A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING RESOLUTION NO. PC90-19
ADOPTED IN CONNECTION WITH CONDITIONAL USE PEaMIT NO. 3239
WHEREAS, on January 15, 1990, Resolution No. PC90-19 was adopt~d by the Anaheim
City Planning Commission to approve Conditional Use Permit No. 3239 and permit an indoor boat repair,
sales and storage faoility with waiver of minimu:n number of parking spaces (36 proposed, 123 required);
and that said resolution includes the following condition of approval:
11. That no outdoor storage of, display of, or work on boats or boat parts shall
be permitted.
WHEREAS, this property is developed with an indoor boat repair, sales and storage
facility located in Development Area 4(Transit Core Are~) of the Northeast Area Specific Plan (Specific
Plan No. SP94-1); and that the Anaheim General Plan land use designation for this property is General
Industrial; and
WHEREAS, the petitioner requests an amendment to this conditional use permit to permit
the outdoor display of three (3) boats in the existing parking fot area under the authority of Code Sections
+8.03.091 and 18.03.092 of the Anaheim Municipal Code; and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on June 21, 1999 at 1:30 p.m., notice of said public hearing having been duiy given as
required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after d~e inspection, investigation and study made by itself
and in its behalf, and after due consideration af all evidence and reports offered at said hearing, does find
and determine the following facts:
1. That the proposed amendment to the use is properly one for which a conditional use
perr~it is authorized by Anaheim Municipal Code.
2. That the proposed modification, including the imposition of additional conditions, is
reasonably necessary to proter,t the public p~ace, health, safety or general welfare, or necessary to permit
reasonable operation under the conditional use permits as grented.
3. That a site inspection by staff indicate the property and landscaping are well-maintained
and free of trash and debris; and that iherp are no existing Code violations.
4. That no one indicated their presence at the public hearing in opposition to the proposed
amendment; and that no correspondence was received in opposition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim Ciry
Planning Commission has review~d the proposal to amend a condition of approval to permit the outdoor
display of three (3) boats in the existing parking lot area; and does hereby determine that the Negative
Declaration previously approved in connection with Conditional Use Permit No. 3239 is adequate to serve
as the required environmental documentation in connection with this request upo~ finding that the
declaration reflects the independent judgment of the Iead agency and !hat it has considered the Negative
Declaration together with any comments received during the public review process that there is nu
substantial evidence that the project wil{ have a significant effect on the environment.

NOW, THEREFQi2E, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby amend Resolution No. PC90-19, adopted in connection with Conditional Use Permit No.
3239, to amend Condition Nos. 11 and 14 to read:
That no outc~or storage or work on boats or boat parts shall be permitted.
14. That subject property shall be developed substantially in accordance with pians and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file
with the Planning Department marked Exhibit Nos. 2 and 3, and Revision No. 1 of Exhibit
No. 1 as revised at the June 21, 1999 Plannirtg Commission public hearing, to permit the
display of two (2) boats surrounded by landscaping; and as conditioned herein:'
AND BE IT FURTHER RESOLVED that the Plarning Commission does hereby add the
foilowing new condition of approval:
18. That prior to commencing the outdoor display of boats, the petitioner shall submit a final
plan to the Zoning Division showing the display of (2) boats adjacent to, and parallel with,
the south building elevation facing La Palma Avenue with three (3) landscape clusters, as
follows: a land;,cape cluster with trees at the west end, a boat next to that, a landscape
cluster with a tree in the middle, a boat next to that, and a landscape cluster at the end.
Said plan shall be reviewed and approved by the Pianning Commission as a"Reports and
Recommendations" item.
19. That no flags, banners or advertising shall be displayed on the boats.
20. That the petitioner shall pay for any Code Enforcement inspections that result from
complaints received for verified violations.
21. That the three (3) boats shall only be displayed out-of-doors during normal hours of
business operation only.
22. That the display of the three (3) boats shall be accessory to the existing boat repair, sales
and storage facility; and that said out-door display shall b~ discontinued in the event that
the primary sales function ceases. ,
