A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING RESOLUTION NO. PC90-24
ADOPTED Il~f CONNECTION W!Ti-1 CONDITIONAL USE PERMIT NO. 3235
WHEREAS, on January 29, 1990, Resolution No. PC90-24 was adopted by the Anaheim
City Planning Commission to approve ~onditional Use Permit No. 3235 and permit an auto sales and service
center with waivers of minimum number of parking spacP~, minimum structural setback and required
improvement of parking areas on propsrty located at 1381 East Auto Center Drive; and
WHEREAS, this property is developed with an automobile sales and repair facility (Hardin
Honda) in the CL (Commercial, Limited) zone; and that the Anaheim General Plan designates the property
for General Commercial land uses; and
WHEREAS, the petitioner requests amendment to this conditionaf use permit to con~tn~ct a
new display canopy, enclose an existing canopy, and construct a new mezzanine storage area within the
axisting auto sales and repair faciliry, and for waivers of maximum height of a freestanding sign, minimum
sight distance requirements for a freestanding sign and minimum number of parking spaces; and
WHEREAS, the City Planning Commissian did hold a public hearing at the Civic Center in
the Ciry of Anaheim on September 13, 1999 at 1:30 p.m., not~ce of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim blunicipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed conditional use permit and to investigate
and make findings and recommendations fn connection therewith.
WHEREAS, said Commission, after due inspection, investigation and study made by itself
and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the following facts:
1. That the proposed use is properiy one for which a conditional use permit is authorized by
Anaheim Municipal Code Sections 18.44.050.060 and 18.44.050.085 to construct a new display canopy,
endose an existing canopy and construct a new meuanine storage area within an existing auto sales and
repair facility, and with waivers of the following:
(a) Sectiuns 18.05.093.050 - Maximum heiqht of freestanding sian.

(b) Sections 18.05.093.070 - Minimum siQht distance requirements for freestandinq siqns,

2. That waiver (a), maximum sign height, is hereby approved, in part, to allow a 23-foot high
sign to match the existing sign, wiiich will be removed, because the property is surrounded with othE: sfmilar
land uses in the same zoning and which have similar signs.
3. That waivers (b) and (c), minimum s~ght distance requirements for freestanding signs and
minimum number ~f p~rking spaces, are hereby denfed because they were deleted foliowing pubiic
nolification.
4. That the preposed modification, as approved and i~cluding the imposition of additional
conditions, is reasonably necessary to protect the public peace, heaith, safety or gQneral welfare, and
necessary to permit reasonable operation under this conditional use permit as originally granted.

5. That no one indicated their presence at the public hearing in opposition to the proposal; and
that no correspondence was received in opposition.
CALIFORNIA ENVIRONMENTAL QUAL1IY ACT FINDING: That the Anaheim City Pianning
Commission has reviewed the proposal to amend Conditional Use Permit No. 3235, including certain
conditions of approval, to construct ~ ~ew display canopy, enclose an existing canopy and construct a new
mezzanine storage area within an existing auto sales and repair facility, and with waivers of maximum height
of a freestanding sign, minimum sight distance requirements for a freestanding sign and minimum number of
parking spaces on an irregularly-shaped 2.3-acre property located north of the westerly terminus of Auto
Center Drive, with a frontage of 350 feet on the north side of Auto Center Drive, a maximum depth of 463
feet and being located 1,400 feet west of the centerline of Phoenix Club Drive (1381 East Auto Center Drive);
and does hereby determine that the Negative Declaration previously approved in connection with Conditional
Use Permit No. 3235 is adequate to serve as the required environmental documentation in connection with
this request upon finding that the declaration reflects the independent judgment of the lead agency and that it
has considered the Negative Declaration together with any comments received during the public review
process that there is no substantial evidence that the project will have a significant effect on the environment.
NOW, THERFFORE, BE IT RESOLVED that the Anaheim C~ty Planning Commission does
hereby amend Resolution No. PC90-24, adopted in connection with Conditional Use Permit No. 3235, to
permit construction a new display cancpy, enclose an existing canopy and construct a new mezzanine
storage area within an existing at~to sales and repair facility under authority of Anaheim Municipai Code
Sections 18.44.050.060 and 18.44.050.085, and with waivers of the following:
(a) Sections 18.d5.093.050 - Maximum height of freestandinq sian.

BE IT FURTHER F2ESOLVED that Conditio~~ Nos. 6, 7 and 18 of Resolut~on No. PC90-24
are hereby amended to read as follows:
That priar to issuance of a building permit, plans shall be submitted to the City Tra~c and
Transportation Manager for review and approval showing conformance with the most current
versions of Engineering Standard Pian Nos. 436 and 602 pertafning to parking standards and
driveway locatians. Subject prope~ty shall thereupon be developed and maintained in
conformance with said plans.
That the one hundred ninety seven (197) parking spaces shown on Revision 1 of Exhibit Nos.
1 and 4, submitted by the petitioner, shall not be occupied by any use other than customer,
visitor or employee parking, nor shall said spaces be utiiized for vehicle storage or display.
1 P That prior to final buifding and zoning inspections, subject property snall be developed
substantiaily in accordance wit~i plans and specifications submiµad to the Ciry of Anaheim by
the petitioner and which plans are on fiie with the Planning Department marked Revision No. 1
of Exhibit Nos. 1, 2, 3 and 4, and Exhibit Nos. 5, 6, 7, 8 a~d 8a; provided, however, that
landscaping consisting of minimum fifteen (15) gallon sized trees shall be placed across the
roof parking area and that the maximum height of the freestandir.g sign shall be twenty three
(23) feet.
BE IT FURTHER RESOLVED that Condition No. 16 pertaining to signs in the ML (Limited
Industrial) Zone is hereby deleted; and

22. Zhat prior to finai building and zoning inspection~, minimum five (5) gallon size shrubs shall be
plant~d around the ~xlsting above-ground utility device along Auto Center Drive to screen it
from the public's view.
23. That no vehicles may be displa~~ed in any landscaped areas. Any such existing display shali
k~e removed.
24. That prior to issuance of a building permit, plans shall be submitted to the City Tra~c and
Transportation Ma~ager for review and approvai showing conformance with Engineering
Standard No. 137 pertaining to sight distance visibility for the sign location. The overall height
of said sign shail be reduced to a maximum of lwenty three (23) feet.
25. That roof-mounted inflatable devices shall not be permitted.
26. That the sign copy on the freestanding sign shall be limited to that which is shown on Exhibit
No. 8a. Any additional or different sign copy shall be submitted to the Planning Con~mission
for review and approval as a"Reports and Recommendations" item.
27. That signage for subject facility shall be limited to that which is shown on the exhibits
submitted by the petitioner and approved by the Planning Commission. Any additional signs
shall be submitted to the Planning Commission for review and approval as a"Reports and
Recommendations" item.
28. That no vending machine(s) shall be visible to any public right-of-way.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
September 13, 1999.
