A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETI i iJN FOR RECLASSIFICATION NO. 98-99-09 BE GRANTED, UNCQNDITIONALLY
WHEREAS, the Anaheim City Planning Commission did receive a verified petition for
Reciassification for real property situated in the City of Anaheim, County oF Orange, State of Califomia,
described as follows:

WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of r~naheim on February 1, 1999 at 1:30 p.m., notice of said public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evi~ence for and against said proposed reclassification and to investigate and make
findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study mada by
itself and in its behalf, and after due consideration of all evidence and rep~rts offered at said hearing, does
flnd and determine the following facts:
1. That this reclassification is a Ciry-initiated reclassification of the subject properties from
the CG (Commercial, General) Zone to the CL (Commercial, I_imited) Zone.
2. That the Anaheim General Plan designates subject property for the General Commercial
land usPs.
3. That the proposed reclassification of subject property is necessary and/or desirable for
the orderly and proper develcpment of the community.
4. That the proposed reclassification of subject property does properly relate to the zones
and their permitted uses locally established in close proximity to subject property and to the zones and
their permitted uses generally established throughout the community.
6. That one person indicated their presence at said public hearing in opposition; and that rio
correspondence was received in opposition to subject petition.
CALIFORNIA ENVIRONMENTAL QUALI7Y ACT FINDING: That the Anaheim City
Planning Commission hias reviewed the proposal to reclassify subject property from the CG (Commercial,
General) Zone to the CL (Commerciai, Limited) Zone on a 1.6-acre area consisting of four separate
parcels described as foliows: Parcel A: A rectangularly-shaped parcel having a frontage of 97 feet on the
north side of Lincoln Avenue, a maximum depth of 176 feet, -~nd locaked 302 feet west of ihe centerline of
Magnolia Avenue (2623 West Lincoln Avenue); Parcel B: A rectangularly-shaped parcel having a frontage
of 97 feet on the north side of Lincoln Avenue, a maximum depth of 176 feet, and located 175 feet west of
the centerline of Magnolia Avenue (2607 West Lincoln Avenue); Parcel C: A rectangularly-shaped parcei
located at the northwest corner of L,incoln Avenue and Magnolia Avenue, having frontages of 122 feet on
ihe north side of Lincoln Avenue and 125 feet on the west side of Magnolia Avenue (2601 West Lincoln
Avenue); Parcel D: A rectangulariy-shaped parcel having a frontage of 163 feet on the west side of
Magnolia Avenue, a maximum depth of 122 feet, and located 165 feet north of the centerline of Lincoln
Aver~ue (109, 111, 115, 117 and 119 North Magnolia Avenue); and does hereby approve the Negative
Declaration upon finding that the declaration reflects the independent judgmant of the lead 2gency and
that it nas considered the Negative Declaration together with any comments received during the public
review process and further finding on lhe basis of the initial study and any comments received that there is
no substantial evic'ence that the project will have a significant effect on the environment.
NQW, THEREFORE, BE IT RESOLVED th2t the Anaheim City Planning Commission
does hereby approv~ the subject Petition for Reclassification, unconditionally, to authorize an amendment
to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property from the CG
(Commercial, General) Zone and to inc;orporate said described property into the CL (Commercial, Limited)
Zone.
BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a
commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of
the City Council which shall be a legislative act which may be approved or denied by the City Council at its
sole discretion.
