A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISS90N
TFiAT PETITION FOR RECLASSIFICATION NO. 97-98-13 BE D~NIED
WHEREAS, the Anaheim City Planning Commission did receive a verified petition for
Reclassification for certain real property situated in the City of Anaheim, County of Orange, State of
California, and described in Attachment "A"; and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on April 27, 1998, at 1:30 p.m., notice of said public hearing having been duly given as
required by Iaw and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evide~ce for and against said proposed reclassification and to investigate and make
findings and recommendations in connection therewith; and that said public hearing was continued from the
March 16, 1998 Planning Commission meeting; and
WNEREAS, said Commission, after due inspect~on, investigation and study made by itself
and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the follovving facts:
1. That the petitioner proposes reclassification of subject property from the RS-A-43,000(SC)
(Residential/Agriculture - Scenic Corridor Overlay) zone and RS-5000(SC) (Residential, Single-Family -
Scenic Corridor Overlay) zones to the RM-3000(SC) (Residential, Multiple-Famity - Scenic Corridor
Overlay).
2. That the Anaheim General Plan designates subject property for Hiilside Low-Medium
Density Residential land uses; and that General Plan Amendment No. 354, filed concurrently with this
reclassification to amend the Land Use Element to Hillside Medium Density Residential, was denied by the
Planning Commission.
3. That the proposed reclassification of subject property is ~ot necessary nor desirable for
tiie orderly and proper development of the community; and that the proposEd reclassification does not
implement the existing Anaheim General Plan land use designation.
4. That the proposed reclassification of subject property does not properly relate to the zones
and their permitted uses locally established in close proximity to subject property and to the zones and their
permitted uses generaliy established throughout the community.
5. That approximately 26 persons indicated their presence at the public hearing in opposition
and five of them spoke in opposition to the proposal; that correspondence was received in opposition; and
that a petition containing approximately 400 signatures was received in opposition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to reclassify subject property from the RS-A-43,000(SC)
(Residential/Agriculture - Scenic Corridor Overlay) zone and RS-5000(SC) (Residential, Single-Family;
Scenic Corridor Overlay) zone to the RM-3000(SC) (Residential, Multiple-Family - Scenic Corridor
Overlay} zone on a 10.5-acre parcel having frontages of 260 feet on the south side of Riverdale Avenue,
43 feet on the west side of Addington Drive east of the terminus of Bainbridge Avenue and g5 feet on the
west side of Addington Drive between Pageant Street and Redrock Street, having a maximum length of
2,290 feet, and being located 70 feet south of the centerline of Bainbridge Avenue (4000 East Riverdale
Avenue); and does hereby deny the Negative Declaration upon finding that the declaration reFlects the
independent judgement of the lead agency and that it has considered the Negative Qeclaration together with
any comments received during the public review process and further finding on the basis of the initial study
and any comments received that there is substantial evidence that the project will have a significant effect on
the environment.

NOW, THEREFORE, BE IT RESOWED that the Anaheim City Planning Commission does
hereby deny Petition for Reclassification on Uie basis af the aforementioned findings.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
April 27, 1998.
