A RESOLUTION OF THE ANAHEIM CIN PLANNING COMMISSION
REINSTATING AND APPROVING CONDITIONAL USE PERMIT NO. 3032
AND AMENDiNG CERTAIN CONDITIONS OF APPROVAL OF
RESOLUTION NO. PC88-183, AS AMENDED AMD ADdPTED THEREWITH
WHEREAS, on July 6, 1988, the Planning Commission adopted Resolution No. PC88-
183 to permit a semi-enclosed garden church for a period of three years until July 6, 1991, with waiver of
the required improvement of a parking area; and that on July 15, 1991, Resolution No. PC 91-153 was
adopted by the Planning Commission to arriend the conditions of approval and permit the use until July 6,
1994; and that on May 16, 1994, the Planning Commission adopted Resolution Nn. PC94-55 to amend
certai~ conditions and to add certain conditions, including the fol~owing:
5. That this conditional use permit shall terminate in five (5) years on May 16, 1999.
WHEREAS, this property is partially developed with a semi-enclosed church with modular
buildings and an outdoor chapel lo~ated at 8712 East,Santa Ana Canyon Road (The Garden Church);
that the property is located in Development Area 9(Single-Family Residentiai) of the Sycamore Canyon
Specific Plan (SP88-1); and that the property is designated for Open Space by the General Plan Land
Use Element; and
WHEREAS, the petitioner has requested reinstatement of Conditional Use Permit No.
3032 to continue operations of the existing garden church and deletion of Condition No. 5, pertaining to
the time limitation; and
WHF_REAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on June 21,1999 at 1:30 p.m., notice of said public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commi~sion, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed reinstated use is properly one for which a conditionai use permit
is authorized by the Zoning Code.
2. That outdoor chapel and religious services are being conducted within the existing
iacilities as originally approved; and that no changes have been made to the Sycamore Canyon Specific
Plan or the Zoning Code which would affect this conditional use permit.
3. That the reinstated use will not adversely affect the adjoining iand uses and the
growth and development of the area in which it is located. •
4. That the size and shape of the site for ihe reinstatad use is adequate to allow full
development of the proposal in a manner not detrimental to the particular area nor to the ~aace, heaith,
safety and general welf:,r!~,
5. That the traffic generated by the reinstated use will not impose an iandue burden
upon the streets and highways dosigned and improved to carry the traffic in the area.
6. That reinstating this conditional use permit, under the conditions imaosed, wilt not
be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim.

7. TF~at this use permit is being exercised in substantially the same manner and in
conFormance with all conditions and stipulations originally approved by the approval body.
8. That this use permit is being exercised in a manner not detrimental to the particular
area nor ta the surrou~ding lant~ uses, nor to the public peace, health, safety and general wei;~re.
9. Th2t deletion of the time limitation is necessary to permit reasonable operation of
the use under the conditional use permit as originally granted.
40. That no ans indicated their presence at the public hearing in opposition to the
propossi; an~ ihat nv ourr~spondence was received in opposition.
CALtFORNIA ENVIRONMENTAL QUALITY ACT FIAIDING: That the Anaheim City
Flannirrg Cr~rnmission has reviewed the proposal and does hereby find that the Negative Declaration
praviei~sly approved in connection with Conditionai Use Permit No. 3032 is adequate to serve as the
re?~~ired ~nvirc,imental documentation for subject request upon finding that the deciaration reflects the
independzncjudgment of the lead agency and that it has considered the previously approved Negative
Declaration together with any comments received during the public review process and further finding on
lhe basis of the initial study and any comments received that there is no substantial evidence tt-at the
prcject will have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby amend Resolution No. PC88-183, as amended and adopte in connectior with Conditional
Use Permit No. 3032, to reinstate and continue operations of the existin garden church as originally
approved and to delete Conci~cion No. 5.
