A RESOLUTION OF THE ANAHEIM CITY PLANNING COfV1MlSSION
THAT PETITION FOR RECLASSIFICATION NO. 99-00-08 BE GRANTEG, UNCONDITIONALLY
WfiEREAS, the Anaheim City Planning Commission did receive a verified peGtion for
Reclassification for real property situated in the City of Anaheim, County of Orange, S!ate of California,
described as follows:
THE NORTH HALF OF THE EAST HALF OF THE SOUTHEAST QUARTER
OF THE SOUTHEAST ~UARTER OF SECTIOIV 11, TOWNSHIP 4 SOUTH,
RANGE 11 WEST, RANCHO LOS COYOTES, IN THE CITY OF ANAHEIM,
COUNTY OF ORANGE, STATE OF CALIFORNIA, OF MISCELLANEOUS
MAPS FILED IN BOOK 51, PAGE 11 O~ PARCEL MAPS.
EXCEP'TING THEREF~OM THE FOLLOWING:
THAT PORTION OF THE EAST HALF OF THE SQUTHEAST QUARTER
OF THE SOUTHEAST QUARTER OF SECTION 11, TOWNSHIP 4 SOUTH,
RANGE 11 WEST, SAN BERNARDINO MERIDIAN, INCLUDED WITHIN A
STRIP OF LAND 110 FEET WIDE LYING 44 FEET ON EACH SIDE OF THE
FOLLOWING DESCRIBED CENTERLINE:
BEGINNING AT THE SOUTHEAST CORNER OF SAID SECTION 11 (THE
WEST LINE OF SECTION 13 OF SAID TOWNSHIP AND RANGE BEARS
SOUTH 0° 09' 50" EAST, FROM SAID SOUTHEAST CORNER; THENCE
ALONG THE EAST LINE OF SAID SECTION 11, (SAID EAST LINE BEING
ALSO THE CENTERLINE OF STANTOPJ AVENUE, 60 FEET WIDE, AS
DECLARED BY ACTION OF BOARD OF SUPERVISORS OF SAID

4VHEREAS, the City Planning Commission did hoid a public hearing at the Civic Certer
in the Ciry of Anaheim on October 11, 1999 at 1:30 p.m., notice of said pubiic hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed reclassification and to investigate
and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, fnvestigation and study made by
itseif and in its behalf, and after due consideration ot ail evidence and reports offered at said hearing,
does find and determine lhe following facts:
1. That the petitioner proposes rec!assification of subject property from the RS-A-
43,000 (Residential lAgricuitural) and CL (Commercial, Limited) zones to the CL (Commercial, Umited)
zone.

2. That the Anaheim General Plan designates the praperty for Medium Density
Residential and General Commercial land uses; and that the Planning Commission approved General
Plan Amendment No. 369 (which is being processed concurrently with this reclassification) to redesignate
the entire property for General Commercial land uses.
3. That the proposed reciassificatian of subject property is necessary and desirable
for the orderly and proper deve!opment of the community.
4. That reclassiflcation of this property is cainpatible with the zoning of surrounding
properties which also have frontage on Beach Boulevard; that reciassification wiil establish consistent
land use and site devElopment standards for the area; and that reclassification will encourage
estabiishing commerciat uses along Beach Bouievard, a malor arterial highway and an "entry gateway"
into the City of Anaheim.
5. That the proposed reclassification does properly relate to the zones and their
permitted uses locally established in ciose proximity to subject property and to the zones and permitted
uses generally establishe;i throughout the community.
6. 7k~at no one indicated their presence at'f;e pubiic hearing in opposition to ihe
proposal; and that no correspondence was received in oppositi~n.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Ar~aheim City
Pianning Commission has reviewed the proposal to reclassify subject property from the RS-A-43,000
(Residential/Agricultural} and CL (Commercial, Limited) zunes to ty~e CL (Commercial, Limited) zone on
an irregularly-shaped 8.5-acre parcel having a frontage of 874 ~eet on the west side of Beach Boulevard,
a maximum depth of 609 feet, being located 660 feet r,orth of the centerline of Lincoln Avenue, and
further described as 221 and 311 North Beach Boulevard (a restaurant and Anaheim Vacation RV Park);
and does hereby approve the Negative Declaration ~pon finding that it has considered the Nagative
Declaration together with any comments received during the public review process and further finding on
the basis of the initial study and any commEnts received that there is no evidence that the proJect will
have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Ciry Planning Commics(on
does hereby approve the subject Petition for Reciassification, unconditionally, to authorize an amendment
to the Zoning Map of the Anaheim Municipal Cod~ to exciude the above-described propeity from the
RS-A-43,000 (ResidentiallAgricultural) and CL (Commercial, Limited) Zones and to incorporate said
described property into the C!. (Commer.ial, Lirnited) Zone,
BE IT FURTHER RESc)LVED that the Anaheim City Planning Cumm(ssion does hereby
find and determine that adoptiun of this Resotution is expressly predicated uFon applicant's compliance
with each and all of th2 conditions hereinabove set forth. Should any such conditions, or any part
thereof, be decl~red invalid or unenfarceabte by the final judgment of any court of competent jurisdiction,
then this Resr,!~!tion, and any approvals herein cnnta(ned, shail be deemed ~uli and void.
SE IT FURTHER RESOLVED, tt~at this resolution shall not r,onstitute a rezoning of, or a
commitment by the City to rezone, the subject property; any srch rezoning shali rec;uire an ordinance of
the City Council which shall be a legislative act which may be approved or denied by the City Council at
its sole discretion.
