A RESOLU'f{~iV OF THE ANAHE(M CITY PLANNING COMMISSION
AMENDING RESC)LUTION NO. PC70-5, ADOPTED IN CONNEC"fI~~N WITH
CONDITIONAL USE PERMIT NO. 1151
WHEREAS, on February 5, 1970, Resolution No. PC70-5 was adopted by the Anaheim
City Planning Commission to grant Conditional Use Permit No. 1151 and perm~: 3 pre-school nursery in
an existing church facility at 800 South Lemon Street; and
WHEREAS, this property is developed with a church facility (Native American United
Metho~~iist Church) in the RM-2400 (Residential, Multi-Family) zone; and that the Anaheim General Plan
designates this property for Low-Medium Density Residential land uses; and
WHEREAS, the petitioner proposes to retain an existing fine arts schooi for
developmentally disabled adults within the existing church facility, including utilization of existing floor
area in the accessory classroom building, under authority of Code Section 18.32.050.040; and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on July 7, 1999 at 1:30 p.m., notice of said public hearing having been duly given as
required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
riear and consider evidence for and against said proposed conditional use permit and to investigate and
make findings and recommendations in connection therewith; and that the hearing was continued from
the meeting of June 7, 1999; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behaif, and after due consideration of ail evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed use is properly one .or which a conditional use permit is authorized by
the Zoning Code.
2. That this conditionai use permit, as amended, will not adverseiy affect the adjoining land
uses and the growth and development of the area in which it is proposed to be located.
3. That the size and shape of the site for the use, as both a church and private education
facility, is adequate to allow the full development of the proposed use in a manner not detrimental to the
particular area nor to the peace, health, safety and generai welfare.
4. That the traffic generated by the use, as amended, will not impose an undue burden upon
the streets and highways designed and improved to carry the tra~c in the area because of the limited
number of students permitted at this facility and because buses are the primary vehicles used to transport
the students.
5. That amending this conditional use permit, under the conditions imposed, if will not be
detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim.
6. That the proposed fine arts school for developmentally disabled adults within an existing
church facility is hereby approved based on this school having been in operation for over three years at
this location without adversely affecting the surrounding neighborhood.
7. That no one indicated their presence at said public hearirig fn opposition; and that no
correspondence was received in opposition to the subject petition.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anahe~m City
Planning Commission has reviewed the proposal to permit a fine arts school for developmentally disabled
adults in an existing church facility on a 1.9-acre rectangula~ly-shaped property located at the southeast
corner of South Street and Lemon Street, with frontages of 240 feet on the south side of South Street and
338 feet on the east side of Lemon Street, and further described as 800 South Lemon Street (Native
Americ2~ United Methodist Church); and does hereby approve the Negative Declaration upon finding that
the declaration reflects the independent judgment of the lead agency and that it has considered the
Negative Declaration together with any comments received during the public review process and further
finding on the basis of the initiai study and any comments received that there is no substantial evidence
that the project will have a significant e~fect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby amend Resolution No. PC70-5, adopted in connection with Conditional Use Permit
No. 1151, to permit a fine arts school for developmentally disabled adults within an existing church facility,
including utilization of existing floor area in the accessory classroom building, under authority of Code
Section 18.32.050.040; and
BE IT FURTHER RESOLVED that the following conditions of approval are added to said
resolution:
5. That all students transported by car or private bus shall be dropped off at a designated
vehicle loading/unloading zone in the parking lot. Location of said drop-off area shall be
approved by the City Traffic and Transportation Manager.
6. That plans for re-striping the parking lot shali be submitted to the City Tra~c and
Transportation Manager for review and approval showing conformance with the most
current versions of Engineering Standard ?lan Nos. 436 and 602 pertaining to parking
standards and driveway locations. Subject property shall thereupon be re-striped within a
period of one (1) month from th,• date the pl~n was approved, and maintained thereafter
in conformance with said approved plan.
7. That trash storage ar2as shail be refurbished to the satisfaction of the Public Works
Department, Streets and Sanitation Division, to comply with approved plans on file with
said Department, including the instaliation of gates.
8. That the existing un-permitted freestanding sign adjacent to Lemon Street shall be
removed; and that signage for this property shall be limited to one (1), maximum twenty
(20) square foot, wall sign facing Lemon Street.
9. That the maximum number of students shall be limited to fifty (50) students enrolled at
any one time.
10. That the hours of operetion of this school shall be limited to Mondays through Fridays,
from 8:00 a.m. to 3:30 p.m. Incidental evening programs and meetings shall not exceed
two (2) per month; and said evening activities shall not be conducted in such a manner
so as to disturb the surrounding residential neighborhood.
11. That there shall be no housing of students at this facility.
12. That this school use shali be limited to a fine arts school for developmentally disabled
adults in the existing church.
13. That subject property shall be developed substantiaily in accordance with plans and
specifica;ions submitted to the City of Anaheim by the petitioner and which plans are on
file with the Planning Department marked Revision No.1 of Exhibit No. 1.

14. That within a period of ane (1) month from the date of this resolution, Condition No. 8,
above-mentioned, shall be complied with.
15. That within a period of two (2) months from the date of this resolution, Condition Nos. 5
and 13, above-mentioned, shali be complied with.
16. That appraval of this application constitutes approval of the proposed request only to the
extent that it cumplies with the Anaheim Municipal Zoning Code and any other applicable
City, State and Federal regulations. Approvai does not include any action or findings as
to compliance or approval of ttie request regarding any other applicable ordinance,
regulation or requirement.
17. That within a geriod of one (1) year from the date of this resolution, Condition Nos. 6 and
7, abuve-mentioned, shall be compiied with.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption oT this Resolution is expressly predicated upon applicanYs compliance
with each and ali of the conditions hereinabove set forth. Should any uch condition, or any part thereof,
be declared invalid or unenforceable by the final judgment of any co competent jurisdiction, then this
Resolution, and any approvals herein contained, sh~ll be,~em nul d void.
