A RESULUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING CERTAIN CONDITIONS OF APPROVAL OF
RESOLUTION N0. PC98-98 ADOPTED IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 4033
WHEREAS, on June 22, 1998, Resoiution No. PC98-98 was adopted by the Anaheim
City Planning Commission to grant Conditionai Use Permit No. 4033 and permit a 29,503 square foot
church with accessory day care center, feliowship hall, and multi-purpose bu(Iding in conjunction with
existing modular buildings at 8712 East Santa Ana Canyon Road; and
WHEREAS, the property I; partially developed with a church (The Garden Church)
including modular buildings and an outdcor chapel; that the property is located in Development Area 9
(Single-Family Residential) of SP88-1 ;Sycamora Canyon Specific Plan); and that the Maheim General
Plan designates this property far ^pen Space land uses; and
WHEREAS, the petitloner has requestecl approval of revised plans to add a 2,500 square
foot manufactured house to the previously approved c6~urch facility (to be a parsonage, i.o., a res(dence
for the pastor of the church), and amer.dment of certain condit(ons pertaining to landscaping (to permit
landscaping to bo installed prior to final building and zoning inspoctions instead of prior to issuance of a
building permit} and roof-mounted equipment (to permit roof-mounted equipment on the proposed
parsonage); and
WHEREAS, Condition Nos. 8, 10, 17, 19 and 20 of Resolution No. PC98-98 pertain to
roof-mounted equipmenl being prohfbited (No. 8), installation of landscaping (No. 10), development of the
property in accordance with approved exhibits (No.17), the specifi~ conditions required to be completed
prior to issuance of a buiiding permit or within a period of one year from the date of the approval resolution
(No. 19), and the speciBc condit(ons required to be completed prior to final bu(Id(ng and zon(ng inspections
(No.20); and
'.VHEREAS, the City Pianning C.mmfssion did hold a public hearing at the Civic Center in
the City of Anaheim on July 19, 1999 at 1:30 p.m., ~~ot(ce nf said public hearing having been duly given as
required by law and in accordance with the provis(ons of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evidence for and against said proposed amendr~,ants and to investigate and make
findings and recommendations in cennectfon therewith; and that the hearing was continued from the
meeting of June 21, 1999; and
WHEREAS, said Commissfon, after due !~~pection, investigation and study made bv
itself and in its behalf, and after due consideration of all evidence and reports offered et said hearfng,
does find and determine the following facts:
1. That the petitfoner requests amendment to th(s conditfonal use permit under authority of
Subsection 18.03.090 of the Anahefm Mun(c(pal Code !o ~dd a 2,500 square fnot manufactured house to
the previously approved church faciliry, to allow landscaping to be (nstalled prfor to occupancy rather than
prior to (ssuance of a building permit, to permit roof-mounted equipment, and that Condition Nos. 8, 10,
17, 19 and 20 be amended accordingly,
2. That the use, as amended to incii.!de a parsonage, is properly one for which a conditional
use permit is authorized by the Zoning Code.
3. That following pubiic notiflcatfon, the petitioner withdrew the request for roof-mounted
equfpment on the parsonage.

4. That the use, as amended, will not adversely affect the adjoining land uses and the
growth and development of the area in which it is proposed to be located.
5. That the size and shape of the site for the use, as amended, is adsquate to allow fuli
development of the proposed use in a manner not detrimental to the particular area nor to the peace,
health, safety and general welfare.
6. That the traffic generated by the use, as amended, will not impose an undue burden upon
the streets ~nd highways designed and improved to carry the traffic in the area.
7. That amending this conditional use permit, under the conditions imposed, will not be
detrimentai to the peace, health, safety and generai welfare of the citizens of the City of Anaheim.
8. That this use is being exercised in a manner not detrimental to the particular area and
surrounding land uses, nor to the public peace, health and safety and general welfare.
9. That the proposed amendments, as approved, are necessary to permit reasonable
operation of the use under the permit as granted.
10. That no one indicated their presence at the public hearing in opposition to subject
netition; and that no correspondence was received in opposition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDfNG: That the Anaheim City
Planning Commission has reviewed the proposal to permit a manufzctured home for a parsonage and to
amend certain conditions of approval pertaining to landscaping and roof-mounfed equipment in
conjunction with the previously-approvr,d church facflity located on an irregularly-shaped 65.8-acre
property having a frontage of 155 feet on the south side of Santa Ana Canyon Road, a maximum depth of
1,100 feet, being located 3,759 feet west of the centerline of Gypsum Canyon Road at 8712 East Santa
Ana Canyon Road (The Garden Church); and does hereby find that the Negative Declaration previously
approved in connection with Conditional Use Permit No. 4033 is adequate to serve as the required
environmental documentation in connection with this request upon finding that the declaration reflects the
independent judgment of the lead agancy and that it has considered the prev(ously approved Negative
Declaration together with any comments received during the public review process and further finding on
the basis of the initial study and any comments received that there is no substantial evidence that the
project wili have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planr.ing Commission
does hereby amend Resolution No. PC98-98, adopted in connection with Conditional Use Permit No.
4033, to permit a manufactured hom~:s as a parsonage for this church facility and to amend Condition Nos.
17, 19 and 20, to read as follo~rs:
17. That subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on file
with the Plannin,g Department marked Revision No. 1 of Exhibit No. 1 and Exhibit Nos. 2
througli 19, and as conditioned herein, including that the composition roof material for the
manufac::.red house shall be brick-colored, that a minimum of two (2) trees shall be planted
to the south and east of the safd house, and that any exterior air conditioning unit(s) shall be
ground-mounted and screened in accordance with Condition No. 8 herein.
19. That prior to issuance of a bu?Iding permit or within a period of one (1) year from the date of
this resolution, whichever occurs first, Condition Nos. 1, 2, 3, 4, 5, 6. 7, 8, 13 and 16,
above-mentioned, shall be complied with. Extensions for further time to complete :,~id
conditions may be granted fn accordance w(th Section 18.03.090 of the Anaheim ;vlunicipai
Code.

20. That prior to fina! building and zoning inspections, Condition N s. 10 and 17,
above-mentioned, shall be coznplied with.
