PC98-96 A RE°' ~.UTION OF THE ANAHEIM CITY PLANNING COMMISSION RECOMMENDINC :=.~ tENDMENT TO CHAPTER 18.74 OF THE ANAHEIM MUNI~IPAL CODE PERTAINIiVG TO SPECIFIC PLAN NO. 90-1 (AMENDMEN i NO. 3 TO THE ANAHEIM HILLS FF_STIVAL S1~ECIFIC PLAN) WIIEREAS, on March 27, i990, the Anaheim City Councii adopted an ordinance ta arnend the Anaheim Municipal Code by adding a new Chapter 18.74 to establish Zoning and Developm2nt Standards for the Anaheim Hills Festival Specific Plan No. 90-1 ("SP 90-1"); and that City Council subsequently adopted two amendments thereto (Amendment Nos. 1 and 2); and WHEREAS, SP 90-1 currently permits approximately 533,950 sq. ft. of retail space, a 4,000 sq. ft. service station, a 3?,U00 sq. ft. theater, a 150-room hotel with a 7,500 sq. ft. freesianding restaurant and a 240,000 sq. ft. business commercial area in four Development Areas (nos. 1, 2, 3 and 4) on 85 acres; and that the current Master Site Plan for Development Area 4 specifies 240,000 sq. ft. of o~ce area; and WHEREAS, Subsection (b) of Section 18.74.040.060 of Chapfer 18.74, pertaining to Conditional Uses in Development Area 4(Business Commercial Development Area), currertly reads: "(b) Conditional Uses. The following uses and substantially similar uscs shall be permitted with a conditional use permit: 1. Community recreational facilities:' WHEREAS, the petitioner reGuests Amendment No. 3 to SP 90-1 in order to permit senior ci;izens' apartments in Development Area 4 in connection with approval of a cenditional use permit; and WHEREAS, the following deveiopment standards are recommended for senior citizens' housing in Development Area 4 of SP 90-1: MINIMUM LOTAREA: MINIMUM LOTAREA/DWELLING UNIT: MINIMUM FLOOR AREA. DWELLING UNIT: A4AXIMUM BUILDING HEIGHT: MAXIMUM LOT COVERAGE: A4INIMUM STRUCTURAL SETBACK: 17.1 acres (`.e., entire DevelopmentArea 4) 2,875 sq. ft. per dwelling unit (maximum density = 15.2 dwelling units/acre) One bedroom unit: 700 sq. ft. Two bedroom unit: 875 sq. ft. 35 feet (3 stories), with no roof mounted equipment permitted 10% of the building site Along Festival Drive: 50 feet From Single-family ~esidential zone boundaries: 90 feet Between buildings: 20 feet From Develapment Area 3 (Visitor Commercial Development Area) boundary line: SO feet MINIMUM WIDTH OF PEDESTRIAN WALKWAYS: CR°336PL.DOC 5 feet -~ - PC98-96 NiiNIMUM F2ECREATION/LEISURE AREA: 750 sq, ft./ dwelling unit, with minimum 4,000 sq. ft. of indoor recreation room area MINIMUM RATIO OF AFFORDABLE UNITS: 50% of the total number of developed dwelling unifs, with 20% of the dwelling units designated at 50% of the Adjusted A4edian Income, snd the remaining 30% of the dwelling units designated at 60% of the Adjusted Median Income PERMITTED IDENTIFICATION 3IGNAGE: Maximum three 20 sq. ft. monumert signs for the two main entrance driveways WHEREAS, the City Planning Commission did hold a public hearing at ihe Civic Center in the City of Anaheim on June 22, 1998, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions oP the Anaheirn Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and that said hearin~ was continued from the meeting of June 8, 1998, for preparation of development standards for senior r,itizens' apartment projects; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed amendment to SP 9U-1, to conditionally permit senior citizens' apartment projects in Development Area 4(Business Commercial Development Area) of The Anaheim Hills Festival Specific Plan, is similar to existing Z~ning Code standards which conditionally permit senior citizens' apartments elsewhere in comparable commercial zones; and, therefore, the proposal is analogous to a commercial use and is consistent with the listed permitted and conditionally permitted commercial uses in SP 90-1. 2. That the property proposed for Amendment (Vo. 3 to The Anaheim Hills Specific Plan has unique site characteristics such as topography, location or surroundinc~s which are enhanced by special land use and development standards. 3. That Amendment No. 3 is consistent with the goals and policies of the Anaheim General Plan and with the purposes, standards and land use guidelines therein. 4. That Amendment No. 3 results in deveiopment of desirable character which will be compatibie with existing and proposed development in tiie surrounding neighborhood. 5. That Amendment No. 3 contributes to a balance of iand uses. 6. That Amendment No. 3 respects environrr,ental and aesthetic resourcas consistent with economic realities. 7. That, as noted in Attachment No. 1 to Item No. 2 of the Staff Report to the Planning Commission dated June 22, 1998, some of the recommended development for senior citizer~~ housing will replace existing stan~ards found elsewhere in the Zoning Code. 8. That no one indicated their presence at itie public hearing in opposition to the proposal; and that no corrESpondence was received iii opposition to the subject proposal. "Z" PC98-96 ~~ CALIFORNIA ENVIRONMENTAL C~UALITY ACT FINDING: That th2 Anaheim City Planning Commission has reviewed the proposai ta amend Chapter 18.74 of the Anaheim Municipal Code (the Zoning and Development Standards which impiement SP 90-1), also identified as Amendment No. 3 to SP90-1, to conditionally permit senior citizens' apartment projects in Development Area 4(Business Commercial Development Area) of SP 90-1; and does hereby determine that previously-certified EIR No. 300 is adequate to serve as the required environmental documentation for subject request. NOW, THERF_FORE, BE IT RESOLVED that the Anaheim City ~lanning Commission does hereby amend Subsection .060 of Section 18.74.040 of Chapter 18.74, in its entirety, to read as follows: .060 Development Area 4 - Business Commercisl L'avelopment Area. Development Area 4 is designed to accommodate office uses including conference and convention centers together with retail and food service uses, or to provide for the development of senior citizens' apartment housing. In addition to the applicable non- conflicting portions of Section IV-D-2 of the Anaheim Hills Final Specific Plan docment and the Zoning Code, the following regulations shall govern this area: (a) Permitted Uses. In addition to the uses permitted in Section IV-D-2, the following uses and substantially similar uses shall be permitted in Development Area 4: Conference and Convention Centers. Corporate Headquarters. (b) Conditional Uses. The following uses and substantially similar uses shall be permitted with a conditional use permit: Community Recreation Facilities Senior Citizens' Housing, subject to all of the restrictions and regulations of Chapter 18.32 (RM-2400 Residential Multiple- Family) and Chapter 18.98 (Criteria and Standards for Senior Citizens' Apartment Projects) except as provided beiow: (i) Minimum lot area shall be 17.1 acres (i.e., the entire Development Area 4 sitc-). (ii) Minimum lot area per dwelling unit shall be two thousand eight hundred sevFnty five (2,875) square feet per dwelling unit fo~ a maximum density of fifteen and two tenths (15.2) dwelling units per acre. (iii) Min~mum floor area per dwelling unit shall be: One (1) bedroom unit: seven hundred (700} square feet. Two (2) bedroom unit: eight hundred seventy five (875) square feet. (iv} Maximum building height shall be thirty five (35) feet or three (3) stories), whictiever is less, with~...no roof mounted equipment being permitted. " -3- PC98-~;, (~) Maximum fot coverage shall be limited to ten percent (10%) of the building site. (vi) Minimum structural setbacks shall be: Fifty (50) feet from Festival Drive. Ninety (90) feet from abutting single-famiiy residential zone boundaries. Twenty (20) feet between separate buildings. Eighty (80) feet from Development Area 3 boundaries. (vii) Minimum width of pedestrian walkways shall be five (a) feet. (viii) Minimum recreational/leisure area shall be seven hundred fifty (75U) square feet per dwe;ling unit, with a minimum four thousand (4,000) square feet of fndoor recreation room area being provided. (ix) Required affordable units shall be a minimum of forty nine (50%) of the total number of developed dwelling units, with twenty percent (20%) of the dwelling units designated at fifty percent (50%) of the Adjusted Median Income and the remaining thirfy percent (3Q%) of the dwelling units designated at sixty percent (60%) of the Adjusted Median Income. (x) Permitted identification signage for tho complex shall be limited to a total of three (3), twenty (20) square feet each mon~ment signs for the two (2) main entrance ~riveways. (c} Bultd~ng Height. The maximum building height shall be forty five (45) feet ur three (3) stories, whichever is less, exc;uding architectural projections and properly screened roof-mounted equipment which may extend up to five (5) feet, for a total of fifty (50) feet. (d) improvement oF Setbacks. A minimum landscaped area of ten (10) feet shall be provided along Festivai Drive.
