A RESOLUTION OF THE ANAHE!M CiTY PLANNING COMMISSION
AMENDING CERTAIN ~ONDITIONS OF APPRO~/AL OF
RESOLUTION NO. PC91-183 ADOPTEL' {N CONNECTION WITii
CONDITIaNAL USE PERMIT NO. 3468
WHEREAS, on November4, 1991, Reso~ution No. PC91-1E3 was adopted by tha
Anaheim City Panning Commission to grant Conditionai Use Permit No. 3468 and permit a child day care
center in conjunction with an existing church and private school facility at 2219 West Orange Avenue;
and that said resolutior includes the following condition of approval:
That a maximum of fifty (50) children may be enrolled in subject child care
center at any one time.
WHEREAS, the property is developed with a church and private school (Faith Lutheran
Church) with an accessory day care center in the IRS-A-43,000 (Residential/Agricultural) zone; and that
the Anaheim General Plan designates the property for Low Densiry Residential land uses; and
WHEREAS, the petitioner has requested amendment or deletion of Condition No. 9 to
increase the maximum number of children to 75; a~d
WHEREAS, the City Planning Commission did hold a pubiic hearing at the Civic Center in
the City of Anaheim on July 7, 1999 at 1:30 p.m., notice of said public hearing having been duly given as
required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evidence fer and against ~aid proposed conditional use permit and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behaif, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the petitioner requests amendment to this conditional use permit under authority of
Subsection 18.03.092.060 of the Anaheim Municipal Code to increase the maximum number of children
attending the day care center to seventy five (75).
2. That the proposed modification is reasonabiy necessary to protect the public peace,
health, safety and general welfare, and necessary to permit reasonable operatian under the conditional
use permit as originally granted.
3. That the use, as amended, will not adversely affect the adjoining land uses and the
growth ard development of the area in which it fs located.
4. That this use has been, and will continue to be, compatlble with the surrounding single-
family and commercial land uses in and around the area.
5. That this has been exercised in a manner not detrimental to the particular area and
surrounding land uses, nor to the publ(c peace, health and safety and general welfare.
6. That no one indicated their presence at the public hearing in opposition to the proposal;
and that no correspondence was received in opposition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDIN~: That lhe Anahefm C(ty
Planning Commission has reviewed the proposai to amend or delete a condition of approval pertaining to
the maximum number of children permitted for an existing day care center in conjunction with a church

and private schooi facility located on a rectangula~ly-sthaped 2.4-acre p; operty having a frontage of 458
feet on the north side of Orange Avenue, a max(mum clepth of 220 feet, be.ng located 200 feet west of the
centeriine of Brookhurst Street, and further described as 2219 West Orange Avenue (Faith Lutheran
Church); and does hereby find that the Negative Declaration previously approved fn connection with
Conditional Use Permit No. 3468 is adequate to serve as the required environmentai documentation in
connection with this request upon finding that the declaration reflects the (ndependent judgment of the
lead agency and that it has considered the previously approved Negative Declaration together with any
comments received during the public review process and further finding on the basis of the initial study
and any comments received that thero is no substantiai evidence that the project will have a s(gnificant
effect on the environment.
NOW, TtiEF2EFORE, BE IT RESOLVED that the Anaheim City Planning Commissfon
does hereby amend Condition No. 9 of Resolution No. PC91-183, adopted fn connection with Conditional
Use Permit No. 3468 to read as follows:
9. That a maximum of seventy five (75) children may be en olled in subject child care center
at any one time.
