RESOLUTION NO. PC99-222
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING CERTAIN CONDI?IONS OF APPROVAL OF
RESdLUTION NO. 96R-208, ADOPTED IN CONNECTION WITH
VARIANCE NO. 4292
WHEREAS, on December 17, 1996, Resolution No. 96R-208 was adopted by City Council
to grant Variance No. 4292 and permit waiver of maximum structurai height, minimum landscaped
setback adjacen: to a residential zone, minimum setback adjacent to a scenic highway, minimum setback
adjacent to a local street, and required parking lot landscaping to construct a 2-story office building at
5481 East Santa Ana Canyon Road; and that said resolution included the following condition of approval:
"14. That subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are on
file with the Planning Department marked Revision No. 2 of Exhibit Nos. 1 and '2, and
Revision No. 1 of Exhibit Nos. 3 and 4, with the exception of those changes required by
these conditions of approval "
WHEREAS, this property is developed with a 2-story office building (Seven Gables Real
Estate) in the CO(SC) (Commercfal, Office and Professional - Scenic Corridor Overlay) zone; and that
the Anaheim General Plan designates the property for Commercial Professional land uses; and
WHEREAS, the petitioner has requested and amendment to said condition of approvai for
revised plans pertaining to enhancements t~ the exterior of the existing office bu,iding, including
decorative lights and awnings, and relocating the existing wall sign to the second flo~r.
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on December 6, 1999, at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to he~r and consider evidence for and aga(nst said proposed amendment and to investigate and
make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by itself
and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find .
and determine the following facts:
1. That the proposed modifications to tfie building are described in the Staff r~eport to the
Pianning Commission dated December 6, 1999
2. That the proposed modification, including'the imposition of additional conditions, i~
reasonably necessary to protect the public peace, health, safety or general welfare, or necessary to
permit reasonabl~s operation under the variance as originally granted.
3. That the proposed relocation of the existing wail sign is hereby denied.
4. That one person spoke at the public hearing fn opposition to the proposal; and thet two
letters were received in opposition.

. CALiFORNIA ENVIRONMENTAL QUALITY ACT FINDIhG: That the Anaheim City
Planning Commission has reviewed the proposed revised plans pertainir~g to enhancements to the
exterior of the existing office building, including decorative lights and awn~.igs and relocating the existing
wall sign to the second floor on property located at the northwest corner of Santa Ana Canyon Road and
Maude Land, having approximate frontages of 1,008 feet on th? north side of Santa Ana Canyon Road
and 107 feet on the west side of Maude Lane, and further described as 5481 East Santa Ana Canyon
Road; and does hereby find that the Negative Declaration previously approved in connection with
Varian~e No. 4292 is adequate to serve as the required environmental documentation in connection with
this request upon finding that the declaration reflects the independent judgment of the lead agency and
that it has considered the ~reviously approved Negative Declaration together with any comments
received during the public review process and further finding on the basis of the initial study and any
comments received that there is no substantial evidence that the project will have a significant effect on
the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby amend Condition No. 14 of Resolution No. PC99-222 to read as foilows:
14. That subject property shall be developed substantially in accordance with plans and
specifications submitted to the City of Anaheim by the petitioner and which plans are
on file with the Planning Department marked Revision No. 2 of Exhibit Nos. 1 and 2,
and Revision No. 1 of Exhibit Nos. 3 and 4; provided, however, that the proposed
relocation of the wall sign is denied, and with the exception of those changes required
by the~e conditions of approvai.
A~!D BE IT FURTHER RESOLVED that the Planning Commission does hereby add the
following new conditions of approval to said resolution:
22. That there shail be no advertising permitted on the awnings, that the awnfngs shall be a
hunter green, and that any request to modify the awnings (including color) shall be
~ubmitted to the Zoning Division for Planning Commission review and approval as a
"Reports and Recommendations" item.
23. That the property owner shall maintain these awnings and that damaged, torn or
stained fabric awnings shall be repaired and/or replaced within forty eight (48) hours.
24. That should the awnings be removed, the supporting frame shall also be removed and
the building face shall be refinished to its original condition.
