~ed by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan Amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due consideration, inspection, investigation and study made by itself, and after due consideration of all evidence and reports offered at said hearing, DOES HEREBY FIND: 1. That adjacent and nearby residential neighborhoods to the north, northeast and west have a land use c+esignation of Hillside Low-Medium Uensity Residential and are develop~d with Lo~v Density Residentiai single family homes. 2. That the subject property is "landlocked" in that it has no direct access +o any adjoining arterial highway or other public street and, as such, is not developable without first obtaining a single family residential lot(s) and home(s) on Addington Drive to provide vehicle access; and that the adjacent residential subdivisions were developed with a coordinated public street system that did not meke provision for a development such as is being proposed and which would funnel traffic through a single ingress and egress point; and that the proposal wouid, therefore, have adverse impacts on existing residences in the area, particularly those adjoining the subject property and those fronting on the streets which would connect !he project to Riverdale Avenue. 3. That the subject property, which was part of the original SR 91/Riverside Freeway right- of-way acquisition, serves as a buffer between the single family l~omes along Addington f7rive and the freeway. 4. TF~at evidence of the property's unsuitability for residential development is reflected in the sound attenuation measures which would be required to comply with Anaheim Council Policy No. 542 pertaining to Sound Attenuation In Residential Projects. 5. That development of the subject property could encourage simile,r applications for development of marginal residential projects on other freeway properties determined to be surplus by Caltrans. 6. That the evidence presented does not substantiate the ne~.d for an amerdment to the Anaheim Gene~al Plan. • 7. That approxiately 26 persons indicated their presence at the public hearing in opposition and five of them spoke in opposition t~ the proposal; that correspondence was received in opposition; and that a petition containing ai prox?mately 400 signatures was received in opposition. CR3272PL.DOC -1- PC98-69 CALIFORNIA ENVIRONMENTAL QUALI7Y ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend the Land Use Element of the General Plan to change the current land use designation from Hillside Low-Medium Density Residential to Hillside Medium Density Residential on a 10.5-acre parcel having frontages of 260 feet on the ~outh side oF Riverdale Avenue, 43 feet on the west side of Addington Drive east of the terminus of Bainbridge Avenue and 45 feat on the west side of Addington Drive between Pageant Street and Redrock Strep:, having a maximum length of 2,290 feet and being located 70 feet south of the centerline of Bainbridge Avenue (4000 East Riverdale Avenue); and does hereby deny the Negative Deciaration upon finding that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does deny General Plan Amendment No. 354 periaining to the Land Use Element.
